- The U.S. Army Corps of Engineers intends to award a sole source fixed-price contract to Battelle Memorial Institute. As stipulated in the Water Resources Reform and Development Act (WRRDA) of 2014, the required work is only to be performed by 501(c)(3) non-profit organizations. The U.S. Army Corps of Engineers (USACE) is currently designing and constructing three canal pumping stations designed to reduce the risk to the canals from the storm surge from Lake Pontchartrain and maintain flows from the canals to Lake Pontchartrain. The intended contract will be to conduct an Independent External Peer Review (IEPR) for the features of PCCP-01 projects during the design and construction phases of the project in accordance with the Water Resources Development Act (WRDA) 2007 (Public Law 110-114), Section 2034 (IEPR) and 2035 (Safety Assurance Review) and extended by WRRDA 2014, section 1044, to be performed by an independent non-Government agency. Phase I of this review was conducted by Battelle Memorial Institute under an Army Research Office contract, W911NF-11-D-0001 delivery order 0200, TCN 13024. Phase II will require the exact same panel of reviewers who conducted the Phase I review. This is a special notice prepared in accordance with the format in Federal Acquisition Regulation (FAR) 6.302-1(a)(2); services required by the agency are available from only one responsible source and no other type of supplies or services will satisfy agency requirements. However, any firm that believes it can meet this requirement may give written notification to the Contracting officer within fifteen (15) days of publication of this announcement. Supporting evidence must be in sufficient detail to demonstrate the ability to comply with the requirement. Responses received will be evaluated; however, a determination by the Government to compete the proposed procurement based on the responses to this notice is solely within the discretion of the Government. If no responses are received by 17 September 2016, the U.S. Army Corps of Engineers will proceed with awarding a fixed price contract to Battelle Memorial Institute.
