This is a Sources Sought Notice (a) The Government does not intend to award a contract on the basis of this Sources Sought or to otherwise pay for the information solicited. (b) Although "proposal," "offeror," contractor, and "offeror" may be used in this sources sought notice, any response will be treated as information only. It shall not be used as a proposal. (c) Any information received from a contractor in response to this Sources Sought may be used in creating a solicitation. Any information received which is marked with a statement, such as "proprietary" or "confidential," intended to restrict distribution will not be distributed outside of the Government, except as required by law. (d) This Sources Sought is issued by VISN 2 Contracting Office in Albany, NY for the purpose of collecting information about Security Guard Services at the VA Hospital in Albany, NY. The VA is seeking to provide for this requirement for base year plus four option years. The requirement is detailed in the Statement of Work section of this document. (e) Contractors that are able to meet the requirements in the attachment are encouraged to email a capability statement and full information to Anthony Murray at Anthony.Murray2@va.gov. - Contractors shall identify the NAICS code for the product being offered as well as their size status under said NAICS. This information will be used to determine the viability of a set aside for this requirement. The government has identified the NAICS code 561612 Security Guard and Patrol Services. The government intends to set aside this requirement for SDVOSBs. - Contractors shall also identify any Federal Supply Schedules that may carry the desired services. - Contractors shall include any relevant comments about the Attachment(s) if applicable. Performance Work Statement Security Guard Services for U.S. Department of Veterans Affairs Albany VAMC, New York 1. Scope of Work The contractor shall provide management, supervision, personnel, back-up staff replacement staffing, equipment and supplies (except those items of equipment and supplies identified as provided by the Government) necessary to provide unarmed, uniformed guard services as described herein. As a Non-Personal Services contract, these personnel are not to be considered VA Employees for any purpose. Contractor retains all control over personnel and responsibility for direct supervision. Contract personnel may not supervise VA Staff, but may provide direction and instruction as required by duties. 2. Background The Department of Justice has determined that premises leased or owned by the Department of Veterans Affairs (VA) for medical centers or clinics, VA controlled property, are under the law enforcement jurisdiction of VA as that phrase is used in 38 U.S.C. Section 218. This determination rests upon the provision that VA is the owner or leaseholder of the space coupled with possession and control of the space. Security and Law Enforcement Circular Letter 07-91-1 authorizes security services obtained by contract when VA police officer positions are unavailable. Contract security guards utilized on VA controlled property shall exercise any authority vested in them within the limits of their licensing or special police commissioning by the State in which the clinic is located when directed by VA Police. This exercise of authority does not include authorization to bear firearms in VA leased space. 3. Guard Coverage Required 3.1Albany VAMC, Front Lobby. Location: 113 Holland Ave., Albany, NY 12208 Regular Working Hours: 07:00AM - 5:00PM, Monday through Friday Excluding Federal Holidays or any other day specifically declared by the President of the United States to be a national holiday. If a holiday falls on Sunday, the following Monday will be observed as the legal holiday. If a holiday falls on Saturday, the preceding Friday is observed as a legal holiday by U.S. Agencies. 3.2 Albany VAMC, Visitor Lot parking entry control. Location: 113 Holland Ave., Albany, NY 12208 Regular Working Hours: 0700AM - 3:00PM, Monday through Friday Excluding Federal Holidays or any other day specifically declared by the President of the United States to be a national holiday. Location: 113 Holland Ave., Albany, NY 12208 Regular Working Hours: 07:00AM - 4:00PM, Monday through Friday Excluding Federal Holidays or any other day specifically declared by the President of the United States to be a national holiday. If a holiday falls on Sunday, the following Monday will be observed as the legal holiday. If a holiday falls on Saturday, the preceding Friday is observed as a legal holiday by U.S. Agencies. **Federal Holidays -Holidays are: New Year's Day, Martin Luther King's Birthday, President's Day, Memorial Day, Independence Day, Labor Day, Columbus Day, Veteran's Day, Thanksgiving Day, and Christmas Day. To include any other day specifically declared by the President of the United States to be a national holiday. The website www.opm.gov concerning Federal Holidays for all periods of performances, shall be periodically reviewed. 