- Page 2 of 2 DEPARTMENT OF VETERANS AFFAIRS Justification and Approval (J&A) For Other Than Full and Open Competition (>$150K) Acquisition Plan Action ID:___VA263-17-AP-0060_______ Contracting Activity: Department of Veterans Affairs, NCO 23, Minneapolis VA Health Care Center, 618-17-1-029-0069, $304,500.00, Emergency Procurement of Vein Harvesting Cannula Nature and/or Description of the Action Being Processed: An emergent procurement for a firm-fixed price contract will be awarded on a sole source basis for the procurement of the Vein Harvesting Cannula used for surgical procedures. Description of Supplies/Services Required to Meet the Agency s Needs: Guidant Vasoview 6 Harvesting Cannula System, Vein Harvesting System, this system harvests the saphenous ven and radial artery. The estimated quantity per year is 50. Estimated cost per year is $304,500.00. The purchase order will run from 10/28/2016 through 9/30/2017. Statutory Authority Permitting Other than Full and Open Competition: (X ) (1) Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements per FAR 6.302-1; Demonstration that the Contractor s Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority): a. Only One Responsible Source (FAR 6.302-1) Maquet is the original equipment manufacturer of this item. This item is highly specialized and used during coronary bypass procedures. Other companies make similar products, but are not exactly the same. This item is disposable and is the only system that is controlled by foot pedal. The Minneapolis VA Health Care System owns the equipment that these components attach to and warranties would be voided if the OEM s components are not used. Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable: Due to components currently being used that connect to this piece of equipment and warranties would be voided if not using the OEM s components, this will not be solicited until the life of the original equipment has expired. Determination by the Contracting Officer that the Anticipated Cost to the Government will be Fair and Reasonable: It is anticipated that the cost to the Government is fair and reasonable based on previous purchases of this particular item. The cost has not gone up in three years. Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted: The CV team is in the middle of a study and this is the item being used and needs to be standard through the entire study. The study is only about halfway done and it would be detrimental to change part way through the study and data would no longer be viable. A search was conducted on Vetbiz and no VOSB s were found that could provide this particular equipment. Any Other Facts Supporting the Use of Other than Full and Open Competition: Clinicians have been fully trained on this system. The system is still viable and not needing to be replaced yet so competing for a new system and components is not a fiscally sound decision. Listing of Sources that Expressed, in Writing, an Interest in the Acquisition: None A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers to Competition before Making subsequent acquisitions for the supplies or services required: None Requirements Certification: I certify that the requirement outlined in this justification is a Bona Fide Need of the Department of Veterans Affairs and that the supporting data under my cognizance, which are included in the justification, are accurate and complete to the best of my knowledge and belief. Approvals in accordance with the VHAPM, Volume 6, Chapter VI: OFOC SOP. Contracting Officer or Designee s Certification (required): I certify that the foregoing justification is accurate and complete to the best of my knowledge and belief. Director of Contracting /Designee (Required over$150K but not exceeding $700K): I certify the justification meets requirements for other than full and open competition.
