- Page 1 of 1 INTENT TO SOLE SOURCE NOTICE This is not a request for quotes or proposals. VA Pittsburgh Healthcare System (VAPHS) has a 3 year requirement to commence on 10/01/2017 for the fulfillment of prescriptions at Pharmacies within a short distance from the five (5) contracted Community Based Outpatient Centers where Veterans receive healthcare services. Prices consist of a distribution/administrative fee and a price for the prescription itself, either generic or brand name, for which a discount is obtained. Prescriptions filled must be listed on an approved VA formulary. Network Contracting Office 4, supporting VAPHS, intends to enter into sole source negotiations with Heritage Health Solutions, Inc. for this requirement citing authority defined under 38 U.S. Code 8127 -Small business concerns owned and controlled by Veterans: contracting goals and preferences. The criteria include: (1)Such concern is determined to be a responsible source with respect to performance of such contract opportunity; (2) the anticipated award price of the contract (including options) will exceed the simplified acquisition threshold (as defined in FAR 13.000) but will not exceed $7,000,000; and (3) in the estimation of the contracting officer, the contract award can be made at a fair and reasonable price that offers best value to the United States. Further guidance is provided in VA Acquisition Regulations 819.7007 which further states in part: (b) The contracting officer s determination whether to make a sole source award is a business decision wholly within the discretion of the contracting officer. A determination that only one Service Disabled Veteran Owned Small Business (SDVOSB) concern is available to meet the requirement is not required. (c) When conducting a SDVOSB sole source acquisition, the contracting officer shall ensure businesses are registered and verified as eligible in the VIP database prior to making an award.
