Description
It is the intent of the National Library of Medicine (NLM) to enter into a sole source procurement with Cincinnati University, University Hall Goodman Avenue Suite 530, P.O. Box 210222, Cincinnati, Ohio. The purpose of this requirement is to maintain and update the International Toxicity Estimates for Risk database (ITER). The period of performance will be for one year after the date of award with four additional option years projected. This action is under the authority of 41 U.S.C.253 (c) (1), as set forth in FAR 306.302-1. Only one responsible source and no other supplies or services will satisfy agency requirements. This acquisition will be processed under FAR Part 12 - Acquisition for Commercial Items and will be made pursuant to the authority in FAR Part 13 to use simplified acquisitions procedures for commercial acquisitions. The North American Industry Classification System Code is 624190, Other Individual and Family Services, and the business size standard code is $11.0 Million. The Toxicology Excellence for Risk Assessment (TERA), is part of the University of Cincinnati's Department of Environmental Health (UCDEH). TERA helps to protect public health by developing, reviewing and communicating risk assessment via the International Toxicity Estimates for Risk Assessment (ITER) database. This is an ongoing requirement that involves the continuation of making this database publicly available on NLM's Toxicology Data Network (TOXNET). The University of Cincinnati (TERA center) is the only known source that can provide this particular service. In addition, they have proprietary rights to the data. This is not a solicitation for competitive quotations, nor is a RFQ available. However, if any other interested party believes that it can meet the requirement it may submit a statement of capabilities. The capability statement and any other information furnished must be in writing, and must contain material in sufficient detail to NLM to determine if the party can meet all of the foregoing requirements. This solicitation incorporates provision and clauses in effect in the FAC 2005-94, FAR Revision effective January 19, 2017, including all FAR Circulars issued as of the date of the synopsis. NLM anticipates that an award will be made on or about March 13, 2017. Vendors shall comply with all applicable Federal, State and Local laws, executive orders, rules and regulations applicable to its performance under this order. The following clauses and provisions cited herein are incorporated by reference into this announcement: FAR 52.212-1, Instructions to Offerors-Commercial Items (January 2017), FAR 52.212-2, Evaluation-Commercial Items (October 2014). Offerors are advised to provide with their offer a completed copy of the following provisions: FAR 52.212-3, Offeror Representations and Certifications-Commercial Items (January 2017)-with DUNS Number Addendum (52.204-6 (July 2013). The following FAR clauses apply to this acquisition: FAR 52.212-4, Contract Terms and Conditions-Commercial Items (May 2015)-with Addenda (Stop Work Order, FAR 52.242-15 (August 1989) and Year 2000 Compliance (July 1997); FAR 52.212-5, Contract Terms and Conditions Required to Implement Statutes or Executive Orders - Commercial Items (Sept 2016), as well as the following clauses cited therein: FAR 52.232-18, Availability of Funds (April 1984); FAR 52.242-15, Stop Work Order (August 1989) with Alternate l (April 1984); FAR 52.242-17, Government Delay of Work (April 1984); and FAR 52.232-33, Payment by Electronic Funds Transfer-System for Award Management (July 2013); FAR 52.232-39, Unenforceability of Unauthorized Obligations (June 2013); FAR 52.217-8, Option to Extend Service (November 1999); FAR 52.217-9, Option to Extend Term of Contract (January 1999); FAR 52.237-3, Continuity of Services (January 1991); FAR 52.204-7, System for Award Management (October 2016). A determination by the government not to compete this proposed acquisition based upon responses to this notice is solely within the discretion of the government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement. This notice does not commit the Government to award a contract. NO collect calls will be accepted. All responsible sources may submit a quotation which, if timely received, shall be considered by the Government. Capability statements and related materials must be received in the office by 12:00 p.m. local prevailing time on March 01, 2017 via e-CPS. NLM Synopsis Number NIHLM2017941 shall be noted on all correspondence relating to this announcement. This notice requires capability statements to be submitted via the NLM Electronic Contract Proposal Submission (eCPS) website, which can be found at: https://ecps.nih.gov.
