Description
INTRODUCTION THIS IS A PRE-SOLICITATION NON-COMPETITIVE (NOTICE OF INTENT) SYNOPSIS TO AWARD A PURCHASE ORDER WITHOUT PROVIDING FOR FULL OR OPEN COMPETITION. The National Heart, Lung, and Blood Institute (NHLBI), Office of Acquisitions (OA), intends to negotiate and award a purchase order on a noncompetitive sole source basis to Global Data Publications Inc., 441 Lexington Ave, New York, NY, 10017-3910 to provide a one-year base subscription to the Pharma eTrack Database to NHLBI's Office of Technology Transfer and Development (OTTAD) in accordance with the following information: BACKGROUND OTTAD's primary mission is to enable researchers within the NHLBI Division of Intramural Research to interact more effectively with their counterparts in the private sector and in academia to establish collaborative relationships that further develop existing technologies, facilitate the sharing of technologies with outside laboratories, and create innovative technologies in collaboration with others, with the ultimate goal of benefitting the public health in a variety of basic, translational, and clinical areas, including imaging, diagnostics, regenerative medicine, genetics/genomics, developmental biology, cellular and gene therapy, and cell and molecular biology relating to heart, lung, blood, and sleep disorders and diseases. To this end, OTTAD negotiates Cooperative Research Development Agreements (CRADA), Research Collaboration Agreements (RCA), Clinical Trial Agreements (CTA), Material Transfer Agreements (MTA), Confidential Disclosure Agreements (CDA), and other Technology Transfer transactional agreements on behalf of NHLBI that facilitate collaboration while protecting NHLBI's intellectual property interests. OTTAD also acts as the contact point within NHLBI for all new inventions made by NHLBI intramural researchers. The office advises the Scientific Director, intramural investigators and NHLBI leadership on issues relating to patenting and intellectual property. In addition, OTTAD manages NHLBI's large and diverse portfolio of technologies that are available for commercial licensing. OTTAD works closely with its Clients to meet their technology transfer and intellectual property needs. OTTAD's Clients are the National Institute of Arthritis and Musculoskeletal and Skin Diseases (NIAMS), the National Institute of Biomedical Imaging and Bioengineering (NIBIB), the National Institute of Environmental Health Sciences (NIEHS), the National Institute on Deafness and Other Communication Disorders (NIDCD) and the National Institute of Nursing Research (NINR), including the NIH Center for Human Immunology, Autoimmunity and Inflammation (NIH CHI) and the NIH Center for Regenerative Medicine (NIH CRM). PURPOSE The purpose of this acquisition is to procure a one-year base subscription to GlobalData's Pharma eTrack Database. GlobalData provides research solutions covering the full breadth of the pharmaceuticals industry, from clinical trials and epidemiology intelligence, to focused modules available across multiple therapy areas. Each component of their research creates comprehensive, tailor-made research solutions for healthcare professionals. The unique databases, quality expert analysis and powerful workflow tools are available on an online subscription platform to provide decision-making support around the clock. PERIOD OF PERFORMANCE The estimated period of performance is 2/17/2017 - 2/16/2018 JUSTIFICATION The determination by the Government to award a contract without providing for full and open competition is based upon the market research conducted as prescribed in FAR Part 10-Market Research. Per the authority of FAR 6.302-1, the services are available from only one source. Additionally, this is a follow-on to an existing contract (HHSN268201500436PC) and Global Data Publications is currently providing these services to the NHLBI. If another contractor were to take over, there would not only be a lapse in services, but there would be an expensive and duplicative investment in analysis, training, and implementation. This loss of productivity and substantial duplication of costs is unacceptable to the Government. REGULATORY AUTHORITY This acquisition is conducted under the authority of the Federal Acquisition Regulations (FAR) Subpart 13.106-1(b) Soliciting from a single source (for purchases not exceeding the simplified acquisition threshold) and only one responsible source and no other supplies or services will satisfy agency requirements. ADDITIONAL INFORMATION The North American Industry Classification System (NAICS) Code is 519190, All Other Information Services, and the Small Business Size Standard is $27.5M. However, this acquisition is not set-aside for small businesses. This acquisition is being conducted under FAR Part 13, Simplified Acquisition Procedures, therefore the requirements of FAR Part 6, Competitive Requirements, are not applicable and the resultant award will include all applicable provisions and clauses in effect through the Federal Acquisition Circular (FAC) 05-95 (January 19, 2017). This synopsis is not a request for competitive proposals. However, interested parties may identify their interest and capability to respond to this notice. Responses to this notice shall contain sufficient information to establish the interested parties' bona-fide capabilities for fulfilling the requirement and include: unit price, list price, shipping and handling costs, the delivery period after contract award, the prompt payment discount terms, the F.O.B. Point (Destination or Origin), the Dun & Bradstreet Number (DUNS), the Taxpayer Identification Number (TIN), and the certification of business size. All offerors must have an active registration in the System for Award Management (SAM) www.sam.gov. A determination by the Government not to compete this proposed contract based upon responses to this notice is solely within the discretion of the Government. The information received will normally be considered solely for the purposes of determining whether to proceed on a non-competitive basis or to conduct a competitive procurement. All responses must be received by February 14, 2017 at 9:00am EST and must reference synopsis number NHLBI-CSB-(HL)-2017-086-KMA. Responses shall be submitted to the National Heart, Lung, and Blood Institute, Office of Acquisitions, COAC Services Branch, 6701 Rockledge Drive, Room 6127, Bethesda, Maryland 20892-7902, Attention: Kevin Alvarez.
