- The National Institute of Standards and Technology (NIST) intends to negotiate on a sole source basis, under the authority of FAR 13.106-1(b) (1), with Bruker AXS Inc located at 5465 East Cheryl Parkway, Madison, WI to acquire the repair of a NIST owned Bruker S2 Picofox portable benchtop spectrometer which has stopped functioning. The sole source justification is based on the following: The Bruker S2 PicoFox is a limited production standalone instrument used to characterize trace elemental composition from dried liquid residue. The tool uses a Total reflection phenomena to amplify normal X-Ray Fluorescence in order to measure smaller elemental trace quantities than other X-ray fluorescence instruments can achieve. This ‘TXRF' method is still relatively new in the field, and therefore few instrument repair facilities have the capability to service these instruments, let alone the proprietary parts and technology to repair this specific instrument. Bruker is the original manufacturer of this equipment and is the only source reasonably available with the proprietary technical capabilities to fulfill this service. Bruker is the sole provider of certified service engineers and facilities that are capable of providing authorized repairs for this spectrometer. Bruker does not have any authorized repair partners who have access to the proprietary technology, tools, and procedures required to repair the spectrometer. Given these facts, Bruker AXS is considered the only source reasonably available to provide the required service. The resulting purchase order will be a Firm Fixed Price purchase order. The NAICS Code is 811219 with a size standard of 20.5M. No solicitation package will be issued. This notice of intent is not a request for competitive quotations; however, interested parties who regard themselves as capable of fulfilling these requirements are invited to submit responses to the Government for consideration. Responses received by 11:00 am EST 05 July 2017, will be considered by the Government. A determination by the Government not to compete the proposed acquisition based upon responses to this notice is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement.
