- DEPARTMENT OF VETERANS AFFAIRS Justification and Approval (J&A) For Other Than Full and Open Competition (>$150K) 1.Contracting Activity: Department of Veterans Affairs, VISN 04, Wilmington Medical Center, SAO East, Network Contracting Office 4 (NCO4) Transaction No. 460-16-2-139-0029. 2.Nature and/or Description of the Action Being Processed: The contractor Navix Diagnostix, Inc. (Navix) shall provide Vascular Ultrasound Technicians. Said technicians perform functions such as but not limited to Doppler ultrasound studies and will be required to meet the qualifications for their specialty and practice within the scope of their technical and professional discipline and standards. A short term bridge contract to replace current Navix contract VA244-P-1744 is requested; same contract is set to expire on March 31, 2016. This new contract will procure six additional months of services, from April 5, 2016 through October4, 2016. Total value of new contract is estimated to be approximately 96,000.00. 3.Description of Supplies/Services Required to Meet the Agency's Needs : Contractor shall provide a Vascular Ultrasound Technologist for daily coverage to the Wilmington VA Medical Center's (WVAMC) Surgical Service. Period of performance shall be for a period of 6 months, from April 5, 2016 to October4, 2016. Each provider must be a certified and experienced Vascular Ultrasound Technologist. The Vascular Ultrasound Technologist coordinates a variety of technical procedures that require independent judgment and initiative in the application of non-ionizing high frequency ultrasonic waves to humans for diagnosis of disease. Regular tour of duty shall be five days per week, 8:00 am - 4:30 pm each service day. During duty hours at the WVAMC, the Vascular Ultrasound Technologist shall be fully committed to Surgical Service and under the direction/supervision of the Chief of Radiology Service and Supervisor Diagnostic Radiologic Technician. The Vascular Ultrasound Technologist is expected to devote the time necessary to deliver the highest quality services to VA patients. The payment of any leave, including sick leave, holidays, or vacations, is the responsibility of the contractor. The Vascular Ultrasound Technologist shall provide services to VA patients, which includes tasks and other duties as assigned. 4.Statutory Authority Permitting Other than Full and Open Competition: ( ) (1) Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements per FAR 6.302-1; (X) (2) Unusual and Compelling Urgency per FAR 6.302-2; ( ) (3) Industrial Mobilization, Engineering, Developmental or Research Capability or Expert Services per FAR 6.302-3; ( ) (4) International Agreement per FAR 6.302-4 ( ) (5) Authorized or Required by Statute FAR 6.302-5; ( ) (6) National Security per FAR 6.302-6; ( ) (7) Public Interest per FAR 6.302-7; 5. Demonstration that the C ontr ac tor's Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority): By virtue of contract VA244-P-1744, Navix is the sole provider of Vascular Ultrasound Technicians to the WVAMC. In order for the provision of patient care that utilizes these services to continue, the current contractor must continue services without interruption. If the WVAMC were to be left without Vascular Ultrasound Technicians, the quality of patient care could be compromised and Veterans could be harmed. 6.Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable: Competitive procurement of Vascular Ultrasound Technician services under a long term contract is currently underway. Said services are available under the VA's FSS 621I schedule and Special Item Number (SIN) 621-050. New long term contract is anticipated to be awarded prior to September 30, 2016. 7.Determination by the Contracting Officer that the Anticipated Cost to the Government will be Fair and Reasonable: The anticipated contract is valued at a cost of $96,000.00. In accordance with the new contract, this cost is comprised of 128 days of services at a price of $750.00 per day (per diem). The price of $750.00 per day for these services can be determined to be fair and reasonable as it is accordance with contract VA244-P-1744, modification 0005 and has previously been determined fair and reasonable by a VA contracting Officer. Price can also be determined fair and reasonable as it is equal to the price per day that Navix offers to similarly situated customers such as the WVAMC in the Delaware Valley region. 8.Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted: While market research was not specifically conducted for the referenced contract; initial market research has been conducted in conjunction with the new long term procurement referenced in item 5 above. GSA Advantage was searched under SIN 621-050 with a specific referenced to Vascular Ultrasound; thus far, seven small business FSS contract holders have been identified that specifically offer Vascular Ultrasound Technicians. Based on this initial research adequate price competition is expected under the new procurement. 9.Any Other Facts Supporting the Use of Other than Full and Open Competition: N/A. 10.Listing of Sources that Expressed, in Writing, an Interest in the Acquisition: Written expressions of interest were not specifically sought for this justification and approval.
