Description
This is a combined synopsis/solicitation for commercial items prepared in accordance with the Federal Acquisition Regulation (FAR) format in Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; proposals are being requested herein and a written solicitation will not be issued. This solicitation is being issued in conjunction with FAR Part 13.106. The solicitation number is FDA 16-223-1160292 and is issued as a Request for Quote (RFQ). The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular (FAC) 2005-88 dated May 16, 2016. The associated North American Industry Classification System (NAICS) code for this acquisition is 334516 (Analytical Laboratory Instrument Manufacturing); applicable Small Business Size Standard is 1,000 employees. This requirement is solicited as full and open competition and any qualified vendor regardless of size status may submit a quote. Respondents are responsible for delivery in person, by e-mail, fax, mail or other delivery method of complete proposals to the Point of Contact (POC) listed below. Questions and requests for information regarding this solicitation should also be directed to: Tim Walbert Contract Specialist U.S. Food and Drug Administration (FDA) National Center for Toxicological Research (NCTR) 3900 NCTR Road | HFT-320 Bldg 50, Rm 426 | Jefferson, AR 72079 o. 870.543.7267 | f. 870.543.7990 Statement of Work (SOW) Background and General Requirement The U.S. Food and Drug Administration (FDA), National Center for Toxicological Research (NCTR), Division of Genetic and Molecular Toxicology, will be conducting a three-year study in immunotoxicity assessment of nanomaterials using human immune cell-based biomarkers. This study requires a Western Blot Capillary-Based Immunoassay System, ProteinSimple Simple Western Systems WesTM Product Code 004-600 or equal, to include system installation kit, training kit, and eight (8) capillary reagent kits. Four one-year option periods of post-warranty preventive maintenance (PM) service are also required. The required instrument system will be utilized to detect specific proteins in a tissue sample or cell culture homogenate or extract. A. Western Blot Capillary-Based Immunoassay System - General Requirement 1.The components and/or equipment shall be a newly manufactured, not used and/or refurbished, or previously used for demonstration; 2.The system shall be warranted for parts and labor from date of installation and official receipt and acceptance of the equipment. To the maximum extent possible, all warranty work shall be performed on-site at NCTR; 3.Delivery of the system shall be a turn-key solution, i.e., with all components, accessories, start-up supplies required for installation and start-up; 4.The Contractor shall provide on-site (Government-site) operator familiarization training on the system upon completion of installation. Such familiarization shall include system operations, optimization, and basic preventive maintenance procedures; 5.The Contractor shall include all parts, travel, and labor to perform installation during normal duty hours (Monday through Friday, 8 am to 4:30 pm, Central Time). B.Western Blot Capillary-Based Immunoassay System - Minimum Salient Characteristics 1.Shall be designed to minimize handling requirements; 2.Capable of separating and analyzing proteins by size from 12 to 400kDa; 3.Capable of immunoassay analysis, total protein analysis, and charge-based assay methods; 4.Capable of ng-level sensitivity with minimum of 5uL material; 5.Capable of detecting protein levels as low as pg(10-12g); 6.Capable of automated protein separation and detection. C. Minimum Installation, Set-Up, Testing and Training Requirements The Contractor shall provide all labor, travel, and tools to set-up the equipment at the address provided below, to include shipping. The contractor shall demonstrate upon installation that the item meets or exceeds all performance specifications. Upon FDA acceptance of the system, the contractor shall provide on-site operator training and system familiarization. Such familiarization shall include system operations, calibration, optimization, trouble-shooting and basic operational maintenance procedures. D.Minimum Warranty Requirements Initial warranty period shall be for a period of no less than twelve months upon successful installation of the system, and shall include all hardware, software, components and sub-components necessary to the installation. Warranty service shall be inclusive of parts, labor and travel. E.Minimum Post-Warranty Preventive Maintenance (PM) and Repair Service Requirements The Government requires four (4) one-year option periods for post-warranty preventive maintenance and repair service, as required or recommended by the Original Equipment Manufacturer (OEM) for the Western Blot capillary-based immunoassay system specified herein, to begin upon expiration of initial warranty period., Post-warranty preventive maintenance and repair service requirements and specifications for each option year period shall include: 1.Unlimited repair service visits within 8 business days of call for service (for issues that can't be resolved remotely via phone or Internet), Mondays-Fridays (excluding Federal Holidays) between the hours of 7:00 AM-5:00 PM Central Standard Time (CST); 2.Minimum of one (1) scheduled on-site preventive maintenance (PM) visit per contract year; 3.Performance by formally trained and certified technicians/engineers; all repairs and PM services shall be performed according to OEM specifications, manuals, and service bulletins, using OEM replacement parts, components, subassemblies, etc.; 4.Pricing shall be inclusive of labor, travel, replacement parts, components, subassemblies, etc. 5.Unlimited software and firmware updates; 6.Records and Reports - the Contractor shall, commensurate with the completion of each service call (inclusive of warranty service), provide the end-user of the equipment with a copy of a field service report/ticket identifying the equipment name, manufacturer, model number, and serial number of the equipment being serviced/repaired and detailing the reason for the service call, a detailed description of the work performed, the test instruments or other equipment used to affect the repair or otherwise perform the service, the name(s) and contact information of the technician who performed the repair/service, and for information purposes, the on-site hours expended and parts/components replaced. In addition, the Contractor shall provide a written report to the FDA COR and Contract Specialist, summarizing all maintenance and repair activities (including warranty work) each time service and/or repair is performed. (d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, and