- Justification for Other Than Full and Open Competition, Extension U.S. General Services Administration GSA Region 4 Leasing Division - Branch A JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION LEASE NUMBER: GS-04B-60306 PROJECT NUMBER: 4FL0376 DHS-CBP Air And Marine Facilities (AB 7074) 1.IDENTIFICATION AND DESCRIPTION OF ACTION BEING APPROVED. The General Services Administration currently leases 55,507 Rentable Square Feet (RSF) with a Common Area Factor 1.15, yielding 48,267 ANSI SOMA Office Area square feet (ABOA) at The Offices at the OMNI, 1501 Biscayne Blvd., Miami, FL 33132 under lease number GS-04B-LFL60306 for the CIS. The lease was awarded on November 05, 2015 and the current schedule has CIS occupying space on April 24, 2016. CBP is currently in 3,360 Rentable Square Feet (RSF) of space under lease GS-04B-LFL42861. That lease expires April 23, 2016. Approval is requested to expand the new CIS lease by 5,391 Rentable Square Feet (RSF) with the incumbent lessor without full and open competition for DHS-CBP. 2.DESCRIPTION OF THE SUPPLIES OR SERVICES REQUIRED. To satisfy the DHS-CBP mission requirements, the facility must be within a walkable distance of a boat slip. This requirement is for 5,391 RSF of space with a Common Area Factor 1.17 yielding 4,608 ANSI BOMA Office Area square feet (ABOA) and 15 surface parking spaces for a ten (10) year term to commence on April 24, 2016. The estimated annual cost of this expansion is $45.76 per RSF per year for an annual cost $246,692.16 and the new total contract value including the current SF is $31,502,456.40 incorporating expected rental adjustments over the term of the lease. The delineated area is North - North of S. Dixie Hwy., South - NW 7151 St., East - NW/SW 22"d Ave., West ­Atlantic Ocean, adjacent to or within very close proximity to intercostal waterway. 3.IDENTIFICATION OF STATUTORY AUTHORITY. 41 U.S.C. 3304(a)(1): Only one responsible source and no other supplies or services will satisfy agency requirements. 4.DEMONSTRATION THAT THE ACQUISITION REQUIRES THE USE OF THE AUTHORITY CITED. GSAM 570.403 states, if the expansion space needed is outside the general scope of the lease, the contracting officer must determine whether it is more prudent to provide the expansion space by supplemental agreement to the existing lease or to meet the expansion requirement and existing tenancy to the requirement by competitive means. Per the leasing desk guide chapter 6, this expansion request is considered outside the scope of the lease. 5.DESCRIPTION OF EFFORTS TO SOLICIT AS MANY OFFERS AS PRACTICAL. GSA was notified by the building owner of the existing location 77/99th SE 5th St., Miami, FL 33131 that the OHS-ICE lease will not be renewed and that the existing location is scheduled for demolition. Initially DHS-ICE and DHS-CBP were going to collocate with one another. The REXUS project number for this project was 4FL0276. Recent market research conducted by GSA in Miami, Florida, for comparable properties showed that the rental rate within the delineated area for those properties ranges from $15.00 - $43.69 per RSF. The cost quoted to the Government by the current Lessor, at the existing location, is $45.76 per RSF. The Contracting Officer determines that the anticipated cost to the Government of $45.76 per RSF for the entire requirement is fair and reasonable.
