Description
JEFO Justification for an Exception to Fair Opportunity (JEFO) 1. Contracting Activity: U.S. Army Medical Research Acquisition Activity (USAMRAA) 820 Chandler Street Fort Detrick, MD 21702-5014. POC: Alana Sowers - Contract Specialist. Anthony Petrore - Contracting Officer. Requiring Activity: Defense Centers of Excellence (DCoE) for Psychological Health/Traumatic Brain Injury (PH/TBI). POC: Brent Penny. 2. Nature or Description of the Action: Approval is requested by DCoE PH/TBI for an option to extend services for 3 months, cost-plus-fixed-fee contract modification with ER Williams, Inc., to provide senior administrative, acquisition, financial management, cost estimating and budget support services to DCoE. ER Williams, Inc. currently provides DCoE PH/TBI internal support services via contract W81XWH-08-D-0011-0020 which was awarded via fair opportunity competition procedures under TRICARE Acquisition, Automation, and Resource Management (TAARMS) Indefinite Delivery/Indefinite Quantity (IDIQ) Contracts. 3. Description of Supplies/Services: The option to extend services for 3 months. This award provides for internal administrative, acquisition, financial management, cost estimating, and budget support to DCoE Headquarters and three Centers. The Contractor shall provide administrative office support, financial management, and budget support, and acquisition/procurement support, as well as other internal support functions as identified in the statement of work. The current Period of Performance (POP) ends on June 26, 2017. The new POP will commence on June 27, 2017 and continue to September 26, 2017. The estimated cost of this extension is $341,280. 4. Authority Cited and Supporting Rationale: Pursuant to 10 U.S.C. 2304(C) as implemented by FAR 16.505(b)(2) and substantiated by FAR 16.505(b)(2)(i)(B): Only one awardee is capable of providing supplies or services required at the level or quality required because the supplies or services are unique or highly specialized. This extension to the task order is needed to provide the Government with critical continued services, allowing time for USAMRAA to finish the competitive solicitation and award of the follow-on requirement for DCoE. The complete requirement package and funding arrived late to USAMRAA. The current competitive follow-on requirement is in the market research and planning stage, with a solicitation expected in the near future. The Government is carefully selecting the best approach to ensure competition and obtain the best value and fair and reasonable pricing. ER Williams possess the operational infrastructure, knowledge, and corporate and personnel experience required to perform the tasks within the Performance Work Statement (PWS). Awarding to another contractor at this time would require additional training and lead time, which would lead to an interruption of necessary services. ER Williams has proved successful in providing services required at the level of quality required. Failure to extend the task order by three (3) months will cause DCoE to be at great risk of failing to fulfill its mission. The break in services would result in the following impacts for the duration of the lapse in service: • DCoE would lose senior administrative support to their Headquarters Chief and DVBIC Direct. • Would lose Subject Matter Expert support for DVBIC and DCoE. • Would lose procurement support services/contracting expertise. 5. A determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable. The cost of this anticipated option to extend services action will be fair and reasonable based on: 1) The initial award was competitively awarded, and the cost history is available to use as a comparison to future, similar work. 2) This modification will be based upon previously agreed to labor and indirect rates that are part of the base contract which have been determined to be fair and reasonable. 6. Any other facts supporting the justification. None. 7. A statement of the action, if any, the agency may take to remove or overcome any barriers that lead to the restricted consideration before any subsequent acquisition for the supplies or services is made. The three (3) month extension will be awarded to ER Williams. At this time, no effort will be made to solicit from multiple offerors. A follow-on contract is currently in the market research and planning state, with a solicitation expected to be released in the near future. The follow-on contract will be competitive and is expected to be awarded and take effect on September 27, 2017. This extension will provide continued services while USAMRAA completes the process of awarding the competitive follow-on contract.
