DEPARTMENT OF VETERANS AFFAIRS Justification and Approval (J&A) For Other Than Full and Open Competition (>$150K) Acquisition Plan Action ID:_ VA244-16-AP-3868 1.Contracting Activity: Department of Veterans Affairs, VISN 04, (542) Coatesville VA Medical Center, Coatesville, Pennsylvania, 19320, Network Contracting Office 4; 542-16-2-048-0027 2.Nature and/or Description of the Action Being Processed: This is a short term sole source contract follow on to RII's tele radiology services contract VA244-12-C-0537. This extension will allow for more time to complete the HCR memo for the new contract and also allow for a longer solicitation period for the RFP and resulting efforts to evaluate and award a new contract as well as credential and privilege new physicians as needed. This is a fixed price contract. 3.Description of Supplies/Services Required to Meet the Agency's Needs: This is for the professional aspect of tele-radiology image reading and reports. It will also cover 40 hours of on-site radiologist coverage at the Coatesville VA Medical Center. The total value of the three month extension is $26,322.00. 4.Statutory Authority Permitting Other than Full and Open Competition:. ( X) (1) Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements per FAR 6.302-1; ( ) (2) Unusual and Compelling Urgency per FAR 6.302-2; ( ) (3) Industrial Mobilization, Engineering, Developmental or Research Capability or Expert Services per FAR 6.302-3; ( ) (4) International Agreement per FAR 6.302-4 ( ) (5) Authorized or Required by Statute FAR 6.302-5; ( ) (6) National Security per FAR 6.302-6; ( ) (7) Public Interest per FAR 6.302-7; 5.Demonstration that the Contractor's Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority): This contractor is currently providing tele -radiology and on-site radiologist coverage for the Coatesville VA Medical Center. The contractor is privileged at the Medical Center to provide the services, has access to the computer system, and has the power scribe transcription package to allow for report processing to the VistA system. This request is to provide sufficient time to develop a new contract, allow for sufficient time for full and open competition, and provide time for credentialing providers at CVAMC. Without this service, patient care would be affected negatively. 6.Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable: Competitive procurement will occur during this three month extension. Determination by the Contracting Officer that the Anticipated Cost to the Government will be Fair and Reasonable: Unit prices under the three month contract extension are as follows: Teleradiology Off-Site Services, Per Procedure "CT - $53.00 "General X-Ray - $15.00 "MRI - $75.50 "Ultrasound/Bone Densitometry - $32.00 "Vascular - $32.00 On-Site Services: $285.00 Per Hour Above prices are determined to be fair and reasonable based on them being equal to prices under option year II of contract VA244-12-C-0537 which were previously determined to be fair and reasonable by a Contracting Officer based upon adequate price competition. Total value of off-site per procedure services is $14,922.00. Total value of on-site hourly services is $11,400.00 (40 hours @ $285.00). 7.Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted: Market research has been conducted for the new contract being developed. Market research revealed that there is adequate price competition available from at least five (5) Service Disabled Veteran Owned Small Businesses (SDVOSB). SDVOSBs are as follows: "Critical Medical Solutions, Inc. "Excalibur Healthcare, PA "Radiology Imaging Institute, LTD "Valor Network, Inc. "Radiology Professional Management, Inc. 8.Any Other Facts Supporting the Use of Other than Full and Open Competition: This is a bridge request to cover the new contract solicitation, etc. Competition among SDVOSBs will occur. 9.Listing of Sources that Expressed, in Writing, an Interest in the Acquisition: None at this time. 10.A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers to Competition before Making subsequent acquisitions for the supplies or services required: As noted above, competition is planned among qualified SDVOSBs for the new contract.
