Description
Modification #3: Reference is made to the June 21, 2016, announcement, reference number 2016-31010A, inviting submission of qualifications and proposal data for the Indonesia Eastern Airspace Aviation Safety Technical Assistance. USTDA has received an inquiry: "Regarding USTDA audit rights of contractors' and subcontractors' "books, records, and other documents, sufficient to reflect properly all transactions under or in connection with the Contract," what is the scope of the records that must be retained for three years? With respect to fixed price subcontracts (e.g., for commercial items or commercial services), does this audit right extend to labor and time charging records of all employees who worked on the transaction? Does it include records of the costs incurred by 2nd, 3rd, 4th tier suppliers of commercial items or commercial services? Is there any minimum dollar threshold for the flow-down or applicability of the audit clause?" In response, the scope of the books and records requirement may look different depending on how a company is keeping track of the transactions that are related to the activity. Yes, this requirement extends to the labor and time charging records for any personnel that works on the activity during the performance of the Terms of Reference. The books and records requirements should "flow down" to subcontracts related to the activity. There is no minimum dollar threshold amount for the applicability of the books and records requirement. USTDA has received inquiries regarding the applicability of the Truth in Negotiations Act. In response, USTDA's grants are not subject to the requirements in the Truth in Negotiations Act (TINA), as TINA is applicable to FAR contracts, not federal assistance. USTDA is making this information available for the benefit of all prospective bidders. The response date for this RFP remains 5:00 PM local (Jakarta) time on August 19, 2016.
