Description
JUSTIFICATION FOR SINGLE SOURCE AWARDS IAW FAR 13.106-1 (OVER MICRO-PURCHASE THRESHOLD($3K) BUT NOT EXCEEDING THE SAT ($150K)) IAW FAR13.104, COs must promote competition to the maximum extent practicable to obtain supplies and services from the source whose offer is the most advantageous to the Government, considering the administrative cost of the purchase. When competition is not practicable, IAW FAR13.106-1(b), COs solicit from a single source for purchases not exceeding the simplified acquisition threshold. COs may solicit from one source if the CO determines that the circumstances of the contract action deem only one source reasonably available (e.g., urgency, exclusive licensing agreements, brand-name or industrial mobilization). IAW FAR13.106-3(b)(3),COs are required to include additional statements explaining the absence of competition (see 13.106-1 for brand name purchases) if only one source is solicited and the acquisition does not exceed the simplified acquisition threshold (does not apply to an acquisition of utility services available from only one source) or supporting the award decision if other than price-related factors were considered in selecting the supplier. This template when completed can be used to document single source awards IAW FAR13.106-3(b)(3). Note: Statements such as "only known source" or "only source which can meet the required delivery date" are inadequate to support a sole source purchase. 1. PURCHASE REQUEST OR REQUISITION NUMBER: Emprint Procedure Planning Application1A. PROJECT/TASK NUMBER 541-36A-16-000121B. ESTIMATED AMOUNT: $34,990 2. BRIEF DESCRIPTION OF SUPPLIES OR SERVICES REQUIRED AND THE INTENDED USE: This activity proposes to solicit with Covidien Sales LLC a large business using sole source procurement procedures under NAICS Code 339112 for The Emprint Procedure Planning Application allows clinicians to use pre-procedural and intra-procedural patient CT image data to visualize and create a plan for lung or liver ablation procedures, as well as the ability to compare follow-up imaging. 3. UNIQUE CHARACTERISTICS THAT LIMIT AVAILABILITY TO ONLY ONE SOURCE, WITH THE REASON NO OTHER SUPPLIES OR SERVICES CAN BE USED: The Louis Stokes Cleveland Department of Veterans Affairs Healthcare System is requesting VISN 10 Contracting Activity to enter into sole source procurement with Covidien Sales LLC to complete the above stated services. The Cleveland VAMC recently (Oct 2015) purchased the Emprint Ablation system. This software will allows us to optimize the usage of the equipment. The Emprint Planning application is designed for use with the Emprint Ablation system with Thermosphere technology. This request is being entered as a sole source does to the proprietary nature of the equipment, and the urgency of the request in relation to safety and quality patient care. All repairs are to be completed with the use of OEM parts, tools materials, methods, and software. 4. REASON THAT SUGGESTED SOURCE IS THE ONLY SOURCE, WHICH CAN PROVIDE THE SUPPLIES OR SERVICES: None- Proprietary parts, tools, materials, and software as applicable-OEM Certified field service engineer. All maintenance inspections and repairs must be done with OEM parts, tools, materials, and software to meet specific capabilities and specifications of the above stated equipment. Third party vendors do not have access to OEM parts. Therefore other companies were not contacted for this proposed purchase order. According to our subject matter experts, this is the only company that has the latest technology available. The ablation machine and software is patented technology that will allows us to perform lung ablation's, decrease our current local recurrence rate and improve ablations zones which will optimize patient treatment and successful rate with only one treatment session. The new Emprint Platform has Thermosphere Technology, Thermosphere Technology is the only actively buffered energy platform on the market and this is a novel and highly patented design. 5. DESCRIPTION OF MARKET RESEARCH CONDUCTED AND RESULTS OR STATEMENT WHY IT WAS NOT CONDUCTED: FAR 6.302-2 does not require competition based on the agency's need for The Emprint Procedure Planning Application. Market research was conducted using the FSS Schedule, a search by our subject matter experts and an online search engine search. The resulting findings were that the Covidien Procedure Planning Application will best meet the needs of the organization. The new Emprint Platform has Thermosphere Technology, Thermosphere Technology is the only actively buffered energy platform on the market and this novel and highly patented design is what separates the Emprint with Thermosphere Technology platform from any other brands/equipment on the market. This technology is to give a large reproducible and highly predictable spherical ablation field across various environments and tissue types with only one type of antenna. For future procurements, the VA will survey the industry to find other suitable potential vendors that can provide the preventative maintenance for the Emprint Procedure Planning Application 6. Contracting Officer's Certification: Purchase is approved in accordance with FAR13.106-1(b).
