- Statement of Work Justification for Other than Full and Open Competition The Federal Communications Commission (FCC) intends to enter into a Purchase Order with Nixon Power Services, LLC for the maintenance of the FCC’s Type 1 generators in ten US locations. The objective of this effort is to supply power to critical loads during temporary interruptions of the commercial power supply. Managing power consumption using an onsite generator, can provide significant cost savings. An onsite generator reduces the risk of power outages and low power quality and control time-of-day related power charges. The goal of this effort is to provide regular and thorough preventive maintenance of the generator. The generator supports missions, equipment and personnel, for real-world events. A continuous source of power is required to maintain operational readiness. The period of performance for this effort is one base year, beginning 09/30/2016 thru 09/29/2017. This notice of intent is not a request for proposals or quotations, however, all responsible sources may submit a proposal or quotation to be considered by the FCC if received within 15 calendar days of publication of this notice. The authority for negotiating a sole source basis is made under FAR 13.106-1(b) which permits soliciting from a single source, if the contracting officer determines that the circumstances of the contract action deem only one source is reasonably available. The North American Industry Classification System (NAICS) Code is 221118. Any challenges to this sole source requirement must be received by September 30, 2016 NO later than 08:00am Washington D.C. eastern local time, in writing, and sent to nereyda.dunn@fcc.gov in order to be considered by the FCC for the purpose of determining whether or not to compete the requirement. Challenges must include information sufficient to enable the FCC’s needs as stated herein. A determination by the FCC not to compete this proposed requirement based on responses to this notice is solely within the discretion of the FCC. The FCC has already identified that there are no other capable sources that are Kohler certified and able to perform maintenance at all 10 US locations.