does not contain the clause at 52.215-2, Audit and Records-Negotiation. (1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor's directly pertinent records involving transactions related to this contract. (2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR Subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved. (3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law. (e)(1) Notwithstanding the requirements of the clauses in paragraphs (a), (b), (c), and (d) of this clause, the Contractor is not required to flow down any FAR clause, other than those in this paragraph (e)(1) in a subcontract for commercial items. The following FAR 52.212-1 addenda apply: Paragraph (b)(4): To ensure information is available, offerors shall furnish as part of their proposal all descriptive material necessary for the government to conclusively determine that the product offered is technically acceptable. The government is not responsible for locating or securing any information, which is not identified in the proposal. Paragraph (c): Period for acceptance of offers. The offeror shall state on its quote that quoted prices are firm until September 30, 2016. This solicitation is being issued under the premise that the offeror will certify that the combination of equipment maintenance/service it will propose to fulfill this requirement is exempt from the Service Contract Act per the conditions set forth in FAR 52.222-48 & FAR 22.1003-4(c). If the Contractor certifies that the company is exempt under the terms and conditions of 52.222-48, then clause 52.222-51 will be applicable to the resulting order. In the event that a contractor does not make this certification, the traditional Service Contract Act clauses 52.222-41, and 52.222-43 shall be included in the resulting order award as well as Wage Determination WD 05-2035 (Rev.-18). This Wage Determination can also be accessed at the following link: http://www.wdol.gov/wdol/scafiles/std/05-2035.txt?v=18 FAR CLAUSE 52.222-48 EXEMPTION FROM APPLICATION OF THE SERVICE CONTRACT ACT TO CONTRACTS FOR MAINTENANCE, CALIBRATION, OR REPAIR OF CERTAIN EQUIPMENT- CERTIFICATION applies to this solicitation: (a) The offeror shall check the following certification: CERTIFICATION The offeror [ ] does [ ] does not certify that- (1) The items of equipment to be serviced under this contract are used regularly for other than Government purposes, and are sold or traded by the offeror (or subcontractor in the case of an exempt subcontractor) in substantial quantities to the general public in the course of normal business operations; (2) The services will be furnished at prices which are, or are based on, established catalog or market prices for the maintenance, calibration, or repair of equipment. (i) An "established catalog price" is a price included in a catalog, price list, schedule, or other form that is regularly maintained by the manufacturer or the offeror, is either published or otherwise available for inspection by customers, and states prices at which sales currently, or were last, made to a significant number of buyers constituting the general public. (ii) An "established market price" is a current price, established in the usual course of trade between buyers and sellers free to bargain, which can be substantiated from sources independent of the manufacturer or offeror; and (3) The compensation (wage and fringe benefits) plan for all service employees performing work under the contract are the same as that used for these employees and equivalent employees servicing the same equipment of commercial customers. (b) Certification by the offeror as to its compliance with respect to the contract also constitutes its certification as to compliance by its subcontractor if it subcontracts out the exempt services. If the offeror certifies to the conditions in paragraph (a) of this provision, and the Contracting Officer determines in accordance with FAR 22.1003-4(c)(3) that the Service Contract Act- (1) Will not apply to this offeror, then the Service Contract Act of 1965 clause in this solicitation will not be included in any resultant contract to this offeror; or (2) Will apply to this offeror, then the clause at 52.222-51, Exemption from Application of the Service Contract Act to Contracts for Maintenance, Calibration, or Repair of Certain Equipment-Requirements, in this solicitation will not be included in any resultant contract awarded to this offeror, and the offeror may be provided an opportunity to submit a new offer on that basis. (c) If the offeror does not certify to the conditions in paragraph (a) of this provision- (1) The clause in this solicitation at 52.222-51, Exemption from Application of the Service Contract Act to Contracts for Maintenance, Calibration, or Repair of Certain Equipment-Requirements, will not be included in any resultant contract awarded to this offeror; and (2) The offeror shall notify the Contracting Officer as soon as possible, if the Contracting Officer did not attach a Service Contract Act wage determination to the solicitation. (d) The Contracting Officer may not make an award to the offeror, if the offeror fails to execute the certification in paragraph (a) of this provision or to contact the Contracting Officer as required in paragraph (c) of this provision. The provision at 52.212-2 Evaluation-Commercial Items (OCT 2014) is applicable to this solicitation: (a) The Government will award a contract resulting from this solicitation to the lowest price technically acceptable responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government. Proposals will initially be ranked from lowest to highest total price. The lowest-priced proposal will then be evaluated for technical acceptability. If determined technically acceptable, and the price is fair and reasonable, an award will be made to that offeror. If, however, the lowest priced offer is determined to be technically unacceptable the next lowest price proposal will be evaluated for technical acceptability, and so on until a technically acceptable proposal is found. (b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s). (c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award. The Provision at FAR 52.212-3, Offeror Representations and Certifications-Commercial Items (NOV 2015), applies to this acquisition. The Offeror shall complete only paragraph (b) of this provision if the Offeror has completed the annual representations and certification electronically via the System for Award Management (SAM) website accessed through http://www.acquisition.gov. If the Offeror has not completed the annual representations and certifications electronically, the Offeror shall complete only paragraphs (c) through (p) of this provision.
