Attachment 3 - FAR 52.212-5 Clause Attachment 2 - Instructions to Offerors Attachment 1 - Equipment Specifications This notice is a combined synopsis/solicitation for commercial items using Simplified Acquisition Procedures. This acquisition will be made in accordance with the format in Federal Acquisition Regulation (FAR) Subpart 12.6 "Streamlined Procedures for Evaluation and solicitation for commercial Items," as applicable, and as supplemented with additional information included in this notice. This announcement constitutes the only solicitation (a written solicitation will not be issued) and quotes are being requested. The Solicitation number is 2016-Q-65084 and the solicitation is issued as a Request for Quotes (RFQ). This acquisition will be processed under FAR Part 13 Simplified Acquisition Procedures (SAP). The solicitation documents and incorporated provisions and clauses are those in effect through Federal Acquisition Circular (FAC) 2005-87 April 6, 2016. NORTH AMERICAN INDUSTRY CLASSIFICATION SYSTEM (NAICS) CODE The intended procurement is classified under NAICS code 334516, Analytical Laboratory Instrument Manufacturing, with a small business size standard of 1,000 employees. The acquisition is competed full and open and the small business set aside had been dissolved. ACQUISITION AUTHORITY This acquisition is for a commercial item or service and is conducted under the authority of the Federal Acquisition Regulation (FAR) part 13-Simplified Acquisition Procedures and FAR part 12-Acquisition of Commercial Items, and is not expected to exceed the simplified acquisition threshold. The following FAR provisions and clauses apply to this acquisition: 1) 52.212-1 Instructions to Offerors - Commercial Items, 2) 52.212-2 Evaluations - Commercial Items, 3) 52.212-3 Offeror Representations and Certifications - Commercial Items, OFFERORS must submit a completed 52.212-3 Offeror Representations and Certifications-Commercial Items-with DUNS Number signed by an authorized representative of the offeror OR provide a copy of the valid offeror's Representations and Certifications from the System for Award Management (SAM) at www.sam.gov. 4) 52.212-4 Contract Terms and Conditions - Commercial Items, 5) 52.212-5 Contract Terms and Conditions Required to Implement Statutes Or Executive Orders - Commercial Items. (See Attachment 3) It is the responsibility of the Quoter to be familiar with the applicable FAR clauses and provisions. The clauses and provisions may be accessed in full text at this address: https://www.acquisition.gov/?q=/browse/far/52 EQUIPMENT SPECIFICATIONS See Attachment 1 for a complete technical description. WARRANTY REQUIREMENTS The contractor shall provide a minimum of a one (1) year warranty on all equipment, supplies, and repairs. All products shall be warranted to be free from material defects in workmanship or material under normal use and service for warranty period. DELIVERY REQUIREMENTS/PERIOD OF PERFORMANCE The contractor shall deliver the required equipment within six to ten months after receipt of order. Delivery must be FOB Destination. The equipment shall be delivered to the CDC Atlanta campus. CONTRACT TYPE The Government intends to issue a firm fixed price commercial items purchase order for this requirement. Invoicing shall be on a NET30 basis and payment shall be made via Electronic Funds Transfer (EFT). QUESTIONS Interested vendors may submit questions relating to this requirement. Questions shall be submitted to the Contract Specialist, Betty Vannoy, via email at bbv9@cdc.gov by or before May 17, 2016 at 1PM EST. Late questions shall not be accepted. No telephone calls. INSTRUCTIONS TO OFFERORS See Attachment 2 for a complete Instructions to Offerors, Response Format, and Evaluation Criteria See Attachment 3 for FAR 52.212-5, Contract Terms and Conditions Required To Implement Statutes or Executive Orders-Commercial Items. CLOSING INFORMATION By submission of an offer, the offeror acknowledges the requirement that a prospective awardee shall be registered in the System for Award Management (SAM) database prior to award resulting from this solicitation (www.sam.gov). Submission shall be received not later than May 31, 2016 at 5 PM EST. Offers may be e-mailed their quotes to Betty Vannoy at bbv9@cdc.gov. Late submissions shall be treated in accordance with the solicitation provision at FAR 52.212-1(f) All responsible sources may submit an offer that will be considered by this Agency.
