- On May 10, 2016, the Technology Acquisition Center awarded Delivery Order VA118-16-F-1023 under the terms and conditions of National Aeronautics and Space Administration (NASA) Solutions for Enterprise-Wide Procurement (SEWP) V contract NNG15SC76B with GMC Tek, LLC, 211 Church St. SE, Suite 115-A, Leesburg, VA 20175. GMC Tek will be providing TeleCare Record Manager Software licenses maintenance and support. The period of performance shall be from May 15, 2016 through March 31, 2017, the total order value of $353,994.23. ? JUSTIFICATION FOR AN EXCEPTION TO FAIR OPPORTUNITY 1. Contracting Activity:Department of Veterans Affairs (VA) Office of Acquisition Operations Technology Acquisition Center 23 Christopher Way Eatontown, NJ 07724 2. Description of Action: This proposed action is for the award of a brand name firm-fixed-price Delivery Order issued under the National Aeronautics and Space Administration (NASA) Solutions for Enterprise-Wide Procurement (SEWP) V Governmentwide Acquisition Contract (GWAC) for brand name Document Storage Systems, Inc. (DSS) Telecare Software Application and DSHI Veterans Health Gateway (VHG) software licenses and maintenance renewal. 3. Description of the Supplies or Services: The Michael E. DeBakey VA Medical Center (VAMC) and the call centers at 10 VAMCs within Veterans Integrated Service Network 16 has a requirement for brand name DSS TeleCare Record Manager (TRM) licenses and maintenance support. These licenses shall be utilized on the DSHI VHG, which is a server-side, medical expert system that provides nurses with clinical decision support when evaluating Veterans with active symptoms. The contractor shall also provide two days of on-site training for TRM and two days of on-site training of VHG Plus at the Jackson, Little Rock, and New Orleans VAMCs. Software training shall be provided to administrators and general users in a classroom setting with workstations. The period of performance shall be from date of award through March 30, 2017. 4. Statutory Authority: The statutory authority permitting this exception to fair opportunity is 41 U.S.C. 4106(c)(2) as implemented by the Federal Acquisition Regulation (FAR) 16.505(b)(2)(i)(B), entitled "Only one awardee is capable of providing the supplies or services required at the level of quality required because the supplies or services ordered are unique or highly specialized." 5. Rationale Supporting Use of Authority Cited Above: Based on market research, as described in section eight of this justification, it was determined that limited competition is available among authorized resellers for the required brand name DSS TRM software licenses and maintenance support. This brand name software enables the call centers to triage calls appropriately and document patient information and clinical calls. Due to proprietary software code, no other software product is interoperable or compatible with the current DSHI VHG system comprised completely of the DSS TRM solution. Procuring any other brand solution would require VA to either implement a second triage solution in addition to DSS TRM, which would add complexity, redundancy, inefficiency, and risk, or require VA to completely replace its current DSS TRM solution, the costs of which would not be recuperated through future competition. Additionally, no other brand software provider is capable of providing the required support and maintenance, as only DSS possesses the proprietary data necessary to maintain the current TRM software. No other vendor has the capability or data rights to provide the support required due to proprietary restrictions. Specifically, only DSS has the rights and technical ability to produce necessary patches and updates for the software. If the current DSS TRM software does not receive software patches and updates, software performance could degrade and fail to accurately analyze Veteran symptoms and medical history, which could create patient care delay. 6. Efforts to Obtain Competition: Market research was conducted, details of which are in section eight of this justification. This effort did not yield any additional sources that can meet the Government's requirements. It was determined that limited competition is viable among authorized resellers for the required brand software license, maintenance and support. In accordance with FAR 5.301 and 16.505(b)(2)(ii)(D), notice of award of this action will be synopsized and this justification will be made publicly available within 14 days of award on the Federal Business Opportunities Page. In accordance with FAR 16.505(a)(4)(iii)(A), this justification will be posted with the request for quotation on the NASA SEWP V GWAC website to notify all interested parties. 7. Actions to Increase Competition: The Government will continue to conduct market research to ascertain if there are changes in the marketplace that would enable future actions to be competed, such as new products that are capable of integrating with VA's current DSHI VHG system. To accomplish this, VA will continue to review industry publications, commercial directories, Government source lists, contacts with other potential or Governmental customers to identify sources known to them. 8. Market Research: Market research was conducted by VA personnel in March 2016 by reviewing other triaging solutions such as Pyramid Technology Services Inc. and Flexera Software. While these products have similar functionality, neither can integrate into VA's current infrastructure of solely DSS TRM licenses. Additionally, it was determined that none of these vendors can provide the necessary patches, updates, and support for VA's current DSS TRM software. While these other brands provide similar maintenance support, all are brand specific to its own proprietary software and is not compatible with other brands. Additional market research was conducted in March 2016 by utilizing the Provider Lookup tool to determine whether the brand name TRM software licenses and maintenance support is available from NASA SEWP V GWAC holders. It was determined that there are several resellers of the brand name TRM software licenses and maintenance support that hold current GWACs. Therefore, limited competition is expected among these GWAC holders. 9. Other Facts: None.
