- Chapter VI: Other Than Full and Open Competition (OFOC) SOP Attachment 3: Request for Sole Source Justification Format >$150K OFOC SOP Revision 05 Page 1 of 2 Original Date: 03/22/11 Revision 05 Date: 05/02/2016 DEPARTMENT OF VETERANS AFFAIRS Justification and Approval (J&A) For Other Than Full and Open Competition (>$150K) Acquisition Plan Action ID: VA248-17-AP-8406 Contracting Activity: Department of Veterans Affairs, VISN 08, VA Caribbean Healthcare System (VACHS). VA Form 1358 obligation 672-C71129. Nature and/or Description of the Action Being Processed: This request was for the EMERGENCY PROCUREMENT of home oxygen services. Description of Supplies/Services Required to Meet the Agency s Needs: This was an EMERGENCY request to procure VACHS Home Oxygen Therapy for approximately 300 patients with diverse diagnoses; as terminal Cardiac and Lung disease, and Musculoskeletal disabilities. The optimal treatment is the use of Long Term Oxygen Therapy (LTOT) and in more particular cases respiratory support through long term invasive and noninvasive mechanical ventilation. The use of LTOT and respiratory support are the only treatments that scientifically prove to increase the life expectancy in the majority of these patients. In some of our beneficiaries oxygen represents their only method of life support. The VA had an urgent and compelling need for the continuation of these services because any interruption could result in detriment of the life and the wellbeing of patients, and risk increase of death. A one month PO was necessary to avoid loss of human life and liability to the VA. Statutory Authority Permitting Other than Full and Open Competition: ( ) (1) Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements per FAR 6.302-1; (X) (2) Unusual and Compelling Urgency per FAR 6.302-2; ( ) (3) Industrial Mobilization, Engineering, Developmental or Research Capability or Expert Services per FAR 6.302-3; ( ) (4) International Agreement per FAR 6.302-4 ( ) (5) Authorized or Required by Statute FAR 6.302-5; ( ) (6) National Security per FAR 6.302-6; ( ) (7) Public Interest per FAR 6.302-7; Demonstration that the Contractor s Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority): An urgent and compelling need exists, and following the sole source/logical follow on procedures would result in unacceptable delays. The new requirement is currently being competed and we were pushing to get a $6 million contract awarded by 1 April 2017. Our intent was to have a timely contract however, due to time constraints and the fact that we could not run a parallel solicitation we had to fill the gap to provide home oxygen services to Veterans in need until the new contract is awarded 28 April 2017 so that there was no break in service. Medics are the incumbent on existing contract and have the qualifications and capabilities to continue oxygen services in PR and underlying areas. Determination by the Contracting Officer that the Anticipated Cost to the Government will be Fair and Reasonable: The anticipated costs to the Government will be fair and reasonable based upon comparison of the proposed price with previous prices found under Contract VA248-12-C-0006. The re-procurement for a new vendor is already in place and is set to be awarded by May 2017. This order represents best value (as defined in FAR 2.101) and results in the lowest overall cost alternative (considering price, special features, administrative costs, etc.) to meet the Government s compelling needs. Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted: Research shows that Medics was the only source of this service in San Juan, PR. Due to the urgent nature of this request additional market research was not conducted. Any Other Facts Supporting the Use of Other than Full and Open Competition: In efforts to continue oxygen services and prevent interruption, permission was granted to proceed with an emergency PO to existing vendor Medics for one month Period of Performance 1 April 2017 - 30 April 2017. Listing of Sources that Expressed, in Writing, an Interest in the Acquisition: None. A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers to Competition before Making subsequent acquisitions for the supplies or services required: Due to the emergency nature of this order there is very little that can be done to overcome barriers to competition at this time. Requirements Certification: I certify that the requirement outlined in this justification is a Bona Fide Need of the Department of Veterans Affairs and that the supporting data under my cognizance, which are included in the justification, are accurate and complete to the best of my knowledge and belief.
