- Authority and Introduction: Under authority of the Federal Acquisition Regulation (FAR) Part 13.106-1(b), the National Institute of Standards and Technology (NIST) intends to negotiate on a sole source basis with SHOPTECH INDUSTRIAL SOFTWARE CORP. (SHOPTECH), 180 GLASTONBURY BLVD STE 303, GLASTONBURY, CT, 06033-2246, as the only capable source that can provide E2 Shop Systems Job Management Software. Correspondingly, based on the foregoing authority under the FAR, the NIST intends to award on a sole source basis. The intended procurement will be classified under North American Industry Classification System (NAICS): 511210-Software Publishers; Business Size Standard: $38.5 Million. Government's Requirements: The contractor shall provide yearly maintenance of software upgrades, patches, and online / phone support for the FTG's current E2 Shop Systems Job Management Software. The contractor shall provide unlimited online and phone support for all E2 Shop Systems Job Management Software related issues such as: - programming support - software trouble shooting - post processor issues - applications engineering. The contractor shall also provide unlimited software upgrades, version corrections and/or patches. Sole Source Rationale: Market Research was conducted and SHOPTECH was identified as the sole source capable of meeting the Government's Requirements. SHOPTECH is the only licensed distributor of the E2 Shop Systems Job Management Software. E2 Shop Systems Job Management Software is the proprietary Enterprise Resource Planning (ERP) Software of SHOPTECH. No other appropriate sources were identified, and therefore a sole source solicitation is required with SHOPTECH. The NIST is required to constantly and accurately maintain its logistics and operations; and, only SHOPTECH provides E2 Shop Systems Job Management Software which is needed for continuity of NIST logistics and operations. Thus, SHOPTECH is the sole provider of the E2 Shop Systems Job Management Software. General Information and Responses to this Notice: This notice of intent is not a request for competitive proposals or quotes and no solicitation document will exist for this requirement. However, companies interested in responding to this notice shall submit technical data, including price and sufficient documentation to determine capabilities and qualifications in meeting or exceeding the Government's Requirements. All statements received by the closing date of this notice will be considered by the Government. A determination by the Government not to compete based on responses to this notice is solely within the discretion of the Government. Companies interested in responding to this notice: 1. May submit their capabilities and qualifications to meet or exceed the Government's requirements, in writing via e-mail, to Mario Gray using e-mail address: mario.gray@nist.gov, with the solicitation number referenced in the subject line of the e-mail. 2. Shall submit their responses by no later than the closing date of this notice. Oral communications are not acceptable in response to this notice.
