- JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION. HSCG3816Q010151 BUY POSTING 15K - 25K THIS REQUIRED HIGH PRIORITY POSTING WILL CLOSE AT 4:30 PM EST 08/29/2016. AIRCRAFT COMPONENT(s) / INTENT TO AWARD TO OEM OR INCUMBENT: Full Traceability back to OEM is required and must be stated with the quotation. USCG ALC MRS is seeking quotes (via plain text email) with intent to award, using simplified acquisitions, a purchase order for the following: 1. NSN: 5999-01-HS3-0350, SATCOM GASKET, P/N AG728000-76, QTY 16 EA: MFGCD: 1NPE1 *** Justification and approval for other than full and open competition is attached. FOB ORIGIN: Indicate shipping and handling charges included in the price for each line item. Only new traceable parts to the manufacture by the OEM AVIATION DEVICES AND ELECTRONIC CO (AVDEC) are acceptable. Full Traceability back to Original Equipment Manufacturer (OEM) is required and must be stated with the quotation. Drawings and specifications are not available, and cannot be furnished by the Government. Required delivery is 10 days after receipt of order. Deliver to USCG Aviation Logistics Center (ALC), Receiving Section, Bldg. 63, Elizabeth City, North Carolina, 27909-5001. This time critical notice will close at 4:30 PM EST AUG 29, 2016 with award anticipated shortly thereafter. All responsible sources may submit a response which, if received prior to the closing date, must be considered by the agency. This award is anticipated to be in excess of $15K but is not expected to exceed $25K. This special notice of intent to award is posted on WWW.FBO.GOV in compliance with and in accordance with Federal Acquisition Regulations Part 5.101 (Methods of Disseminating Information) between $15K and $25K. Award will be made upon determination of fair and reasonable pricing and is subject to FAR Part 12 and FAR Part 13. Purchase Order terms and conditions will be in accordance with FAR 52.212-4 Contract Terms and Conditions - Commercial Items (MAY 2015) and the applicable clauses of FAR 52.212-5 Contract Terms and Conditions Required to Implement Statutes or Executive Orders - Commercial Items (JUN 2016). Incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2005-89. The applicable North American Industry Classification Standard (NAICS) Code is 336413. The small business size standard is 1,250 employees. It is anticipated that a non-competitive Sole Source Purchase Order will be awarded as a result of this notice pending the availability of funds. It is the Government's belief that only AVDEC has the required proprietary technical and engineering data to provide the parts. The information submitted must include a letter from the OEM verifying the Offeror is an authorized distributor and verifying the OEM AVDEC will provide proprietary data. Vendors who do not meet the capability requirement will not be considered and should not respond. This notice of intent will not be extended or the award delayed for a vendor to submit their data for capability determination or for registration in SAM.GOV. SYSTEM FOR AWARD MANAGEMENT (SAM) The system for award management (SAM) is a free web-site which consolidates Federal Procurement systems and the catalog of Federal Domestic Assistance. The United States Coast Guard C-27J program requires spare aircraft parts for the fleet. Only the exact part numbers listed on the Purchase Order will be accepted. This requirement must be restricted to authorized sources of the Original Equipment Manufacturer (OEM) or firms who can effectively demonstrate their ability to provide the components and obtain the proprietary data required meeting form, fit, and function of the units. The Coast Guard requires that distributors or other potential sources be ASA-100 certified, or in compliance with other quality systems listed in FAA Advisory Circular 00-56A. These requirements are necessary in order for the Coast Guard to maintain the capability to adequately support all Coast Guard missions. 52.203-98 Prohibition on Contracting with Entities that Require July 2016 Certain Internal Confidentiality Agreements - Representation (Deviation) (a) In accordance with Section 743 of Division E, Title VII, of the Consolidated and Further Continuing Appropriations Act, 2015 (Pub. L. 113-235) and its successor provisions in subsequent appropriations acts (and as extended in continuing resolutions), Government agencies are not permitted to use funds appropriated (or otherwise made available) for contracts with an entity that requires employees or subcontractors of such entity seeking to report waste, fraud, or abuse to sign internal confidentiality agreements or statements prohibiting or otherwise restricting such employees or subcontractors from lawfully reporting such waste, fraud, or abuse to a designated investigative or law enforcement representative of a Federal department or agency authorized to receive such information.
