The purpose of this Sources Sought Notice is to search for contractors capable to provide Board Eligible/Board Certified Orthopedic Surgeon Services for the Memphis VA Medical Center located in Memphis, Tennessee. This Sources Sought Notice is for market research purposes only and shall not be considered an invitation for Bids, Request for Quotations, or a Request for Proposal. Do not submit a proposal or quote. This market research is issued for information and planning purposes only and does not constitute a solicitation nor does it restrict the Government as to the ultimate acquisition approach. In accordance with FAR 15.201(e), responses to this notice are not offers and cannot be accepted by the Government to form a binding contract. Additionally, there is no obligation on the part of the Government to acquire any products or services described in this sources sought. You will not be entitled to payment for direct or indirect costs that you incur in responding to this Sources Sought Notice. Any contract that might be awarded based on information received or derived from this market research will be the outcome of a competitive process. Interested parties are responsible for adequately marking proprietary, restricted, or completion sensitive information contained in their response. The Government does not intend to pay for the information submitted in response to this Source Sought Notice. POINT OF CONTACT: Sara Vickroy Sara.vickroy@va.gov Contracting Officer DRAFT Performance Work Statement for Onsite Orthopedic Physician Services at Memphis VA Medical Center 1. GENERAL: 1.1 Services Provided: The purpose of this PWS is to provide the VA Medical Center located in Memphis, Tennessee with the services required for a board eligible/certified orthopedic surgeon to provide orthopedic surgery care. It is preferred that the contract surgeon(s) have background and experience to supervise students and residents in orthopedic surgery and students in an ACGME (Accreditation Counsel for Graduate Medical Education) accredited Orthopedic Surgery program. A board eligible/certified orthopedic surgeon, certified by the Board of Orthopedic Surgeons, shall serve as attending surgeon on all orthopedic surgery operations with a level of supervision appropriate to the complexity of the case and the training level of the resident, if any, participating in the procedure. The scheduling and staffing will be considered and requested by the Chief, Surgical Service to the Department of Veterans Affairs Medical Center Memphis. In addition, the contract physician(s) must be present at the VA facility and must perform the required services as specified in the contract. The contract physician(s) shall be available to perform residual cases, specialized procedures or emergency or urgent specialized procedures, and provide follow-up to patients and new consults after normal working hours, weeknight, weekend, and holiday "on-call" services as needed. The contractor shall be responsible for providing replacement staff at all times to ensure complete coverage. Contract physician(s) will only be paid for services performed. The contract physician(s) shall not supervise any VA employees and will only perform authorized contract work at the VA Medical Center in strict accordance with the schedule of costs shown in the contract. Contract physician(s) will provide, as needed, professional direction and oversight to support personnel employed by the VAMC, Memphis, TN. Contract physician(s) will actively support the VAMC Memphis' efforts to purchase all orthopedic surgical supplies or implants from contracted vendors. Only when clinically indicated will such purchases be considered from non-contracted Vendors. Non contract requests must include documentation demonstrating why the contract appliance/implant, when available, is not clinically acceptable and each purchase request must be approved by the Chief of Staff or designee. Place of Performance - Memphis VA Medical Center (VAMC), 1030 Jefferson Avenue, Memphis, TN 38104 1.2. Authority: Title 38 USC 8153, Health Care Resources (HCR) sharing Authority. 1.3. Policy/Handbooks: 1.3.1. VA Directive 1663: Health Care Resources Contracting - Buying http://www1.va.gov/vapubs/viewPublication.asp?Pub_ID=347 2. QUALIFICATIONS: 2.1 Staff/Facility 2.1.1. License - Personnel assigned to perform the services covered by this contract shall have a current license to practice medicine in any State, Territory, or Commonwealth of the United States or the District of Columbia; shall be graduates from accredited medical colleges; be board certified or board eligible; have appointment that is commensurate with their assigned responsibilities and duties and be eligible to hold faculty appointments at the University of Tennessee. All licenses held by the personnel working on this contract shall be full and unrestricted licenses. Contract physician(s) who have current, full and unrestricted licenses in one or more states, but who have, or ever had, a license restricted, suspended, revoked, voluntarily revoked, voluntarily surrendered pending action or denied upon application will not be considered for the purposes of this contract. 