3.8 At a minimum, one guard is required at each of the three locations specified in section 3.1-3.3, plus one security supervisor. However, the Contractor shall decide how many security guards are required to fulfill the requirements within this Performance Work Statement and to remain in compliance with the Department of Labor's Service Contract Act wages and over-time laws. 4. Security Guard Services Contractor shall provide the following services listed below: 4.1Contractor shall provide security guard service as indicated by location in paragraph 3. Guard Coverage Required. 4.2Contractor's personnel who are employed under this contract shall have been approved by the Contracting Officer Representative (COR) or his/her designee prior to beginning duties (hereinafter referred to as "Key Personnel"). The Contractor is required to submit to the COR, the names and all necessary documentation of fully trained and qualified personnel. Approval shall be based on meeting the qualification standards in the contract, plus other background information obtained regarding the individual which attests to his/her fitness for the required duty. 4.3Reserve Personnel (Back-up Staff) Prior to commencement of work on this Contract, the Contractor is required to submit to the COR, the names and all necessary documentation of fully trained and qualified personnel who will be used in a reserve capacity (e.g. to replace guards on scheduled or non-scheduled sick leave or vacation, to respond to emergency service, or similar situations), for approval via email or fax to the COR. 4.4Entrance Control Post. Operate and enforce a system of personnel identification. Direct patients/visitors to sign in with reception as required. 4.5Roving Patrols. Conduct hourly rounds of the facility parking areas insuring any issues are immediately reported to the VA Police Dispatcher. 4.6Building Rules and Regulations. Observe building occupants and visitors for compliance with posted rules and regulations. Immediately notify the VA Police Dispatch of any issues or infractions. 4.7Law and order. Immediately notify VA Police Dispatch of any breaches of Law and Order observed by security personnel. 4.8Unauthorized Access. Notify the VA Police Dispatcher of any discovery of attempted access by unauthorized person. 4.9Hazardous Conditions. Immediately report potentially hazardous conditions and items in need of repair, including inoperative lights, slippery road surfaces, broken floor surfaces, etc., to the VA Police Dispatcher. Take all appropriate, immediate action to prevent injury of patients or staff use (for example, use of safety cones to block area and direct activity around the hazard, etc.). 4.10Injury or Illness. Obtain professional assistance in the event of injury or illness to Government employees, Veterans, or others while in the building or on the grounds. Render First Aid and/or CPR, within the competence and ability of the contractor personnel, in emergency situations and assist medical and law enforcement personnel as appropriate or as directed by VA Police. 4.11Additional Duties. Turn off unnecessary lights, close windows, and additional duties including but not limited to opening or securing doors and gates. 4.12Reports and Records. Prepare required reports as required/directed by the VA Police or COR including but not limited to incident and lost and found reports and daily monitoring checklists (to be provided to contractor upon award). Submit a daily activity report to the COR (fax or email). 4.13Emergencies. Immediately respond to emergency situations as directed by the VA Police and provide appropriate assistance. Immediately notify the COR, as appropriate, of action taken. 4.14Security and safety duties and level of performance as required by this contract fall within the Department of Labor (DOL) wage decision category of Guard I or Guard II. 5. Limitation on Man-Hours to be provided by Individual Employees 5.1 No employee of the contractor shall provide more than twelve (12) hours of service in any twenty-four (24) hour period unless the work periods are separated by an eight (8) hour non-duty period ("service" includes VA contract work and also any other employment). This limitation may be temporarily adjusted by the Contracting Officer (CO) verbally in emergency situations which are beyond the control of the Contractor (i.e. weather conditions that prevent the next shift from getting to the building, civil disturbances, bombings, etc). A written confirmation of waiver must be obtained for each occurrence. 6. Supervision 6.1 Contractor shall provide access (physically or via phone) to supervisor level personnel during all authorized duty shifts. Each supervisor shall have a background with a minimum of two (2) years of experience supervising commercial or industrial security guards. VA shall not directly supervise contractor employees, and any issues shall be communicated between the contractor supervisor and the COR. Likewise, contractor supervisor shall not supervise VA personnel. 6.2 Contractor supervisor shall personally contact the COR during the first week of every month to review and discuss matters of mutual concern. Contact may be in person or by telephone. 