Description
JUSTIFICATION FOR AN EXCEPTION TO FAIR OPPORTUNITY 1.Contracting Activity: Department of Veterans Affairs (VA) Office of Acquisition Operations Technology Acquisition Center 23 Christopher Way Eatontown, New Jersey 07724 2.Description of Action: This proposed action is for firm-fixed price delivery order to be issued under the National Aeronautics and Space Administration (NASA) Solutions for Enterprise-Wide Procurement (SEWP) V Government Wide Acquisition Contract (GWAC) for NetZoomDC software including software licenses and software maintenance support. 3.Description of Supplies or Services: The Department of Veterans Affairs (VA) Region 3 Office of Information and Technology (OIT) has a requirement for NetZoomDC software, including software maintenance support, for team members in the IT Service Support (ITSS) Service Line, Facilities Management Division. NetZoomDC is rich and fully scalable enterprise Data Center Infrastructure Management (DCIM) software. This product enables Data Center professionals to model, manage, monitor and maximize data center assets, space, power and cooling, and provides real-time insight into the management of the data center. VA requires maintenance support for the above mentioned software in order to keep the software fully functional and operational. The software maintenance will consist of software upgrades and updates to include major releases, point releases, service releases and security releases of applicable software on a quarterly basis, and/or within 48 hours in cases in which a high risk vulnerability fix becomes available. The period of performance shall include a 12-month base period and four 12-month option periods for continued maintenance support. 4.Statutory Authority: The statutory authority permitting this exception to fair opportunity is Section 41 U.S.C 4106(c)(2) as implemented by Federal Acquisition Regulation (FAR) Section 16.505(b)(2)(i)(B) entitled, "Only one awardee is capable of providing the supplies or services required at the level of quality required because the supplies or services ordered are unique or highly specialized." 5.Rationale Supporting Use of Authority Cited: Based on extensive market research, as described in Section 8 of this justification, it was determined that limited competition is available among authorized resellers for the required brand name NetZoomDC software, including software licenses and software maintenance support. The implementation of NetZoomDC is necessary for the Facilities Management Division to effectively manage, monitor and maximize its data center assets, space, power and cooling in order to comply with Federal Data Center Consolidation Initiative (FDCCI) and Data Center Optimization Initiative (DCOI) as mandated by the Office of Management and Budget (OMB). NetZoomDC is the only software that provides unlimited asset and data center monitoring and an unlimited simple network management protocol (SNMP) string. These features are required in order for the Facilities Management Division to effectively monitor and optimize its data center assets, and provide real-time reporting to satisfy federal initiatives. In addition, NetZoomDC software is a proprietary software product; therefore, no other software maintenance provider has the proprietary code to perform the necessary support services. Based on the market research conducted by the Government technical experts it has been determined only NetZoomDC or its authorized resellers have the required access to the source code of the software to be able to meet the Governments' needs. 6.Efforts to Obtain Competition: Market research was conducted, details of which are in Section 8 of this justification. Limited competition is anticipated for this brand name software and maintenance support. There are five authorized resellers of the NetZoomDC software and maintenance support on the NASA SEWP V GWAC. In accordance with FAR 5.301 and 16.505(b)(2)(ii)(D), this action will not be synopsized at award on the Federal Business Opportunities (FedBizOps) website due to the dollar threshold. In accordance with Far 16.505 (a)(4)(ii)(A), this justification will be submitted to all applicable NASA SEWP V GWAC holders along with the Request for Quotation in order to fully notify all interested parties. 7.Actions to Increase Competition: The Government will continue to conduct market research to ascertain if there are changes in the marketplace that would enable future actions to be fully competed. 8.Market Research: NetZoomDC is a commercially available off-the-shelf software license package currently in use in VA. When conducting market research in June 2016, the Government's technical experts reviewed similar software products to ascertain if these items could meet VA's requirements. Specifically, the Government's technical experts conducted web-based research on similar software products available from iTRACS and Device42. The research revealed that neither the iTRACS nor Device42 software products provide for unlimited asset monitoring or feature an unlimited SNMP string which are both required for the Facilities Management Centers to effectively monitor its data center environments. In addition, the market research confirmed that the source code required to issue the updates is proprietary, and therefore, only NetZoomDC or its authorized resellers have the tools and can access the source code and other proprietary data to provide the necessary maintenance support. Market research was also conducted by utilizing the Provider Lookup Tool on the NASA SEWP V GWAC website, which found a total of five contract holders that can fulfill the Governments requirements, one of which is a Service-Disabled Veteran-Owned Small Business (SDVOSB). In addition, NASA SEWP V GWAC has a dynamic catalog where line items can be added based on customer requests, therefore, as long as the required item or service is within scope of the NASA SEWP V GWACs, items and services can be added to a NASA SEWP V GWAC holder's catalog on a daily basis. In addition, the requirements discussed herein have been found to be within scope of the NASA SEWP V GWAC in a separate determination. 9. Other Facts: None.
