- The Army Contracting Command - Redstone (CCAM-RDI), Fort Eustis, VA, intends to negotiate with only one source under the authority of FAR 6.302-1(a)(2)(ii), "Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements", with L-3 Aviation Communication & Surveillance Systems, LLC (CAGE Code 1WYD3), 19810 N. 7th Ave, Phoenix, AZ 85027, to purchase eight (8) Electronic Standby Instrument System (ESIS)GH-3900-series Displays, Part Number 501-1851-01, for the MH-60 Black Hawk Helicopter into an already-approved Common Avionics Architecture Suite (CAAS) cockpit configuration. REASON AUTHORITY CITED L-3 Aviation Communication & Surveillance Systems, LLC, owns the proprietary rights for the ESIS Displays. L-3 Aviation Communication & Surveillance Systems, LLC is the original equipment manufacturer and only authorized vendor able to sell and modify the ESIS Displays. L-3 developed the ESIS Displays at private expense and has no interest in selling these rights to the Government at this time. The Government does not own sufficient rights to the data to allow open competition. No other type of hardware or component can satisfy the government's need due to the unique configuration of this air data computer that is (a) designed into the CAAS and (b) qualified and approved for use under a Department of the Army (DA) Air Worthiness Release (AWR). In addition, award to another source would result in substantial duplication of cost to the Government that is not expected to be recovered through competition. Interested persons may identify their interest and capability to respond to the requirement or submit proposals. This notice of intent is not a request for competitive proposals. However, all capabilities statements or proposals received prior to the closing date set in this synopsis will be considered by the Government. A determination by the Government not to compete this proposed contract based upon responses to this notice is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement.