7. Minimum Qualifications Standards Security Guards I and II: 7.1 Education/Experience. All employees assigned by the Contractor to work under this contract shall possess at least a high school education or equivalency, and shall have at least two (2) years of experience demonstrating: the ability to meet and deal with the general public; the ability to read, understand and apply printed rules, detailed orders, instructions, and training materials; the ability to maintain poise and self control under stress; the ability to construct and write clear, concise, accurate and detailed reports; and any type of military service which may be credited toward meeting these requirements. 7.2 Age. All Contractor employees performing work under this contract shall be a minimum of eighteen (18) years of age or as required by the State of New York. 7.3 Felony convictions. All contractor employees shall have no felony convictions. 7.4 All contractor personnel shall comply with all licensing requirements and all continuing education and training requirements mandated by the State of New York to perform work required by this contract. 7.5 Guard I: This guard carries out detailed instructions and procedures primarily oriented to insure that emergencies and security violation are readily discovered, and reported to appropriate authority. The primary duty is to observe and report security and emergency situations. This guard intervenes directly only in situations which require minimal action to safeguard property or persons. Duties require minimal training and physical fitness standards. 7.6 Guard II: The Guard II enforces regulations and procedures designed to prevent breaches of security, exercise judgment and uses discretion in responding to incidents and emergencies, determining whether to intervene directly, ask for assistance as time permits, keep situation under control or surveillance, or to report incident or situation to the appropriate authority for handling. Duties require specialized training in methods and techniques of protecting controlled areas. 8. Health and Physical Fitness Requirements 8.1 All employees assigned by the Contractor to work under this contract shall be physically able to perform all general patrol duties, functions, and activities; shall be free from any communicable disease; shall be in good general health without physical defects or abnormalities which would interfere with the performance of these duties; shall possess binocular vision correctable to 20/30 shall be free of color blindness, and be capable of hearing ordinary conversation at 15 feet with either ear without benefit of a hearing aid. This statement is to clarify that the employee hired by contractor can do the job assigned. 8.2 Each employee shall be given a physical examination without cost to the Government or the employee, and medical certification attesting to the final results of this examination shall be furnished to the COR on Standard Form 78 (Certificate of Medical Examination), to be provided after contract award, at least five days prior to anticipated date of assignment. This form must receive the approval of the CO prior to assignment of the employee to duty. 8.3 In addition, all Contractor employees providing services specified under this contract must undergo a psychological assessment by a qualified psychiatrist without cost to the Government, attesting to the final results of Pass or Fail, and provide results via memo on letterhead from the psychiatrist's office. The memo shall be furnished to the COR after contract award, at least five days prior to anticipate date of assignment. This form must receive the approval of the CO prior to assignment of the employee to duty. Security guard duties include personal encounters with patients, visitors, and other employees. Encounters are often with mentally ill, irrational or disturbed persons who, although assaultive or destructive, must be handled with understanding, full control of force, and unimpeded judgment. Any emotional or mental condition which could cause the applicant to be a hazard to others or self during stress situations and physical altercations will disqualify him/her. 8.4 The employee shall undergo a medical and psychological re examination annually, and the results shall be furnished to the COR and CO. 8.5 All employees shall be literate in English to the extent of reading and understanding printed regulations, detailed written orders, training instructions and material, and shall be able to compose reports which convey complete information. 8.6 Diseases: Individuals shall have no established medical history or medical diagnosis or epilepsy or diabetes, or where such a condition exists, the individual shall provide medical evidence that the condition can be controlled with proper medication so that the individual will not lapse into a coma or unconscious state while performing assigned guard services duties. An individual who has been incapacitated due to serious illness, injury, disease, or operation, which could interfere with the effective performance of assigned guard services duties shall, prior to resumption of such duties, provide medical evidence of recovery and ability to perform such duties. Individuals shall have no established medical history or medical diagnosis of habitual alcoholism or drug addiction, or, where such a condition has existed, the individual shall provide certified documentation of having completed a rehabilitation program which would give a reasonable degree of confidence that the individual would be capable of performing assigned guard services duties. 