- NOTICE OF INTENT TO AWARD A SOLE-SOURCE CONTRACT The US Department of Commerce (DOC), National Oceanic and Atmospheric Administration (NOAA), Eastern Region Acquisition Division, Simplified Acquisition Branch intends to negotiate on a sole source basis with JASCO Applied Science, 8630 Fenton Street, Suite 218, Silver Spring, Maryland 20910, using the procedures in FAR Part 13, to provide modeling and technical support for Marine Mammal Impact Assessment in the Gulf of Mexico. JASCO conducted the initial modeling underlying the impact assessment for the Draft Programmatic Environmental Impact Statement (PEIS) and are in possession and full understanding of the results. The modeling outlined here in this proposal is an extension of the initial effort utilizing the agreed-upon and extensively discussed methodologies and parameters. Further, for the second option, JASCO developed (based on extensive collaboration with National Marine Fisheries Service (NMFS) a proprietary calculator that only they currently own and can operate. They understand and have effectively executed the previous modeling using the parameters that NMFS discussed and are in the singular position of being able to easily and effectively conduct this extension of that original modeling. It would take significant money and staff time to reconstruct the initial modeling with any other company and would be entirely inefficient and a poor use of resources. The statutory authority for other than full and open competition is FAR 13.106-1(b)(1)(i), Only one responsible source. The North American Industry Classification Code (NAICS) for this acquisition is 541620 with a business size standard of $15.0 million. This is not a solicitation for competitive quotes. However, if any other interested party believes that it can meet the requirements, it may submit a statement of capabilities, which if timely received, will be considered by NOAA. A statement of capabilities must be received by 04:00 pm, April 10, 2017. A determination by the Government not to compete this proposed requirement based upon responses to this notice is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement in the future. Evidence must be provided of ability to provide the required services. The capability statement and any other information furnished must be in writing and must contain material in sufficient detail to allow NOAA to determine if the party can meet all of the requirements.
