- STATEMENT OF WORK FOR Tree Clearing PROJECT _________ Tree Clearing JBL-E Ft. Eustis, VA 22 May 2017 •1. GENERAL REQUIREMENTS: All work associated with this project is classified as construction. The following is a list of principle work items. Additional work that is not listed but may be required to accomplish the desired results is inclusive in the project scope. The Contractor shall provide except as otherwise expressly provided herein: all adequate and competent labor, supervision, tools, equipment, incidentals, installed and comsumable materials, transportation, services, quality assurance and field investigations of JBL-E Tree Clearing Project and associated work herein after generally called the Site Clearing Work. The Contractor confirms the he is an expert in this field of work and is fully knowledgeable and experienced in all aspects of procedures, methods, regulations, codes and municipal requirements and the Contractor further acknowledges that JBL-E is relying on this expertise. The contractor shall prepare documents according to the General Provisions, Clauses, and SOW for the following scope. •2. SCOPE: The Contractor shall provide all labor, materials, and equipment to cut and remove all merchantable timber within approximately 23.03 forested acres of installation land. Work shall be in accordance with contract specifications, drawings, and technical requirements as set forth below. The Contractor shall conduct all work without interruption to the military mission and ensure that egress roads remain free and clear of debris associated with the logging activity during the duration of the construction. •a. Tree Cutting and Removal i. The Contractor shall commercially clear approximately twenty three point zero three (23.03) acres of forest as specified in Site Clearing Plan at the JBL-E military installation, Newport News, Virginia. The Contractor shall harvest the merchantable timber and clear the site by way of commercially cutting and removing timber, the trees hereinafter are called Site Clearing Areas. The Contractor shall be required to comply with all of the necessary permits for this project, all of which have already been obtained by the Government. Project sites are attached as map(s). ii. The timber shall be harvested and removed in accordance with accepted good forestry practices as outlined by the Virginia State Department of Forestry Best Management Practices. The Contractor shall be certified by the Virginia SHARP logger certification program. iii. Site clearing activities include removal of trees and vegetation above ground, but will not include grubbing or removal of root balls and stumps. Undergrowth up to a nominal diameter at breast height (DBH) of five inches (5") will be chipped and/or ground using mobile forestry equipment. Standing timber above a nominal diameter of five inches (5") will be harvested using specialized industry specific clearing equipment and logging practices. The Contractor shall leave stumps of harvested trees in place no higher than twelve inches (12") above ground, except when rare obstacles; stones, metal or roots will make the cutting of the stump to the required twelve inch (12") height impracticable. Trees shall be removed from the site as logs or chipped and removed; the limbs and vegetative debris generated by logging activities will be chipped, shredded, ground or mulched, and removed from the site or used as cover to minimize erosion or as a sediment control berm at the discretion of the Contracting Officer Representative. All material from logging activities shall be removed from the Site Clearing Areas by the Contractor. There will be no long-term piles of vegetative matter. After removal from the job site, all logs, wood, brush and any other debris become the property and responsibility of the Contractor. iv. Liquidated Damages: The Contractor shall pay as liquidated damage, the sum of one dollar ($5.00) for each stump not cut pursuant to the provisions of condition iii. above. Overlooked trees designated for harvest must be cut as soon as the Contractor is notified. For each such designated tree which is not cut, the Contractor shall pay at the rate of one dollar ($1.00) per inch of diameter at breast height (DBH) outside bark. The Contractor shall pay a sum amounting to three times the appraised value for all undesignated trees containing merchantable material which are cut, injured through carelessness, or killed by fires which he/she, his/her employees, sub-contractors or employees of subcontractors caused or the origin or spread of which he could have prevented unless such cutting injury or killing of trees involves small amounts of material and in the judgment of the Contracting Officer is justified by existing conditions. v. Logging Operations: Logging operations shall be confined entirely to the Site Clearing Areas and approved access roads. Logging equipment will not be allowed outside the cutting area without prior approval to do so and trees in adjacent areas shall not be damaged by logging equipment. Only existing rights of ways, trails, roads, and firebreaks within and leading to the Site Clearing Areas shall be utilized to minimize construction of new skidding trails unless otherwise authorized by the Contracting Officer Representative. All logging debris shall be kept within the Site Clearing Area boundaries, outside of wetland areas, and out of roads and streams at all times. The Contractor shall maintain slash disposal zones keeping logging all slash at least fifty feet (50') from the tree line along public roads and twenty feet (20') from established military reservation roads. vi. Any and all log landings/decks and skid trails must remain within the Site Clearing Area boundaries unless approved by the Contracting Officer Representative. Log landings/decks will be located as designated by the Contracting Officer Representative and any constructed with heavy equipment will be repaired by the Contractor and approved by the Contracting Officer Representative before termination of the contract. vii. The Contractor must provide all tools, equipment, vehicles, and supplies and will be responsible for all costs (professional permits, licenses, etc.) incidental to this work. viii.The Site Clearing Work shall be performed under a fixed price contract that shall include: pre-mobilization including submittals and training; mobilization; installation and maintenance of storm water management and erosion and sediment control devices (ECDs); site clearing; dust control; and other specific work activities in conformance with Contract requirements to perform the Work. ix. Merchantability definitions for designated trees: DBH=Diameter at Breast Height Hardwood Sawtimber - Any tree yielding at least one reasonably straight and sound eight foot (8') log, minimum eleven inch (11") DBH. Hardwood Pulpwood - Any tree yielding a minimum length of ten foot (10'), minimum six inch (6") DBH, minimum diameter three inch (3") at the small end, and reasonably sound not meeting sawlog standards. Pine Sawtimber - Any tree yielding at least one reasonably straight and sound eight foot (8') log, minimum eleven inch (11") DBH. Pine Chip-n-Saw - Any tree yielding at least one reasonably straight and sound twelve foot (12') log, between ten inch (10") and twelve inch (12") DBH. Pine Pulpwood - Any tree yielding a minimum length of ten foot (10'), minimum five inch (5") DBH, minimum diameter three inch (3") at the small end, and reasonably sound not meeting sawlog or chip-n-saw standards. Chip wood - Any woody stem or tree without a specified topwood diameter or height not meeting any other merchantable product standards. x. Timber harvesting operations shall in no way affect or interfere with military training or operations at JBL-E Tracking Facility. The Contracting Officer Representative may delay tree clearing from time to time and the area may be closed because of military training operations. Upon receiving notice to do so, the Contractor shall move all tree clearing operations from the affected site(s) to an area designated by the Contracting Officer Representative and will re-route all vehicles and equipment as required. The Contractor agrees to make daily check in/out contact with the JBL-E Representative or other designated personnel regarding harvesting schedules affecting the Site Clearing Areas. xi. Some additional timber volume may become available to the Contractor during the lifetime of the contract. The additional timber will be timber that is fire, wind, disease and/or insect damaged and must be removed immediately to prevent deterioration or timber that is interfering with the JBL-E mission and must be disposed of immediately. xii. Sawmills will not be permitted in the Site Cutting Areas or at the BPTF. Whole tree chipping is permitted and all trees must be removed from the job site. xiii. All grounds within and adjacent to the work area shall be maintained in a clean and sanitary condition. Trash shall be disposed of in a satisfactory manner and operations shall be conducted so as to not pollute any watercourse. xiv. All operations, including the construction of roads and trails, shall be conducted in a manner to minimize damage to streams, marshes, ditches, drainage structures, terraces, and stream sides. Streams and drain ditches shall be kept clear of logs, chunks, and debris resulting from operations under this task order. xv. The Contractor shall exercise all reasonable precautions to prevent excessive soil damage that may cause serious erosion, compaction or rutting problems. Excessively wet soil is subject to serious damage from equipment operations. Therefore, interruptions of operations may become necessary from time-to-time during the contract period. The Government will notify the Contractor when these conditions exist. xvi. The Contractor shall comply with all US Government and State of Virginia forest fire fighting laws and shall be held liable for damages resulting from his operations. In the event of a fire, the Contractor shall immediately contact 911 first and then notify the JBL-E Representative at ( 757 ) 764-0553. The Contractor shall maintain adequate forest fire fighting extinguishing materials and equipment at all times during operations for controlling forest fires expeditiously in the terrain and location where timber harvesting operations are being carried out under this contract. No heating equipment, warming fires, or burning shall be undertaken on the property and encompassing harvest area unless prior approval is received from the JBL-E Representative. Burning of trash or maintenance byproducts (oily rags, etc.) is prohibited. b. Environmental Protection i. All trees are to be cut and removed from the wetland areas within the Site Clearing Area. All limbing, toping, and placement of non-merchantable material is to take place outside the streamside management boundary. All trees and tree parts that are chipped and/or dispersed during this project are not to be left in any streamside management area. ii. The Contractor will adhere to all Federal, State, and local laws, regulations and permits pursuant to this project including, but not limited to, the MDE stormwater management and sediment and erosion control permit, State of Virginia Nontidal Wetland and Waterways Permit, the USACE wetland permit, and the USFWS Federal Fish and Wildlife Permit No. ????????