Description
Justification and Approval for Contract No. W564KV-15-C-0183 On 22 April 2016, the Army awarded a follow-on contract (W564 KV -16-C-0012) to Tech Trans International, Inc ( TTI ). However, on 28 April 2016 the incumbent contractor ( TMC ) submitted a GAO protest (B-413046). As a result of the protest, the KO issued a stop-work order to TTI on 29 April 2016. In addition to the GAO protest, another contractor (C4ID) submitted a KO-level protest. On 29 April 2016, the KO extended the performance period on contract 15-C-0183 to 29 May 2016 (one month) in order to allow time for GAO's ruling. This extension was accomplished through modification P00002. On 2 May 2016, the Government requested GAO to dismiss the protest. As of 25 May 2016, GAO has not issued a ruling on the Army's motion. Because the customer requires continued performance, Contract No. 15-C-0183 must be extended another month to 29 June 2016. This extension is for one month to allow GAO to resolve the protest to W564 KV -16-C-0012. However, there is the possibility that additional months could be required if there is a delay in the GAO ruling. Further, additional months may be necessary to resolve the KO-level protest, as the analysis of that protest is ongoing. Should additional time be required for the ongoing litigation or for corrective action steaming from the litigation, this Justification and Approval approves an additional three months of performance. Based on the above, it is not possible for another contractor to be able to perform services beginning on 30 May 2016. The contractor who was awarded the follow-on contract (W564 KV -16-C-0012) is under a stop work due to the GAO protest by the incumbent. Further, as the attempt to award this competitive bridge contract has demonstrated, there is insufficient time available to compete a bridge contract that is currently under protest. A break in service for interpreter and translation services would severely impact mission success of the GDP- ISAF training program as it would create an immediate failure to communicate effectively.