8.9 All Contractor employees shall address all Veterans and all VA Personnel by surnames or sir or ma'am. Contractor employees shall refrain from using foul language, tobacco, alcohol, illegal drugs, or mood or mind altering legal drugs, at all times, anywhere on or near Government facilities (within 100 feet). Contractor employees shall remove or cover obscene or controversial tattoos, i.e., "No blood for oil" or "Death to War Pigs" or similarly objectionable or reprehensible phrases or statements. 9. Meal Periods 9.1. The Guard whose tour includes a non paid lunch period shall be relieved from duties during such period, normally not to exceed 30 minutes. 2 The Guard normally may be granted a rest period not to exceed fifteen (15) minutes during each four (4) hours of continuous duty. 10. Acronyms 10.3 CO. Contracting Officer 10.4 COR. Contracting Officer's Representative 11. Government Furnished Property 11.1 Guard office/area with the following: (1) Writing Surface (not necessarily a desk) - 1 each. (2) Chair - 1 each. (3) Desk Phone or Access to such - 1 each (4) Electricity and phone access (5) Portable radio to tie in with VA Police 11.2 Accountability for Government Property. All non-disposable property furnished by the Government under this contract will remain the property of the Government. Annually and upon termination of the contract, the Contractor shall conduct a joint inventory of all such property with the COR. 12. Contractor Furnished Property and Supplies 12.1 The Contractor shall furnish and maintain in acceptable condition, at no cost to the Government, all items of uniform and equipment necessary to perform work required by this contract, as discussed in this section. 12.1.2 Cellular telephone, for the supervisor. Furnish the phone number to the COR. 12.1.3 One flash light capable of shining 50 meters for each guard. 12.1.4 Uniforms. The Contractor security guards shall wear the company's standard uniform, including any accessories. 12.1.4.1 The Contractor's uniform shall meet similar standard color used by large security or police organizations. Security guards shall wear the same color and style of uniform and in good condition. 12.1.4.2 Inclement weather clothing must be identical in style and color for each uniform and shall be required for those guards required to perform duties while exposed to cold, rain, and other foul weather conditions. 12.1.5 Related accessories listed below must be in good condition and similar 12.1.5.1 Shirt, short sleeve 12.1.5.2 Trousers/slacks. All season weight 12.1.5.3 Jacket, light weight 12.1.5.4 Gloves (one pair, color to match accessories) 12.1.5.5 Key strap with flap. 12.1.5.6 Radio/cellular telephone case 12.1.5.7 Insignia, shoulder patch (each shirt and jacket) 12.1.5.8 Whistle, thunder with chain attachment. 12.1.5.9 Nameplate, standard size to the uniform and visible within 6 feet distance 12.1.6 Leather shoes (low quarter type) or police-style boots plain toe and standard heel. The color of the shoe shall match the color of leather equipment accessories. Shoes/boots will be of plain design, in good repair and shined to a luster. NOTE: NO GUARD MAY ENTER ON DUTY WITHOUT WEARING THE PROPER UNIFORM INCLUDING ACCESSORIES. 12.2 Each guard on duty shall be equipped with supplementary equipment including, but not limited to, notebooks, pens, pencils, replacement flashlight batteries and bulbs, and traffic control safety apparel (reflective vests, gloves, traffic batons, etc.), as appropriate to operations. Guards shall not be permitted to provide themselves with any unauthorized supplemental or personals such as concealed or unconcealed firearms, knives, "come alongs", or other such non standard items. 13. Weapons Prohibited. The Contractor shall not possess any concealed or unconcealed firearms, mace, knives, "come along" night sticks or any other auxiliary, non-standard items. 14. Work Scheduling Procedures 14.1 The Criteria for establishing work schedules and requirements for contract relief period and for starting and stopping work are contained herein: 14.1.2 Work schedules for supervisors and guards shall be prepared by the Contractor on separate schedules and posted in work areas, at least one week in advance. (For continuity and familiarity with requirements, the Contractor should have the post manned by the same guard(s) on a normal weekly basis, not to exceed a total of 40 hours per week. Low turnover in personnel is also desirable. Schedules shall be prepared on a form and furnished to the COR. Changes to the schedules shall be posted in work areas in sufficient time prior to schedule change to assure that employees affected by a change in duty hours are properly notified. 14.1.3 The removal or changing of guards from assigned post must be approved by the COR. (Unless an emergency situation exists). 14.1.4 Guards may not leave their posts until proper relief arrives. When this occurs, it will be specifically noted. 