- Subject- Notice of Intent to Sole Source In Accordance with Federal Acquisition Regulation (FAR) 13.106(b)(1)(i) "Contracting officers may solicit from one source if the contracting officer determines that the circumstances of the contract action deem only one source reasonably available (e.g., urgency, exclusive licensing agreements, brand-name or industrial mobilization)." This is a special notice prepared in accordance with Federal Acquisition Regulation (FAR) 5.2 -Synopses of Proposed Contract Actions. US Army Corps of Engineers - Omaha District, intends to issue a Firm-Fixed Price contract (Blanket Purchase Agreement) to MidDakota Vegetation Management, 35920 Canham Pl., Miller, SD 57362. This action is for a new firm-fixed price, commercial single-source requirement for the procurement of noxious weed. The areas selected for noxious weed treatments are located on federal property managed the U.S. Army Corps of Engineers (USACE) Oahe Project Office, SD. Work consists of survey and herbicide applications to control infestations of noxious weeds; primarily noxious weeds such as Saltcedar or tamarisk (Tamarix ramosissima, Tamarix chinensis, Tamarix parviflora), Canada Thistle (Cirsium arvense), Leafy Spurge (Euphorbia esula), Absinth Wormwood (Artemisia absinthium L.) Russian Knapweed, (Centaurea repens), Halogeton (Halogeton glomeratus) and other identified noxious weeds and invasive species. The Contractor will furnish all labor, equipment, materials, and supervision necessary to provide complete herbicide application services for control of weeds. All work will be in North Dakota; however, the majority of the area that will receive treatment will be located in Burleigh and Morton Counties, ND. The Corps will provide the Contractor with maps/information associated with this BPA before work commences. Approximately 500 acres are to be treated with the use of an ATV/UTV. Period of Performance: 15 May 2017 - 30 November 2017. Authority- The statutory authority for this non-competitive acquisition is 10 U.S.C. 2304 (c)(1), as implemented by Federal Acquisition Regulation (FAR), 13.106(b)(1)(i) "Contracting officers may solicit from one source if the contracting officer determines that the circumstances of the contract action deem only one source reasonably available (e.g., urgency, exclusive licensing agreements, brand-name or industrial mobilization)." The rates in this call were determined fair and reasonable with the establishment of the Master BPA. A SOLICITATION WILL NOT BE POSTED. The Government intends to proceed with this sole source action. The NAICS code is 561730, "Landscaping Services" The size standard as defined by the U.S. Small Business Administration is $7.5M. All responsible sources may submit a capability statement, proposal, or quotation, which shall be considered by the agency. Interested concerns must show clear and convincing evidence that competition of this requirement would be advantageous to the Government. Oral communications are not acceptable in response to this notice. A determination by the government not to compete this proposed requirement is solely within the discretion of the government.
