- Synopsis: This is a notice of intent to sole source for commercial services prepared in accordance with FAR Part 8. It is the intent of the National Institutes of Health (NIH) Business System (NBS) to procure Panaya CloudQuality Suite License, maintenance and support on a sole source basis from Infosys, 800 King Farm Blvd., Suite 505, Rockville, MD 20850 under the authority of FAR 6.302-1(a) (2). The North American Industry Classification System Code (NAICS) is 541511- Custom Computer Programming Services. 1. Background Information The overall objective of the NIH Business System (NBS) Office is to facilitate the scientific mission of the National Institutes of Health and enable administrative and scientific support that is cost effective and provides accurate and timely information. The immediate scope of the NBS includes the implementation of business or "functional" areas to replace those currently included in the legacy administrative system within the new NIH Enterprise System. The Panaya Code Remediation Tool was used for the NBS technical upgrade from Oracle 11g - Oracle 12i. The tool provided the capability to automatically identify specific NBS customizations impacted by the Oracle 12i upgrade and obtain detailed data on what and how to fix the impacted customization. 2. Purpose and Objective The purpose of this requirement is to procure, from an authorized reseller, Panaya CloudQuality Suite license, maintenance and support services for the NBS. 3. Contractor Tasks The Contractor shall: • Provide Panaya license and annual maintenance and support services • Provide major product and technology releases • Provide updates, fixes, security alerts, data fixes, and critical patch updates during the contract term with immediate download passwords • Provide software license replacement for accidently damaged or malfunctioning hardware keys (Not including lost keys) • Certification (with most new) products • Provide Functional/Technical Support (via Platinum Support Service Plan. 24X7 access to Panaya's Support Portal and online case submission) • Technical Support via Metalink or via phone (access to protected support pages on the Panaya). Sole Source Justification: The Panaya "CloudQuality Suite" subscription will allow National Institute of Health to be fully aligned and current with Oracle EBS's maintenance strategy and business driven change strategy, by reducing the cost, improving time to market and significantly reducing the risks associated with any ERP change activity. The software maintenance and support services cannot be obtained from any other vendor and must be procured through Infosys to effectively continue operation of the CloudQuality Suite software. In accordance with Federal Acquisition Regulation (FAR) at 8.405-6(b), there is only one responsible source. Infosys was the only vendor to submit a Capability Statement to the Sources Sought Notice (SSN), as the CloudQuality Suite Software is proprietary to Infosys. Firms interested in responding to this notice must be able to provide the referenced software and service as specified above. Responses must be in writing and must be received electronically at the Government infrastructure by 4:00pm EST on Friday, June 17, 2016. Proposals must include pricing information and should reference Pre-Solicitation No. NIHLM2016117 and should be submitted electronically to Reginald Brown at reginald.brown@nih.gov.