14.1.5 All guards and supervisors shall be in proper uniform and ready to begin work promptly at the start of their shift. The Supervisor is responsible for ensuring that guards meet uniform and appearance standards before being logged in for duty. Those who fail, will be rejected for duty until they comply and will not be permitted to log-in for pay until such time as the Supervisor deems them fit. All personnel shall remain on the job in full uniform until the end of their full tour of duty. Discrepancies will be noted in duty log and reported by Contractor Supervisor to the COR. Repeated incidents may be considered cause for permanent removal from performance under this contract, if determined to be in the best interest of the Government by the COR or designee and requested through the Contracting Officer. 15. Quality Assurance Plan 15.1 The Contractor is responsible for implementing and maintaining a Quality Assurance Program (QAP) to ensure that the work performed meets or exceeds contract requirements and results in the correction of potential and actual problems. The QAP shall be implemented on the first day of contract performance and shall describe what will be reviewed and outline actions to be taken by the Contractor, should review(s) and/or inspections identify areas requiring remedial action. A copy of the QAP shall be provided to the COR prior to contract performance. 15.2 The QAP shall outline the Contractor's plan to ensure the quality of the performance requirements as outlined in the PWS. THE QAP shall address what will be revealed and shall outline actions taken by the Contractor, should the review identify areas of remedial action. 15.3 The QAP shall clearly describe methods to document, measure, control, and improve the quality processes including a plan for training employees to ensure full compliance with all performance objectives and standards. 15.4 The Contractor shall keep records of any inspections and corrective actions taken, as outlined in the QAP and shall make such records available to the COR upon request. 16. Training 17.1 To be eligible to perform under this contract, each contract guard shall meet New York State requirements for guards. All guard employees in the State of New York shall be properly licensed and shall comply with all licensing requirements and all continuing education and training requirements specified by New York State. 17.2 The Contractor shall provide COR a recommended plan for training Guards and supervisors. The plan must list training and/or courses that will be required for employees and an approximate schedule for attendance. This plan will also include methods the Contractor will use to maintain continuity of contract guards and supervisors with a minimum turnover in personnel. In addition to the training required by New York Law, the Contractor is also responsible for providing training as outlined in Appendix I. 18. Authority and Jurisdiction 18.1 Contractor and its employees shall meet all requirements under federal and New York State law and regulations, and submit all required licenses, certifications, etc. from all appropriate federal and state agencies prior to providing services under this contract. 18.2 Each guard must carry identification required by New York State Law (Guard Card). 18.3 Copies of guard licenses and permits required by New York State Law will be furnished to the COR upon request. 18.4 The Contractor's employee shall maintain a valid state security officer's certification during the term of his/her employment under the contract. 19. Contract Administration 19.1 Final Payments. Before final payment is made, the Contractor shall furnish the Contracting Officer with a release of all claims against the Government relating to this contract, other than claims in stated amounts that are specifically excepted by the Contractor from the release. If the Contractor's claim to amounts payable under the contract has been assigned under the Assignment of Claims Act of 1940, as amended (31 U.S.C. 3727, 41 U.S.C. 15) a release may also be required of the assignee. 19.2 Deductions for Failure to Provide Equipment, Materials and Uniforms. In the event the Contractor fails to provide uniforms, services or equipment required, the Contracting Officer will make an equitable adjustment in the contract price for the period of deficient performance. In determining the amount of the adjustment, the Contracting Officer will use as a basis the amount it would cost the Government to obtain that which the Contractor failed to provide through rental, lease or purchase. Such adjustment will occur whether or not the Government does in fact supply the item(s). Since the Contractor's employee is not considered "present for duty," shall not be allowed to perform services until the deficiency is corrected, payment will be made at a pro-rated monthly rate for actual work days. 19.3 Deficient Performance. The Contractor shall correct deficiencies in equipment, uniforms, performance of duties or appearance standards in the time directed by the COR. If the Contractor does not correct the deficiency within the specified time, deductions will be made at a pro-rated monthly basis for the period of deficiency. Repeat occurrences will require written response to the Contracting Officer by the Contractor. Individual guards may be disqualified for repeated deficient performance and must be replaced by the Contractor. Failure on the part of the Contractor to rectify deficiencies and prevent reoccurrence may lead to termination in whole or in part by the Contracting Officer. 