Description
On April 29, 2016, the Technology Acquisition Center awarded Delivery Order VA118-16-F-1009 under the terms and conditions of National Aeronautics and Space Administration (NASA) Solutions for Enterprise-Wide Procurement (SEWP) V contract NNG15SC82B with New Tech Solutions (NTS), located at 4179 Business Center Drive, Fremont, CA 94538. NTS will be providing Enterprise Elements Software licenses and maintenance. The period of performance shall be from May 1, 2016 through April 30, 2017, the total order value of $184,000.45. ? JUSTIFICATION FOR AN EXCEPTION TO FAIR OPPORTUNITY 1. Contracting Activity:Department of Veterans Affairs (VA) Office of Acquisition Operations Technology Acquisition Center 23 Christopher Way Eatontown, NJ 07724 2. Description of Action: This proposed action is for the award of a brand name firm-fixed-price Task Order issued under the National Aeronautics and Space Administration (NASA) Solutions for Enterprise-Wide Procurement (SEWP) V Governmentwide Acquisition Contract (GWAC) for brand name Enterprise Elements new software licenses and maintenance support. 3. Description of Supplies or Services: VA Office of Information and Technology, Architecture Strategy and Design requires two brand name Enterprise Elements software licenses with maintenance support, as well as continued maintenance support on existing licenses in order to continue receiving version updates, security patches, and help desk support. This renewal of brand name Enterprise Elements software maintenance consists of Enterprise Elements Repository Core maintenance, Enterprise Elements Standard Concurrent User maintenance, and Enterprise Elements Enterprise Repository (Read Only) maintenance. The Enterprise Elements software facilitates the management and analysis of dynamic, highly interrelated data from various levels of the VA information technology enterprise architecture (EA). The period of performance shall be from date of award until April 30, 2017. 4. Statutory Authority: The statutory authority permitting this exception to fair opportunity is 41 U.S.C. 4106(c)(2) as implemented by the Federal Acquisition Regulation (FAR) 16.505(b)(2)(i)(B), entitled "Only one awardee is capable of providing the supplies or services required at the level of quality required because the supplies or services ordered are unique or highly specialized." 5. Rationale Supporting Use of Authority Cited Above: Based on market research, as described in section eight of this justification, it was determined that limited competition is available among authorized resellers for the required brand name Enterprise Elements Software licenses and maintenance support. Currently Enterprise Elements is the only relational database software which can extract information from VA's current EA Modeling tool, System Architect, using a module purposely designed to accomplish this task. This feature allows the EA program to integrate EA modeled data with other VA data. Enterprise Elements' ability to extract data from System Architect is unique to their software and no other software provider offers this ability. Additionally, no other software provider is capable of providing the required support and maintenance, as only Enterprise Elements possesses the proprietary data necessary to maintain the current software. Each software manufacturer provides support for its own proprietary software, therefore, due to the proprietary nature no alternate source provides the software patches and updates required. 6. Efforts to Obtain Competition: Market research was conducted, details of which are in section eight of this justification. This effort did not yield any additional sources that can meet the Government's requirements. It was determined that limited competition is viable among authorized resellers for the required brand software licenses and maintenance support. In accordance with FAR 5.301 and 16.505(b)(2)(ii)(D), notice of award of this action will be synopsized and this justification will be made publicly available within 14 days of award on the Federal Business Opportunities Page. In accordance with FAR 16.505(a)(4)(iii)(A), this justification will be posted with the request for quotation on the NASA SEWP V GWAC website to notify all interested parties. 7. Actions to Increase Competition: The Government will continue to conduct market research to ascertain if there are changes in the market place that would enable future actions to be competed. To support competition for contract support, the EA Program engages in regular evaluations of industry software to determine whether or not current tools can be replaced. 8. Market Research: April 2016 the Government's technical experts conducted web-based research on software solutions offered by IBM WebSphere and Oracle Apex. The market research confirmed that although IBM WebSphere and Oracle Apex could provide some of the required functionality, the required ability to extract data from the EA modeling tool, System Architect, is not offered by any other provider. Also, the required software maintenance is proprietary; therefore Enterprise Elements or its authorized resellers are the only sources capable of providing the required maintenance to include updates and fixes for Enterprise Elements Software. No other vendor, including those reviewed by the technical experts, has the capability of issuing software updates or fixes for Enterprise Elements Software necessary to support the existing VA requirement. Based on the above, only Enterprise Elements Software meets all of the Government's requirements. Additionally, In March 2016, a Request for Information (RFI) was released through the NASA SEWP V GWAC website using the RFI function to determine if any other sources could provide alternative software licenses or maintenance support. Three responses were received, all of which were from Enterprise Elements license resellers. All three quotes meet the Government's requirements. Therefore, limited competition is expected among these GWAC holders. 9. Other Facts: None
