- Notice of Intent The National Institute of Standards and Technology (NIST), Office of Acquisition and Agreements Management (OAAM), Acquisition Management Division (AMD) proposes to enter into a contract on a basis of other than full and open competition for the Physical Measurement Laboratory (PML), Radiation Physics Group. NIST intends to negotiate on a sole-source basis with Philips Healthcare of Bothell, WA, under the statutory authority permitting other than full and open competition, 41 U.S.C. 1901, as implemented by the Federal Acquisition Regulation (FAR) Subpart 13.501, for repair services and maintenance services for an existing NIST owned Philips Gemini PET CT Scanner. Two separate contracts are anticipated, one contract for the initial repair, a second contract for maintenance services for base period of 1 year, plus 4 option periods of 1 year each. The mission of the Physical Measurements Laboratory, Radiation Physics Group is to provide national standards, methods, measurement services, and data for applications of ionizing radiation (x and gamma rays, electrons, neutrons, radioactivity, etc.) for protection of workers and the general public, radiation therapy and diagnostics, radiography, industrial processing, nuclear and alternative energies, national defense and security, space science (including cosmogenesis) and environmental protection. NIST conducts a program aimed at developing standards for quantitative nuclear medicine imaging. One of the cornerstones of this program is a Philips Gemini TF 16-slice PET-CT scanner that was purchased with funds from the American Recovery and Reinvestment Act (ARRA) in 2009. The scanner and its associated components are used in the development of National standards and have been thoroughly studied and characterized for this purpose. The system requires an exceptionally high degree of reliability to continue in this capacity. The system suffered a catastrophic failure of the x-ray tube and heat exchanger system in September 2016 and requires replacement of both components. Philips Healthcare of Bothell, WA is uniquely qualified to provide the instruments to the PML, Radiation Physics Group based upon the following. Philips Healthcare solely in the industry and market, has the sole proprietary technology and knowledge, and assurance of compatibility of the existing parts and software, as well as, guarantee of full operation of the system at the manufacturers specifications, as demonstrated as follows: The Philips Gemini TF 16-slice PET-CT scanner was purchased by NIST using ARRA funds in 2009 under contract SB1341-10-SU-0400 in the amount of $2,403,360.00. The ability to use this instrument in the current research program requires that the system be maintained and serviced under a comprehensive service agreement. The proprietary nature of the design and the availability of the (again, proprietary) replacement parts dictates that the work be done only by factory-trained and certified service engineers using original parts. Under conditions of purchase of the scanner, the Government must comply with nondisclosure and system access control requirements, indicated as "the software and documents on this system are proprietary to Philips Medical Systems. Only licensees of Philips Medical Systems have the right of access to this system and information contained herein". Since access to the system is essential for repairing, testing, and operating the scanner, the Government is prohibited from allowing anyone other than Philips employees or licensees to access the system. Philips is the sole qualified vendor that is capable to provide the repairs and maintenance services required in protection of the proprietary data and technology. As a result of the scanner and its associated components being used in the development of National standards and have been thoroughly studied and characterized, the system requires an exceptionally high degree of reliability to continue in this capacity, it is determined that Philips is the sole contractor capable of ensuring continuous operation at the full manufacturer specifications, and is the sole contractor allowed to have full access to the proprietary information and access to the software in which the system currently operates. The North American Industry Classification System (NAICS) code for this acquisition is 811219 - Other Electronic and Precision Equipment Repair and Maintenance. Small business size standard: 20.5 Million A determination by the Government not to compete the proposed acquisition based upon responses to this notice is solely within the discretion of the Government. Information received will be considered solely for the purpose of determining whether to conduct a competitive procurement. No solicitation package will be issued. This notice of intent is not a request for competitive quotations. However, responses received by February 15, 2017 will be considered by the Government.
