Description
It is the intent of the National Library of Medicine (NLM) to enter into a sole source procurement with Jay Brown, M.D. 6216 Coho Ln. N.E., Olympia, WA. 98506, to update and enhance Haz-Map as described in the License Agreement. Award of any contract is contingent upon the availability of funds. This action is under the authority of 41 U.S.C.253 (c) (1), as set forth in FAR 6.302-1 and HHSAR 306.302-1. Only one responsible source and no other supplies or services will satisfy agency requirements. This acquisition will be processed under FAR Part 12 - Acquisition for Commercial Items and will be made pursuant to the authority in FAR Part 13.5, Test Program for Certain Commercial Items. The intended procurement is classified under North American Industry Classification System Code (NAICS) 621111 OFFICES OF PHYSICIANS (EXCEPT MENTAL HEALTH SPECIALISTS) with a business size standard of $11.0 million. The period of performance is anticipated to be for a period of twelve (12) months beginning approximately August 1, 2017 to July 31, 2018 with (2) one year option. Award of any contract is contingent upon the availability of funds. This solicitation incorporates provision and clauses in effect in the FAC 2005-94, 2005-95 FAR Revision effective January 19, 2017, including all FAR Circulars issued as of the date of this synopsis. NLM anticipates that an award will be made on or about July 15, 2017. This is not a solicitation for competitive quotations, nor is a RFQ available. However, if any other interested party believes that it can meet the requirement it may submit a statement of capabilities. The capability statement and any other information furnished must be in writing, and must contain material in sufficient detail to allow NLM to determine if the party can meet all of the foregoing requirements. For this notice, capability statements and related materials are required to be submitted via the electronic Contract Proposal Submission (ePCS) website at https://ecps.nih.gov/. Submission of capability statements by facsimile or e-mail is not acceptable. For directions on using eCPS, go to https://ecps.nih.gov/home/howto NOTE: To submit your electronic proposal using eCPS, all offerors must have a valid NIH External Directory Account, which provides authentication and serves as a vehicle for secure transmission of documents and communication with the NLM. The NIH External Directory Account registration process may take up to 24 hours to become active. Submission of proposals by facsimile or e-mail is not accepted. All capability statements and related materials must be submitted electronically no later than 10:00am Eastern time on June 2, 2017 via the method indicated above. Vendors shall comply with all applicable Federal, State and Local laws, executive orders, rules and regulations applicable to its performance under this order. The following clauses and provisions cited herein are incorporated by reference into this announcement: FAR 52.204-7 System for Award Management (Oct 2016), FAR 52.212-1, Instructions to Offerors-Commercial Items (Jan 2017), FAR 52.212-2, Evaluation-Commercial Items (October 2014). Offerors are advised to provide with their offer a completed copy of the following provisions: FAR 52.212-3, Offeror Representations and Certifications- Commercial Items (Jan 2017)-With DUNS Number Addendum [52.204-6 (Oct 2016)]. The following FAR clauses apply to this acquisition: FAR 52.212-4, Contract Terms and Conditions-Commercial Items (Jan 2017)-With Addenda [Stop Work Order, FAR 52.242-15 (August 1989) and Year 2000 Compliance (July 1997)]; FAR 52.212-5, Contract Terms and Conditions Required to Implement Statutes or Executive Orders-Commercial Items (Jan 2017), FAR 52.217-8 Option to Extend Services (Nov. 1999) and FAR 52.217-9 Option to Extend Term of Contract (Mar 2000), as well as the following clauses cited therein: FAR 52.232-18, Availability of Funds (April 1984); FAR 52.242-15, Stop Work Order (August 1989) with Alternate I (April 1984); FAR 52.242-17, Government Delay of Work (April 1984); and FAR 52.232-33, Payment by Electronic Funds Transfer-System for Award Management (July 2013); FAR 52.232-39, Unenforceability of Unauthorized Obligations (JUN 2013). A determination by the government not to compete this proposed acquisition based upon responses to this notice is solely within the discretion of the government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement. This notice does not commit the Government to award a contract. NO collect calls will be accepted. NO facsimile transmissions will be accepted. ALL RESPONSIBLE SOURCES MAY SUBMIT A QUOTATION WHICH, IF TIMELY RECEIVED, SHALL BE CONSIDERED BY THE GOVERNENT.
