PDF Combo/Synopsis Solicitation This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; proposals are being requested and a written solicitation will not be issued. Solicitation Number: F3Q2AD6181A002; issued as a RFQ (Request for Quotation) The following clauses and incorporated provisions are applicable to subject solicitation (in effect through FAC 2005-88 dated 15 June 2016 and DPN 20160630 dated 30 June 2016) This requirement is being issued for 100% Small Business Set-Aside. NAICS Code: 325120 PSC: 6830 Size: 500 Employees The purchase of the following ITEM NO Supplies or Services Quantity Unit of Issue 0001 Liquid Propane: 427,000 Gallons First Shipment within 3 business days of contract award and delivery of all loads to be completed within 20 days of contract award. ***PROPOSED PRICES ARE TO BE HELD FOR 10 DAYS AFTER PROPOSAL DUE DATE*** FOB Destination Purchase Request #: F3Q2AD6181A002 Type of Contract: Firm Fixed Price Item/Requirements Description: Requirement for Liquid propane fuel delivered to Robins AFB, GA. Contractor shall provide propane fuel on a "full service" basis, including acquisition, transportation, and delivery to Robins AFB. Specific delivery instructions will be provided to contract awardee. Ship to address is: Propane Storage Tanks Building 8216 Marchbanks Road Robins AFB GA 31098 Price is FOB Destination (FAR 52.247-34 FOB Destination). Deliver all loads within 20 days after award. First Delivery shall be within 3 business days of contract award. FAR 52.212-1 -- Instructions to Offerors -- Commercial Items. As prescribed in 12.301(c), the Contracting Officer may insert a provision substantially as follows: Evaluation -- Commercial Items (Jan 1999) (a)The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factor shall be used to evaluate offers: LOW PRICE (End of Provision) FAR 52.212-3 -- Offeror Representations and Certifications -- Commercial Items. As prescribed in 12.301(b)(1) FAR 52.212-4 Contract Terms and Conditions - Commercial Items, applies. (MAY 2014) FAR 52.212-5 CONTRACT TERMS AND CONDITIONS REQUIRED TO IMPLEMENT STATUTES OR EXECUTIVE ORDERS--COMMERCIAL ITEMS (DEVIATION 2013-O0019) (Jan 2014) [Class Deviation- 2013-O0019, Commercial Item Omnibus Clauses for Acquisitions Using the Standard Procurement System. This clause deviation is effective on Sep 25, 2013, and remains in effect for five years, or until otherwise rescinded. (a) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph (a) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, and does not contain the clause at 52.215-2, Audit and Records -- Negotiation. (1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor's directly pertinent records involving transactions related to this contract. (2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR Subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved. (3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law. (b) (1) Notwithstanding the requirements of any other clause in this contract, the Contractor is not required to flow down any FAR clause, other than those in this paragraph (b)(1) in a subcontract for commercial items. Unless otherwise indicated below, the extent of the flow down shall be as required by the clause- (i) 52.203-13, Contractor Code of Business Ethics and Conduct (Apr 2010) (Pub. Whenever any FAR or supplemental clause is used with an authorized deviation, the contracting officer shall identify it by the same number, title, and date assigned to the clause when it is used without deviation, include regulation name for any supplemental clause, except that the contracting officer shall insert "(Deviation)" after the date of the clause.
