SIEMENS APOGEE INSIGHT SYSTEM NOTICE OF INTENT ACTION NOTICE OF INTENT TO INCLUDE BRAND NAME COMPONENTS IN A FUTURE CONSTRUCTION CONTRACT FOR PERFORMANCE AT CLEAR, AK Solicitation Number: W911KB-17-R-0010 Agency: Department of the Army Office: U.S. Army Corps of Engineers Location: USACE District, Alaska Provisions set forth by the Federal Acquisition Regulation (FAR) § 6.302-1(c)(1) authorizes the use of brand name only supplies in solicitations/contracts or as part of an acquisition when supplies may be deemed to be available only from one or a limited number of sources, and when it is likely that award to any other source would result in substantial duplication of cost to the government that is not expected to be recovered through competition. As such, for the purposes described hereunder and in accordance with the Federal Acquisition Regulation (FAR) Subpart 6.302-1, Only one responsible source and no other supplies or services will satisfy agency requirements, coupled with the Authority 10 U.S.C. 2304(c)(1), the U.S. Army Corps of Engineers, Alaska District intends to issue a competitive solicitation that will include brand name only items. Specifically, the contractor awarded the competitive construction contract will be required to purchase the following brand name Critical Systems in support of the planned construction acquisition, Siemens APOGEE Insight System. The Siemens APOGEE Insight is used as the base-wide Utility Monitoring Control System (UMCS). All buildings at the installation at Clear, AK have to have a fully integrated building automation system, incorporating direct digital control (DDC) for energy management, equipment monitoring and control, temperature control and other building subsystems. Buildings that are initially stand-alone or not connected to the existing UMCS are required to be able to seamlessly connect with the proprietary Siemens APOGEE UMCS in the future. The use of the original manufacturer of materials and components is required to prevent issues of system functionality and extensive additional costs. The use of any other manufacturer would cause a need to replace in essence complete parts and accessories thus creating complete new systems. Therefore, the future contract will need to use brand name descriptions peculiar to one manufacturer for a specific system with whom a turn-key solution can be provided meeting all government requirements. The government has already developed plans and specifications for the planned construction acquisition, and intends to utilize full and open competitive procedures for the future solicitation/contract of the construction project requiring the brand name only components. The future solicitation will be numbered as W911KB-17-R-0010. The North American Industry Classification System (NAICS) for the project is 236220 with a small business size in dollars of $33.5M. Interested parties may identify their interest and submit clearly articulated product information, vendor/distributor information. Product information lacking the particular features that do not meet, or cannot be modified to meet, this agency's needs cannot be considered. A determination by the Government not to compete this requirement based upon responses to this notice of intent to include brand name component within the construction acquisition is solely within the discretion of the Government. Information received will be considered solely for the purpose of determining whether to include a statement of brand name or equal for the planned future competitive construction procurement.
