Statement of Work Justification for Other Than Full and Open Notice of Intent to Sole Source for Webinar Training Purchase Request Number PUR-17-0156 Civil Treatment for Employees Webinar Training THIS IS NOT A REQUEST FOR PROPOSALS, AN INVITATION FOR BIDS, OR A REQUEST FOR QUOTATIONS. FURTHER, IT DOES NOT REPRESENT A COMMITMENT BY THE GOVERNMENT TO PAY FOR COSTS INCURRED IN PREPARATION AND SUBMISSION OF DATA OR ANY OTHER COSTS INCURRED IN RESPONSE TO THIS ANNOUNCEMENT. This is a Special Notice with the intent to award a sole source order to Employment Learning Innovations, Inc. (ELI) under the authority of FAR 13.106-1 based on ELI's unique value proposition to meet the training requirements of the NTSB. Notice is provided as information to the marketplace, market research, and is an invitation for any other qualified companies to express their interest in and demonstrate their capability to provide software that performs the required work. Background The National Transportation Safety Board (NTSB) is an independent Federal agency with the primary missions of investigating civil aviation accidents in the United States and significant accidents in the other modes of transportation -- railroad, highway, marine and pipeline -- and issuing safety recommendations aimed at preventing future accidents. The Office of the Managing Director (MD), NTSB Training Center (MD-4) has a Civil Treatment for Employees webinar training requirement. The NTSB requires one (1) two-hour training classes in an online/webinar format and Civil Treatment for Leaders for one (1) day training classroom session. The period of performance will be for July 1, 2017 through June 30, 2018 (Base Year), July 1, 2018 to June 30, 2019 (Option Year One) and July 1, 2019 to June 30, 2020 (Option Year Two). The NTSB has a requirement for Civil Treatment for Employees (CTE) webinar training. As a result of this training, NTSB employees will have the skills needed to achieve positive business results in ways that inspire their best work based on civil treatment in the workplace. The training should be behavior-based, instead of focusing on the law exclusively. It should include examples of behavior-based simulations to spark insights for leaders to improve the workplace in ways they may not have considered. The training will result in developed skills that will positively impact the NTSB culture and achieve results. The training should be online/webinar format. Topics to be addressed in the Civil Treatment training include the following: • Harassment • Discrimination • Retaliation • Bullying/Abusive Treatment • Duty to Act • Fair Hiring, Selection and Promotion • Documenting Workplace Events ELI is uniquely qualified to provide CTE training to NTSB employees. The vendor has developed training that presents anti-harassment, anti-bullying, and anti-discrimination information in a non-legalistic manner, unlike other vendors in the industry. More specifically, the training is presented using the Socratic Method with extensive interaction and facilitated discussion, unlike other vendors who present the same subject matter in a legal regimented manner. The training is unique in that is behavior-based in a way not offered by other vendors in the industry. ELI provided the leader version of the training to NTSB managers and leaders on March 7th, March 8th, and June 15th, 2016. ELI provided the employee version of the course on 6 occasions between November 2016 and February 2017. The evaluations for the course were outstanding. The decision to issue a sole source order is based on the importance to maintain continuity and consistency in the unique delivery of this course material. Required Capabilities One (1) two-hour training session in online/webinar format which will include the following: The training should be facilitated professionally, and include detailed discussions following each module. The training should present anti-harassment, anti-bullying, and anti-discrimination information in a non-legalistic manner for employees of varied technical backgrounds. It should be very interactive training, in a synchronous online format that allows for dialog between participants and professional facilitator. The vendor should be tracking the participation of all attendees. The vendor should provide one (1) separate webinar session to accommodate approximately 40 people in total. Sources capable of fully satisfying the above requirements are invited to submit capability statements/expressions of interest providing the Government the necessary information to determine actual capability. At a minimum, this information, which must be prepared specifically in response to this notice should, must include: (1) identification of company or organization; (2) an assertion of existing, full capability to meet proposed requirements; (3) business/contracts/marketing office point(s) of contact; (4) notification of business size and /or special status; and (5) any additional information that may be useful to the successful procurement of the requirements, if solicited. These expressions of interest shall adhere to a ten (10)-page submission limit plus web links and any specialized product descriptions. The statement of qualifications should include only information that clearly demonstrates the respondent's capabilities, expertise, and experience to perform the requirements described in this notice. General marketing material should not be included. The NTSB prefers that companies do not submit proprietary material. However, the Government recognizes that proprietary data may be a part of your submittal. If so, clearly mark such restricted or proprietary data and present it as an addendum to the non-restricted/non-proprietary information. Information received will be considered solely for the purpose of determining whether to conduct a competitive procurement. A determination by the Government not to compete the proposed order based upon responses to this notice is solely within the discretion of the Government. All responsible sources may submit a capability statement, which shall be considered by NTSB. Parties must submit information within seven (7) days of publication of this notice. NTSB will not return capability statements and the supporting documentation submitted in response to this notice. Telephone responses and inquiries will not be accepted.