-0.(To be Provdived by Contractor) iii. All skid trails, logging decks/landings and haul roads constructed or used by the Contractor shall be repaired to pre-harvest condition prior to termination of the contract. Repairs shall include, but are not limited to smoothing ruts, spreading out any piles of soil over the area it was removed from, installing temporary erosion control measures such as water diversion bars. Unless otherwise directed by the JBL-E Representative, the Contractor is responsible for seeding, mulching, liming, and fertilizing of all haul roads, skid trails and log landings. The preceding must comply with recommendations of the JBL-E Representative. Any associated bonds may not be released until all site repair work is complete. iv. The Contractor shall suspend operations when rutting in excess of six inches (6") in two places occurs. JBL-E and/or Contracting Officer Representative are authorized to stop harvest operations in order to enforce this requirement. When possible, the Contractor may be relocated to a more stable portion of the same harvest area. Any rutting in excess of six inches (6") shall be repaired at the Contractor's expense as soon as the weather and ground conditions permit. v. The Contractor is responsible for all trees felled within the site clearing boundary, damage to trees or vegetation in adjacent areas or property is prohibited. Residual stand damage to neighboring stands within the harvest area shall be kept to a minimum. vi. Harvesting operations are prohibited within fifty feet (50') of any house sites or other cultural/historical if found at any time during site clearing until appropriate evaluation and documentation of the site are collected. Relic hunting or the use of metal detectors for the purpose is strictly prohibited. Any cultural resources adjacent to the harvest areas and all vernal pools shall be protected from damage. vii. The sites in this region may be included at any time as part of a Quarantine limiting the transport of forest products to limit the spread of invasive insects which degrade stands of timber. All forest products harvested from these sites are subject to the applicable Orders of Quarantine as they become effective. Also, Threatened and Endangered species can be discovered at any time and impact various human activity on federal land. viii. The Contractor or his/her employees, agents or subcontractors shall at all times keep the contract area free from waste materials and litter such as lunch refuse, oil cans, barrels or other debris. Storage of hazardous materials shall be done in a manner to prevent accidental release into the environment. The Contractor shall not generate any hazardous waste within site clearing area including but not limited to draining oil onto the ground from any mechanical equipment associated with the tree clearing, if necessary the Contractor shall drain oil into containers intended for this purpose and remove the waste from the site. If a spill of any petroleum product of other hazardous material occurs, the Contractor shall first notify 911 and then JBL-E Representative at ( 757 ) 764 - 0553. The Contractor shall maintain a spill kit intended for emergency capture/containment of such spill, be responsible for all costs incurred in clean-up of such a spill containing hazardous materials. Procedures for spill clean-up shall be in accordance with State and Federal laws as well as the JBL-E Spill Prevention, Control, and Countermeasure Plan in place to prevent and respond to any spills of oils, fuels, or other materials. ix. All logging equipment/vehicles used by the Contractor must be kept at the Site Clearing Area(s) unless prior approval is obtained from the JBL-E and/or Contracting Officer Representative to park elsewhere. Trucks used for hauling forest products shall comply with Federal DOT safety requirements and Virginia State DOT weight restrictions while on federal roads. x. All vehicles and equipment associated with tree clearing entering federal property or any area associated with the Site Clearing Area(s) shall be clean and free from material that could harbor potential invasive/exotic species in the form of soil, seeds, and plants in which could inadvertently be transported or otherwise moved from any job site to the Site Clearing Areas be it logging or any other site work where exposure to such conditions occur. xi. There is a possibility of uncovering and/or finding unexploded ordnances (UXOs) on this property. The Contractor and/or his/her employees, agents, or subcontractors must be familiar with the process of recognizing and reporting such UXOs or any other unknown object, and if found, must stop all work immediately, contact the JBL-E Representative at ( 757 ) 764 - 0553, and follow the guidance received. Work shall not commence until cleared by the JBL-E Representative instructing a brief on UXO identification and reporting. c. Quantity and Suitability: The timber by species/product and volume estimates are as follows: Pine Sawtimber 375.54 Tons Pine Pulpwood 89.63 Tons Hardwood Sawtimber 74.95 Tons Mixed Hardwood Pulpwood 282.05 Tons Chips 230.00 Tons •b. The Condition Assessment Report dated 23 OCT 2012 will be made available to the Contractor. If the Contractor wishes to perform any additional core samples or testing, repairs to the tested areas shall occur immediately. •3.
