- Adobe LiveCycle Software Maintenance and Technical Support Page 2 of 2 JUSTIFICATION FOR AN EXCEPTION TO FAIR OPPORTUNITY 1. Contracting Activity: Department of Veterans Affairs (VA) Office of Acquisition Operations Technology Acquisition Center 23 Christopher Way Eatontown, New Jersey 07724 2. Description of Action: The proposed action is for a firm-fixed-price delivery order (DO) to be issued under the National Aeronautics and Space Administration (NASA) Solutions for Enterprise-Wide Procurement (SEWP) V Governmentwide Acquisition Contract (GWAC) for the renewal of brand name Adobe LiveCycle software maintenance and technical support. 3. Description of the Supplies or Services: VA Office of Information and Technology, Veterans Centered Experience, Enterprise Health Benefits Determination program office has a requirement for the renewal of Adobe LiveCycle software maintenance and technical support for perpetual software licenses VA already owns, specifically: 500 Adobe Document Security AEM 11- Per Recipient Platinum, four Adobe Document Security AEM 11 Per CPU Platinum Annual Support Subscription, one Adobe Experience Manager Customer Communications Add-on 11 Platinum Annual Support Subscription renewal Per CPU, and two Adobe Forms Portal 5.6 Platinum Annual Support Subscription Renewal Per CPU. Software maintenance and technical support shall include periodic software updates, enhancements, and patches to software. Technical support shall include enhanced self-help and search capabilities and voice support services. The required maintenance and technical supports aides VA to maintain Portable Document Format (PDF) enhancement, process management, interactive forms, library forms, authentication, form and workflow change management, transactions, approvals, electronic signature, mobile application development, enhanced form security, electronic and postal forms delivery, content management and content access needed for Veterans Health Administration (VHA) enrollment forms, such as the Online 10-10EZ. Veterans healthcare handbooks are now also being generated by Adobe, allowing more robust and accurate changes to be published quickly in a way that can be accessed by computes, smartphones, and tablets. The period of performance is November 21, 2016 to November 20, 2017 with one 12 month option period. 4. Statutory Authority: The statutory authority permitting an exception to fair opportunity is Section 41 U.S.C. 4106(c)(2) as implemented by the Federal Acquisition Regulation (FAR) 16.505(b)(2)(i)(B), entitled Only one awardee is capable of providing the supplies or services required at the level of quality required because the supplies or services ordered are unique or highly specialized. 5. Rationale Supporting Use of Authority Cited Above: Based on extensive market research, as described in paragraph eight of this document, it was determined that limited competition is viable among Adobe resellers for this brand name maintenance and technical support. Adobe is the developer of the software and is the only source that maintains and supports the software. The software code is proprietary to Adobe, which restricts other software developers from gaining access to the software code. Access is required in order to modify the code and implement the software updates, enhancements, and patches, which keeps the software operational and prevents security vulnerabilities. Without this support, VA would face a degradation of the web services, content management, workflow, enhanced security, and other features embedded into VA s PDF documents developed to provide the online capability to submit applications for eligibility determination and enrollment. 6. Efforts to Obtain Competition: Market research was conducted, details of which are in section 8 of this justification. This effort did not yield any additional sources that can meet the Government s requirements. It was determined, however that limited competition is available among authorized resellers for brand name Adobe LiveCycle software maintenance and technical support. In accordance with FAR 16.505(a)(4)(iii)(A)(2), this justification will be provided with the solicitation to all appropriate NASA SEWP V GWAC holders. Furthermore, in accordance with FAR 5.301 and FAR 16.505(b)(2)(ii)(D), this action will be synopsized at award on the Federal Business Opportunities website and the justification will be made publicly available within 14 days of award. 7. Actions to Increase Competition: The Government will continue to conduct market research to ascertain if there are changes in the marketplace that would enable future actions to be competed. Specifically, the Government will continue to monitor market trends, new/emerging products, looking for compatible technologies to meet VA needs. 8. Market Research: Market research was conducted in July 2016 by the Government s technical experts through reviews of commercial catalogs, technical reviews, and professional reviews regarding Adobe LiveCycle software maintenance and technical support to determine if sources other than Adobe or Adobe authorized resellers could provide the software maintenance and technical support. This research included a review of similar software developers, including PerfectForms, Acquia, Drupal, WordPress, Frevvo, ExtremeForms, ProcessMaker, Microsoft, and RJSSoftware. Based on technical and professional reviews of these products, the Government s technical experts determined that while these companies develop similar software, each one provides software maintenance for its own proprietary products, but is unable to provide maintenance and technical support for another company s proprietary products. The Contract Specialist conducted additional market research in September 2016 by utilizing the Provider Lookup tool on the National Aeronautics and Space Administration (NASA) Solutions for Enterprise-Wide Procurement (SEWP) V Governmentwide Acquisition Contract (GWAC) website which identified Adobe LiveCycle software maintenance and technical support resellers, including two prospective Service-Disabled Veteran-Owned Small Business (SDVOSB) GWAC holders that are resellers of Adobe LiveCycle software maintenance and technical support. 9.