19.4 Interruption of Work. In the event services are not required by the Government and a stop work order is issued by the Contracting Officer, due to events such as, but not limited to, building closure, extreme inclement weather, hazardous conditions or failure of the Congress to appropriate funds, etc., the Government will not be held responsible for payment for services not received. Any period of mandated non-performance will not necessarily extend the term of the contract. In the event services are not provided for portions of days, payment will be made based on a pro-rated monthly basis for actual work days. 20. Special Contract Requirements 20.1 Recording Presence. Each contract security person must sign-in when reporting for duty and sign-out when leaving at the end of the shift. A Record of Time of Arrival and Departure, or other approved sign-in/sign-out form or call log shall be utilized as specified by COR. The sign-in and sign-out location will be designated by the COR who may accept recommendations offered by guard supervisors. Entries made for arrival and departure will be countersigned by an authorized representative of the Contractor. Changes/corrections in the log will also be initialed - NO erasures or deletions. Submit daily activity reports to the COR on a minimum of a monthly basis by fax or email. 20.2 Reporting Man-Hours (Section 3) Provided. The Contractor shall submit to the COR, attached to the invoice, a legible report or form documenting the hours worked by each productive contract employee during the previous month. This report shall be certified by the Contractor as to its accuracy. The Contractor's on-site supervisor may submit and certify the report as being accurate if the Contractor has provided written authorization to do so. The report will be used by the Government to verify compliance with the man-hour requirements of the contract and will be the basis for verification and approval for invoice payment. Hours will be verified by COR. 20.3 Standards of Conduct. The Contractor shall be responsible and legally liable for employee performance and for maintaining satisfactory standards of employee competency, conduct, appearance, and integrity. The Contractor is also responsible for ensuring that employees do not disturb papers on desks, open desk drawers or cabinets, use Government telephones, or access computerized internet, software or network except as authorized. Each contractor employee is expected to adhere to standards of behavior that reflect credit on themselves, their employer, and the Federal government. Disciplinary actions, including removal actions, shall be the responsibility of the Contractor. The COR and Contracting Officer are to be kept apprised of actions and situations. 20.4 Removal from Duty. The Government may also require the Contractor to immediately remove any employee(s) from the work-site(s) should it be determined that individuals are being assigned to duty who have been disqualified for either suitability or security reasons, or who are found to be unfit for performing security duties during their tour(s) of duty. The Contractor shall comply and provide a replacement. Such a determination of unfitness may be made for, but not limited to, the following types of incidents of misconduct or delinquency: 20.5 Violations of VA Rules and Regulations Governing Security, Law Enforcement, and Standards of Conduct on Veterans Affairs Property, 38 CFR 1.218. a). Neglect of duty, including sleeping while on duty, unreasonable delays or failure to carry out assigned tasks, conducting personal affairs during official time, lack of or limited productive service and refusing to render assistance or cooperate in upholding the integrity of the security program at the work-site. b). Falsification or unlawful concealment, removal, mutilation, or destruction of any official documents or records, or concealment of material facts by willful omissions from official documents or records. c). Disorderly conduct, use of abusive or offensive language, quarreling, rude inappropriate comments, sexual harassment, intimidation by words or actions, or fighting, as well as participation in disruptive activities which interfere with the normal and efficient operations of the government. d). Theft, vandalism, immoral conduct, or any other criminal act. e). Selling, consuming or being under the influence of intoxicants, drugs, or substances which produce similar effects. f). Involvement in commercial activities at any time while on Government controlled property (included soliciting sale, donation, etc., from employees, patients, or others). g). Improper use of official authority or credentials. h). Unauthorized use of communications equipment or Government property (includes unauthorized or personal use of internet, long distance telephone services or government computer network). i). Possession or Misuse of weapons(s). j). Violation of security procedures or regulations. k). Not properly uniformed or equipped. 