Description
The U.S. Army Corps of Engineers (USACE), Engineer Research and Development Center (ERDC), Construction Engineering Research Laboratory (CERL) intends to award a preventive maintenance contract for a one year period on a sole source basis to Water Corp. upon the basis of the authority provided at FAR 13.106-1(b)(1)(i). ERDC-CERL requires a maintenance agreements, including software updates and regular diagnostic checks, to ensure proper function of the Ultra High Pressure Liquid Chromatography (UPLC) systems equipment and to prevent research downtime. Waters Corp. is the manufacturer of the equipment and the only vendor that offers maintenance agreements for them and has been identified as the only source based on past procurement history as well as market research conducted via the internet, expert opinion, and contact with industry experts. The UPLC was purchased from Water Corp by ERDC-CERL in August 2014 under a procurement advertised on FedBizOpps as a sole source requirement. The associated North American Industry Classification System (NAICS) code is 334516, which has a size standard of 1,000 employees. This is not a small business set aside, as this Notice of Intent is not a request for competitive quotations. However, interested parties may identify their interest and capability to respond to this requirement. Any interested party that believes they can fulfill this requirement should submit a capability statement to be reviewed. All submissions will be considered, however there is no guarantee that submissions in response to this notice will in any way alter the Government's acquisition strategy. This requirement which includes preventative maintenance visits for two (2) Waters UPLC units with multiple detectors and software is required, each for a period of one (1) year. The contractor shall replace all parts subject to wear as needed to keep the equipment fully functional during that time period.
