Description
SCA Wage 15-5708 Rev 4 Statement of Work This is a COMBINED SYNOPSIS/SOLICITATION for commercial services prepared in accordance with the format in the Federal Acquisition Regulation (FAR) Subpart 12.6, as supplemented with additional information included in this notice. i. This announcement constitutes the only solicitation; proposals are being requested and a written solicitation will not be issued. ii. This solicitation AG-F430-S-17-0002 is being issued as a Request for Proposal (RFP). iii. The North American Classification System (NAICS) code is 541511- Applications Software Programming Services, Custom Computer and the small business size standard is $27.5 million. The proposed contract is 100% set-a-side for small business concerns. The U.S. Forest Service encourages the participation disadvantaged, service disabled, and women-owned business enterprises. iv. The Government requires performance of the work described in these documents to develop and implement standard operating procedures in order to make information available internally and to the public on Institute web sites and other social media as further described in the attached Statement of Work (SOW). The Government anticipates the award of a fixed-price contract. The estimated price range for this procurement initial year plus two (2) option year renewals is between $100,000 and $250,000.00. Period of Performance (PoP) is contingent upon award date. It is the Government's intention to award a Base Year (12-month base period) with Two Option Years. FOB: Destination - Acceptance conducted at IITF, San Juan, PR. v. The Government will award a contract to the Technically Acceptable offeror with the lowest reasonable total evaluated price. The evaluation criteria is divided into three factors: FAR 52.212-2 -- Evaluation -- Commercial Items (Oct 2014) a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers: - Past Performance - Technical Capability - Cost/Price Technical and past performance, when combined, are significantly more important than cost or price. b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s). c) It is the Government's intent to award without discussions. Offerors are encouraged to present their best technical proposal and prices in their initial proposal submission. However, should discussions become necessary, the Government reserves the right to conduct them. If the Government awards without discussions, the Offerors may be given the opportunity to clarify certain aspects of proposals or to resolve minor clerical errors. The Government may reject any or all offers if such action is in the public interest. d) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award. vi. 52.217-8 -- Option to Extend Services (Nov 1999) a) The Government may require continued performance of any services within the limits and at the rates specified in the contract. These rates may be adjusted only as a result of revisions to prevailing labor rates provided by the Secretary of Labor. The option provision may be exercised more than once, but the total extension of performance hereunder shall not exceed 6 months. The Contracting Officer may exercise the option by written notice to the Contractor within 30 days. b) Pursuant to clause 52.217-9, Option to Extend the Term of the Contract, in the event that the Contracting Officer exercises an option, the exercise of any options is subject to FAR 52.232-19 - Availability of Funds for the Next Fiscal Year, and the continuing needs of the Government. - 52.217-9 - Option to Extend the Term of the Contract (Mar 2000) a) The Government may extend the term of this contract by written notice to the Contractor within 30 days; provided that the Government gives the Contractor a preliminary written notice of its intent to extend at least 60 days before the contract expires. The preliminary notice does not commit the Government to an extension. b) If the Government exercises this option, the extended contract shall be considered to include this option clause. c) The total duration of this contract, including the exercise of any options under this clause, shall not exceed 3 years, 6 months. - 52.232-8 - Availability of Funds for the Next Fiscal Year Funds are not presently available for performance under this contract beyond the basic year. The Government's obligation for performance of this contract beyond that date is contingent upon the availability of appropriated funds from which payment for contract purposes can be made. No legal liability on the part of the Government for any payment may arise for performance under this contract beyond the basic year, until funds are made available to the Contracting Officer for performance and until the Contractor receives notice of availability, to be confirmed in writing by the Contracting Officer. vii. To be eligible to receive an award resulting from this solicitation, all offerors must be registered in the System for Award Management ( www.sam.gov ) - NO EXCEPTIONS. viii. 52.212-3 - Offeror Representations and Certifications - Commercial Items (Jan 2017) The offeror shall complete only paragraphs (b) of this provision if the Offeror has completed the annual representations and certification electronically via the System for Award Management (SAM) Web site located at http://www.sam.gov/portal. If the Offeror has not completed the annual representations and certifications electronically, the Offeror shall complete only paragraphs (c) through (u) of this provision. ix. 52.212-4 - Contract Terms and Conditions - Commercial Items (Jan 2017) applies to this acquisition. x. 52.212-5 - Contract Terms and Conditions Required to Implement Statutes or Executive Orders - Commercial Items (Jan 2017) applies to this acquisition. xi. 52.252-1 - Solicitation Provisions Incorporated by Reference (Feb 1998) This solicitation incorporates one or more solicitation provisions by reference, with the same force and effect as if they were given in full text. Upon request, the Contracting Officer will make their full text available.