20.16 The Contracting Officer, in conjunction with COR will make all determinations regarding the removal of a person(s) from the work site(s). In the event of a dispute, the Contracting Officer will make final determination. Specific reasons for removal of an employee(s) will be provided in writing to the Contractor. 20.17 Control of Contract Personnel. Except as otherwise provided in this contract, the Contractor shall have the sole responsibility and prerogative of selection, assignment, transfer, management, and control of contract staff in performance of this contract. The VA does not hire individuals to perform under this contract and shall not hold "selection interviews" of any kind. However, all guards the Contractor proposes to assign are subject to the approval of the COR. The Contractor shall not employ any persons for work on this contract who are not fully qualified. Proof of qualifications shall be as required by New York State Law for guard personnel. If persons are identified to the Contractor by the Contracting Officer as a potential threat to the health, safety, security, general well-being, or operational mission of the VA and its population, they shall be immediately removed from performance and may face legal charges. Quality oversight shall be provided by the COR. 22. Contractor Personnel Security Requirements: Upon contract award, all key personnel shall be subject to the appropriate type of background investigation or screening per VA/VHA directive 0710 and must receive a favorable adjudication from CCA Personnel Security Specialist or VA Security and Investigations Center (SIC) depending on investigation or screening required. This requirement is applicable to all subcontract personnel. If the investigation or screening is not completed prior to the start date of the contract, the Contractor will be responsible for the actions of those individuals they provide to perform work for VA. Contract personnel who previously received a favorable adjudication as a result of a Government background investigation or screening may be exempt from this contract requirement. They must provide documentation to support the previous adjudication. Proof of previous adjudication must be submitted to the Contractor supervisor who shall provide to the VA Contracting Officer. Proof of previous adjudication is subject to verification. Some positions maybe subject to periodic re-investigation/screening. 1. Position Risk/Sensitivity - For all positions required under this contract, the position risk/sensitivity has been designated as: High Risk, Medium Risk, or Low Risk 2. Background Investigation/Screening - It is anticipated that the Contractor or contract personnel will be providing services at a VA facility(s) for MORE than 180 days under a single contract or series of contracts, or have access to VA computer data systems. The background investigation/screening commensurate with the requirements of this contract is: BI, MBI OR NACI 3. Contractor Responsibilities a. The Contractor shall prescreen all personnel to ensure they are able to read, write, speak, and understand the English language. b. The Contractor shall submit or have their contract personnel submit the following required forms to the Personnel Security Specialist or VA Contracting Officer, through the COR or Personnel Security Specialist, within five (5) business days of contract award. 4. Low Risk Investigative Requirements a. All investigations must be completed through the Electronic Questionnaires for Investigations Process (e-QIP). All contractors must complete the Authorization for Investigation Worksheet before they can complete the online e-Qip. b. Optional Form 306, Declaration for Federal Employment provide by VA point of contact. c. Electronic Fingerprint Verification or FD 258, U.S. Department of Justice Fingerprint Applicant Chart. d. Once the items requested are completed, the Contractor is authorized to provide services under the contract. As previously stated, if the investigation or screening is not completed prior to the start date of the contract, the Contractor will be responsible for the actions of those individuals they provide to perform work for VA. e. The Contractor, when notified of an unfavorable determination by the Government, shall withdraw the contract person from consideration of working under the contract. f. Failure to comply with these Contractor personnel security requirements may result in termination of the contract for default. 