- Please read the entire attached document in its entirety and follow all instructions in this notice prior to submitting questions or information. IAW FAR 5.201 and the Office of Federal Procurement Policy Act (41 U.S.C. 416), the following notice is provided: SPECIAL NOTICE TO SOLE SOURCE No solicitation package will be issued. This special notice of intent to award a Sole-Source Purchase Order, and it is not a request for competitive quotations; however, the Government will consider responses from other Small Businesses received no later than 10:00 AM, EDT on 5 December 2016. Responses must be submitted to the Contracting Officer via email at Hufford.robert@pbgc.gov. The Pension Benefit Guaranty Corporation protects the retirement incomes of more than 40 million American workers. The Office of Chief Counsel's (OCC) mission is to provide comprehensive legal services relating to PBGC's ERISA programs involving ongoing and terminated pension plans. The office represents PBGC in all courts in litigation relating to ERISA functions, represents PBGC in bankruptcy or insolvency proceedings, provides legal advice and services to support negotiations and settlements, and makes recommendations regarding the initiation of litigation. PBGC Contracting Organization intends to negotiate this contract on a sole source basis with HLP Integration, LLP., in accordance with Federal Acquisition Regulation (FAR) FAR Subpart 13.106-1(b)(1) - Only one source (including brand name product) is deemed reasonably available to provide the required supplies or services and the cost/price is at or below the SAT. The purpose of the contract is to ensure the continuity of the scanning, storage, retrieval, query, and capability to analyze digitized electronic documents used in discovery and litigation of an ongoing case. Continuity of Operations, security of information, access to information, and the ability to expedite analysis of the documentation via commercial software heuristics and analysis are critical to support the litigation of the case. THIS NOTICE IS NOT A REQUEST FOR A COMPETITIVE QUOTE. Competing this requirement and awarding to any other entity would result in substantial delays, disrupt Litigation already in progress, increase the overall cost to the government, and make affect the litigation outcome. Any response to this notice must be submitted in writing to the Government and show clear and convincing evidence that another source is capable of meeting the Government's requirements and that competition of the requirement would be advantageous to the Government. Responses shall include, at a minimum, the following information: 1. The name of your company; 2. Company DUNS No and CAGE Code; 3. Point of Contact, and secondary contact, information; 4. A description of the technical approach and its overall capability to provided storage and analysis of Litigation Documentation without delay or disruption to processing, extracting, and analyzing Litigation Documentation, and not compromise PBGC's legal case. It is your responsibility to read the attached justification thoroughly and demonstrate how your company's service is capable of meeting the government's need as stated therein. The Government will not seek additional information from your company if you fail to provide sufficient evidence. A determination by the Government not to compete the proposed acquisition based upon responses to this notice is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement. PBGC will not reimburse any costs connected with offerors providing capability information. Oral communications are not acceptable in response to this notice. If no affirmative written responses are received by the response date, award will be made without further notice.
