- JUSTIFICATION FOR AN EXCEPTION TO FAIR OPPORTUNITY 1.Contracting Activity: Department of Veterans Affairs (VA) Office of Acquisition Operations Technology Acquisition Center 23 Christopher Way Eatontown, New Jersey 07724 2.Description of Action: This proposed action is for firm-fixed price delivery order to be issued under the National Aeronautics and Space Administration (NASA) Solutions for Enterprise-Wide Procurement (SEWP) V Government Wide Acquisition Contract (GWAC) for Flexera AdminStudio Enterprise software maintenance support. 3.Description of Supplies or Services: The Department of Veterans Affairs (VA) Office of Information Technology (OI&T), Enterprise Systems Engineering (ESE) has a requirement to renew maintenance on 12 Flexera AdminStudio Enterprise licenses. The required Flexera AdminStudio Enterprise software maintenance with Virtualization Pack (Silver), Part No. KSAVDK1, will include automatic notification of and access to all product updates and upgrades, security patches/updates, technical webinars, white papers, and unlimited access to technical support, 24 hours a day, 7 days a week. The period of performance for the software maintenance will be 12-months from date of award. 4.Statutory Authority: The statutory authority permitting this exception to fair opportunity is Section 41 U.S.C 4106(c)(2) as implemented by Federal Acquisition Regulation (FAR) Section 16.505(b)(2)(i)(B) entitled, "Only one awardee is capable of providing the supplies or services required at the level of quality required because the supplies or services ordered are unique or highly specialized." 5.Rationale Supporting Use of Authority Cited: Based on extensive market research, as described in Section 8 of this justification, it was determined that limited competition is available among authorized resellers for the required brand name Flexera AdminStudio software maintenance support services. Flexera AdminStudio provides a robust, intuitive means to package software and un-package/re-package that software for remote delivery. The current implementation ensures the proper delivery of software to targeted machines used throughout the Microsoft Systems Center Configuration Manager by ESE, and tracks all the software changes at every step in the Change and Release Management Process. Unlike other technologies, Flexera is fully compatible with all VA supported workstations and laptops located within the offices of ESE. The software maintenance is needed to ensure the existing software implementation remains fully operational. The Flexera software communicates through a source code that is based on Flexera proprietary data. Therefore, if any other source was to provide these maintenance services without the Flexera proprietary source code, it would not be able to push upgrades to the existing software or fix, and configure the software. Access to the proprietary source code is critical to meet the VA's need to maintain the current Flexera software as operational. Based on the market research conducted by the Government technical experts it has been determined only Flexera or its authorized resellers have the required access to the source code of the software to be able to meet the Governments' needs. 6.Efforts to Obtain Competition: Market research was conducted, details of which are in Section 8 of this justification. Limited competition is anticipated for this brand name software maintenance support. In accordance with FAR 5.301 and 16.505(b)(2)(ii)(D), this action will not be synopsized at award on the Federal Business Opportunities (FedBizOps) website due to the dollar threshold. In accordance with Far 16.505 (a)(4)(ii)(A), this justification will be submitted to all applicable NASA SEWP V GWAC holders along with the Request for Quotation in order to fully notify all interested parties. 7.Actions to Increase Competition: The Government will continue to conduct market research to ascertain if there are changes in the marketplace that would enable future actions to be fully competed. 8.Market Research: Flexera AdminStudio Enterprise maintenance is a commercially available off-the-shelf software license package currently in use in VA. When conducting market research in July 2016, the Government's technical experts reviewed similar software products to ascertain if these items could meet VA's requirements. Specifically, the Government's technical experts conducted web-based research on similar software maintenance products available. Based on reviews, the Government's technical experts determined that no other software maintenance can meet the Government's interoperability and compatibility requirements for the existing VA-owned Flexera software system because of Flexera's proprietary source code. The TAC conducted additional market research in July 2016 and again in September 2016 by utilizing the Provider Lookup Tool on the NASA SEWP V GWAC website, which found a total of 40 contract holders that can fulfill the Governments requirements, nine of which are Service-Disabled Veteran-Owned Small Business (SDVOSB) GWAC contract holders. Furthermore, market research was conducted on Vendor Information Page (VIP.gov) which found that two or more VIP verified vendors are capable of meeting requirements. Additionally, NASA SEWP V GWAC has a dynamic catalog where line items can be added based on customer requests, therefore, as long as the required item or service is within scope of the NASA SEWP V GWACs, items and services can be added to a NASA SEWP V GWAC holder's catalog on a daily basis. In addition, the requirements discussed herein have been found to be within scope of the NASA SEWP V GWAC in a separate determination. 9. Other Facts: None.