5. Government Responsibilities a. Upon receipt, the local VA facility or VA SIC, depending on the type of investigation/screening required, will review the accuracy of the items requested in paragraph above, and forward these items to OPM to conduct their portion of the background investigation or screening, as applicable. b. The requesting VA facility will pay for any portion of the investigation or screening conducted by OPM, if any. c. Depending on the type of investigation/screening required, the Personnel Security Specialist, or VA SIC will notify the VA Contracting Officer of the adjudicating results of the background investigation or screening. d. The VA Contracting Officer and Personnel Security Specialist will ensure that the required investigations or screening have been completed or are in the process of being requested. Personnel Identity Verification (PIV) of Contractor Personnel In accordance with FAR 52.204-9 and VA Directive 0735 - Personal Identity Verification of Federal Employees and Contractors, any contract person who requires routine physical access to a Federally-controlled facility and/or routine access to a Federally-controlled information system will be required to verify their identity prior to providing services under the contract. Prior to providing services under the contract, each contract person will be asked to provide two (2) forms of identification from the Accepted Identification Documentation List to the appropriate VA representative in order to obtain a proper VA-issued identification card. See the Accepted Identification Documentation List provided below. The COR, or designee, will be responsible for sponsoring each contract person that requires a VA-issued identification card. PIV ID Proofing Criteria The following criteria must be met by all VA employees, contractors, and affiliates prior to being issued a PIV card or Temporary Identity Badge. Continued Next Page Table of Accepted Identification (From Form I-9) Last Update: January 7, 2008 1. Two forms of identification are required from the above list of acceptable documents. Either of the following is accepted: a. Two forms of identification from the left column (Federal or State Government issued picture ID) b. One form of identification from the left column (Federal or State Government issued picture ID) and one form from the right column (Non-Picture ID or Acceptable Picture ID not issued by Federal or State Government). 2. The following rules apply for form identification: a. Any form of identification used for ID proofing may not be expired (except U.S. Passport) b. The Department of Veterans Affairs site/facility badges is not accepted as a valid form of identification. c. Veterans Affairs PIV Cards are federally issued ID cards and can be used as a valid form of identification. d. Handwritten or photocopied documents are not accepted. e. An ID issued before a legal name change (e.g. birth certificate or driver's license) can be presented as one form of ID if a legal document (e.g. marriage certificate/license or a court order) is also presented linking the previous name to the current legal name. The linking document has to display both the former and current legal names. Both documents must be valid and not expired (except U.S Passport). For example, a married woman may use both a certified copy of her birth certificate displaying her maiden name and a driver's license displaying her married name as the 2 forms of ID compliant with PIV Guidelines, as long as she provides a marriage license displaying both her maiden name and married name. f. The Applicant's name listed on the VA PIV Registration Portal, Request for One-VA Identification Card, must match the name on one of the IDs presented by the Applicant. g. The names on both forms of ID presented for ID proofing must match exactly. If one form of ID has a middle name or initial, the other form of ID must have a matching middle name or initial. One form can contain a middle name and the other can have a middle initial as long as the they match. ALL names must be accounted for on both forms of ID. Please see the acceptable and unacceptable ID proofing examples provided below. ACCEPTABLE NAME VARIATIONS ID # 1 - John Henry Smith; ID # 2 - John Henry Smith ID # 1 - John H. Smith; ID # 2 - John Smith 3. Access to and Safeguard of VA Information/Computer Systems a. VA may provide contract personnel with access to VISTA and general files maintained on VA computer systems. Sharing of these access codes or misuse of VA information/computer systems is a Federal crime. When contract personnel no longer provides services to VA, the Contractor shall immediately inform the COR to deactivated their access. The COR is responsible for deactivation. b. Computer access will require VA Cyber Security Awareness Training annually and acknowledge all agreements prior to access. (See attachment for security requirements). The COR is responsible for ensuring and documenting this requirement. c. Contract personnel with Computer access will take necessary precautions to safeguard information and prevent disclosures. If contract personnel suspect a compromised they will report such knowledge to the COR that same day. d. Remotely access will require prior approval from Information Security Officer (ISO). e. The Contractor shall make its internal policies and practices regarding the safeguarding medical electronic information available to VA. Contractors are not authorized to employ a lesser requirement then what is established by this document. f. Any changes in the VA directives during the term of this contract shall be deemed to be incorporated into this contract.
