- SUBJECT: Intent to sole source of Oil Spill Response. The National Park Service (NPS), Glacier Bay National Park & Preserve has a continuing requirement to have Petroleum Spill Response Plans in compliance with section 4202 of the Oil Pollution Act of 1990 (OPA 90), section 311(j) of the Federal Water Pollution Act (FWPCA), and 33 CFR 154.1045. Due to the size and scope of its fuel operations, GLBA must designate a classified U.S. Coast Guard Oil Spill Removal Organization (OSRO) to satisfy the requirements of 33 CFR 154.1045 and 33 CFR 154.1028(a)(1)(4). This announcement constitutes the only notice. This is not a request for quotes. A determination not to compete is solely within the discretion of the Government. Any response to this notice must show clear and convincing evidence that competition would be advantageous to the Government. Responses must be received no later than 5:00 PM, June 17, 2016 by sending an e-mail to rebecca_graham@nps.gov; however, any technical data received will be for the sole purpose of market research for future requirements. Under Simplified Acquisition Procedures, in accordance with Federal Acquisition Regulation (FAR) 13.106(b) Soliciting from a single source, NPS, Alaska Region, Acquisitions Office intends to issue a sole source, firm-fixed price order to: COMPANY: Southeast Alaska Petroleum Resource Organization Inc., (d.b.a. SEAPRO), 540 Water St. Ste. 201, Ketchikan, Alaska, 99901-6378 ON or AFTER: June 17, 2016; NAICS: 562910 Oil Spill Cleanup Services. Determinations not to compete this proposed procurement were made based on the following: There are currently five (5) U.S. Coast Guard classified OSROs in Southeast Alaska; however, only SEAPRO meets all qualifications required to support Glacier Bay National Park's facility and operations. According to representatives from both the response and the prevention departments of U.S. Coast Guard Sector Juneau, the Authority Having Jurisdiction (AHJ) for oil spill response resource requirements, only one of the classified OSRO within our response area is capable of meeting the requirements for timely response to the park's facilities: SEAPRO. In order to meet the requirements of OPA 90, FWPCA, and 33 CFR 154.1045, the National Park Service intends to award a sole source contract.
