- This "Special Notice" announcement was posted on FBO, on April 7, 2016. ANNOUNCEMENT NOTIFICATION INTENT TO AWARD A FIRM FIXED CONTRACT WITH A JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETION FOR AIRPORT SECURITY SERVICES FOR THE AMERICAN EMBASSY IN KABUL, AFGHANISTAN The following J&A was attached: JUSTIFICATION AND APPROVAL FOR OTHER THAN FULL AND OPEN COMPETITION (OVERSEAS CONTRACTING ACTIVITIES) 1. I recommend that Embassy Kabul use other than full and open competition for the acquisition of security coverage for the standing up of an additional international airport terminal in Kabul, Afghanistan. The total estimated cost for this contract is $6,500,000 for the base year and four option years. 2. Nature and/or description of the action being approved: The US Embassy Kabul requires award of a Services Contract to perform security within the new Terminal Two (COM Terminal), on Camp Alvarado, Kabul, Afghanistan. U.S. Embassy Kabul has a security requirement that precludes embassy personnel to transit through the Kabul main International Terminal. The General Services Office requires a security contract for the standing up of terminal two of the International Terminal complex. Terminal Two is located on chief of mission property (Camp Alvarado), in order to make it compliant with international standards and allow international flights to be conducted from this terminal security must be established in accordance with ICAO standards. 3. A description of the supplies or services required to meet the Department's needs. The Contract will provide security services to operate an international terminal that services five major airlines six day per week, on two eight hour shifts per day. Services provide managerial, shift labor and dog teams to ensure ICAO standards are maintained. After negotiations by Embassy staff, Afghan officials responsible for the airport, immigration, and customs, approved Post's plan to open a terminal on Camp Alvarado. HKIA authorities call this "HKIA Terminal 2". Terminal 2 will utilize the existing passenger terminal on Camp Alvarado that was recently equipped with overhead cover and sidewall protection under the OBO Phase II construction program. Afghan Ministry of Interior, MOI, customs and immigration officials will work at Terminal 2 and process inbound and outbound passengers in compliance with ICAO standards. In order to comply with ICAO requirements, passenger and baggage security screening at Terminal 2 will be conducted by Olive Group which currently provides the same services at the commercial terminal. Post must utilize the same Olive Group services to provide security at Terminal 2. 4. An identification of the statutory authority permitting other than full and open competition. 41 USC 3304(a)(1), FAR 6.302-1, Only one responsible source and no other supplies or services will satisfy agency requirements. 5. A demonstration that the proposed contractor's unique qualifications or the nature of the acquisition requires use of the authority cited. Olive Group is the current contracted firm that provides this service to the Hamid Karzai International Airport and no other firm is allowed to operate by the authority of the Afghanistan Civil Aviation Authority (ACAA). In order for the ACAA to allow this embassy-only terminal to operate, and meet ICAO standards, the USG must utilize this firm. 6. A description of efforts made to ensure that offers are solicited from as many potential sources as is practicable. FAR 6.302-1(d)(2) will be complied with in respect to FedBizOpps posting of notices. 7. A determination that the anticipated cost to the Government will be fair and reasonable. Proposal has been reviewed and determined that it is within the fair market value as paid by the current ACAA for similar services provided at the main terminal. 8. A description of the market survey conducted and the results or a statement of the reasons a market survey was not conducted. Olive Group is the only provider for airport security services, so a market survey was not possible, considering the unique situation of working within the confines of the existing aviation rules. This is a unique situation as they are the only source that can be used and this is a war zone. 9. Any other facts supporting the use of other than full and open competition. None 10. A listing of sources, if any, that expressed, in writing, an interest in the acquisition. None 11. A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisition for the supplies or services required. Include a statement that this J&A for other than full and open competition will be published on FedBizOpps in accordance with FAR Section 6.305 within 14 days of award (or within 30 days if the J&A is for unusual and compelling urgency.) Olive Group is the current company contracted to provide this service within the confines of the airport complex. They are the only Contractor that the Afghanistan Civil Aviation Authority will allow to operate within the airport complex. The J&A for other than full and open competition will be published on FedBizOpps in accordance with FAR Section 6.305, within 14 days of award.
