- Subject- Notice of Intent to Sole Source In Accordance with Federal Acquisition Regulation (FAR) 6.302-1 "Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements" This is a special notice prepared in accordance with Federal Acquisition Regulation (FAR) 5.2 -Synopses of Proposed Contract Actions. US Army Corps of Engineers - Omaha District, intends to issue a Firm-Fixed Price contract to the Archaeological Research Center, South Dakota, located at 217 Kansas City Street, Rapid City SD 57701. The contractor shall provide all personnel, equipment, supplies, facilities, transportation, tools, materials, supervision, and other items and non-personal services necessary to perform Archeological Services. The services will be provided at the Contractor's facilities. The Omaha District must procure cultural resource services to meet the Department of the Army's Federal preservation legislation and associated implementing regulations. The most pertinent are the following: Public Law 74-292, Historic Sites Act of 1935, as amended; Public Law 89-665, National Historic Preservation Act of 1966 as amended; Public Law 91-190, National Environmental Policy Act of 1969 as amended; Public Law 95-341, American Indian Religious Freedom Act; implementing regulations 36 CFR Parts 60 and 61 Appendix A; 36 CFR Part 800; Department of Interior, National Park Service (NPS) Bulletin 38. The Cultural Resource Program does not have the equipment, facility, or personnel to provide curations of archaeological resources. Acquiring these services from the South Dakota Archaeological Research Center is advantageous because the facility meets federal curation standards and also meets security and protection standards for artifacts. Authority- The statutory authority for this non-competitive acquisition is 10 U.S.C. 2304 (c)(1), as implemented by Federal Acquisition Regulation (FAR), Part 6.302-1 "Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements" No other sources have been determined to be capable of conducting this work to provide the data quality essential to addressing the project objectives. There have not been any alternate services determined to be used or obtained competitively. It is the best value to the government to procure this work via sole source contract as it is the most cost-effective option to accomplish this work, while maximizing continuity and data quality to ensure the data and resultant information is available to guide management decisions into the future. A SOLICITATION WILL NOT BE POSTED. The Government intends to proceed with this sole source action. The NAICS code is 541720, "Research and Development in the Social Sciences and Humanities" The size standard as defined by the U.S. Small Business Administration is $20.5M. All responsible sources may submit a capability statement, proposal, or quotation, which shall be considered by the agency. Interested concerns must show clear and convincing evidence that competition of this requirement would be advantageous to the Government. Oral communications are not acceptable in response to this notice. A determination by the government not to compete this proposed requirement is solely within the discretion of the government.