2.1.2. Board Certification - All contract physician(s) shall be board eligible/certified by the American Board of Orthopedic Surgery http://www.abos.org/, and be currently certified in Basic Life Support (BLS) and Advanced Cardiac Life Support (ACLS). All continuing education courses required for maintaining certification must be kept up to date at all times. Documentation verifying current certification shall be provided by the contract physician to the VA COR on an annual basis for each year of contract performance. 2.1.3 Credentialing and Privileging - Credentialing and privileging is to be done in accordance with the provisions of VHA Handbook 1100.19 dated October 15, 2012, found at the web address below: http://www.va.gov/vhapublications/ViewPublication.asp?pub_ID=2910. Contractor shall ensure that all contract physician(s) employed under this contract participate in the Credentialing and Privileging process as described in Medical Center Memorandum no. 11-21- Credentialing and Privileging Process, which may be accessed at the following URL: http://vaww.memphis.va.gov/docs/memo.aspx (See Attachment 3) The contract physician(s) is responsible to ensure that they possess the requisite credentials enabling the granting of privileges. A copy of license must be provided with the offer and will be updated upon expiration and renewal. Any changes related to the provider's licensing or credentials will be reported immediately to the VAMC, Memphis, TN. Specific questions regarding Credentialing and Privileging should be directed to the office of Quality Management & Improvement VA Medical Center, Memphis, TN. No services shall be provided by any contract physician(s) prior to obtaining approval by the Memphis VAMC Professional Standards Board, Medical Executive Board and Medical Center Director. 2.1.3.1.If a contract physician(s) is not credentialed and privileged or has credentials/privileges suspended or revoked, the contractor shall furnish an acceptable substitute without any additional cost to the Government. 2.1.3.2Privileges will be renewed at least every two (2) years in accordance with Medical Center and The Joint Commission requirements if there is a contract with option years; however, if no option years, privileges will be renewed annually. Contract physician(s) shall meet all duties of medical staff as delineated by Medical Staff Bylaws. Contract physician(s) assigned to work at the Medical Center shall be required to report specific patient outcome information, such as complications, to the Service Chief. Quality Improvement data provided by the contract physician(s) and/or collected by the service will be used to analyze individual practice patterns. The Service Chief will utilize the data to formulate recommendations for the Clinical Executive Board to consider in the renewal of clinical privileges. 2.1.3.3. Request for privileges and completed credential packets shall be submitted sixty (60) days prior to the contract physician(s) scheduled start date. Application package will be provided by the VA Memphis to be completed by the candidate. This includes: Curriculum vitae, current references, signed release of information from candidate, and statement that candidate does not have any physical or mental health condition that would adversely affect his/her ability to carry out assigned duties, and additional credentialing and privileging forms. Candidate will also be required to make application through the VET-PRO Internet process. VetPro is an Internet enabled system for the credentialing of VHA health care providers that facilitates completion of a uniform, accurate and complete credentials file. VetPro improves efficiency by allowing providers to enter essential credentialing data only once. Providers must be enrolled in VetPro and credentialed using the VetPro process. Candidate will need to be enrolled in VET-PRO by our Credentialing and Privileging Coordinator at the Memphis VA. The website address ishttp://fcp.vetpro.org/. The contract physician(s), hereafter referred to as Provider, Credentialing and Privileging will only be effective as long as the contract is effective. In addition, if the contract is not renewed, extended/modified, the provider should not see patients beyond the contract date; however will be allowed 30 days beyond the contract date to complete all administrative requirements. 2.1.4.Technical Proficiency: Contract physician(s) shall be technically proficient in the skills necessary to fulfill the government's requirements, including the ability to speak, understand, read and write English fluently. Contract physician(s) shall provide documents upon request of the CO/COR to verify current and ongoing competency, skills, certification and/or licensure related to the provision of care, treatment and/or services performed. Contract physician(s) shall provide verifiable evidence of all educational and training experiences including any gaps in educational history and shall be responsible for abiding by the Facility's Medical Staff By-Laws, rules, and regulations (referenced herein) that govern medical staff behavior. 2.1.5.Continuing Medical Education (CME)/ Certified Education Unit (CEU) Requirements: Contract physician(s) shall provide the COR copies of current CMEs as required or requested by the VAMC. Contract physician(s) registered or certified by national/medical associations shall continue to meet the minimum standards for CME to remain current. Contract physician(s) shall report CME hours to the credentials office for tracking. These documents are required for both privileging and re-privileging. Failure to provide shall result in loss of privileges for contract physician(s). 2.1.6.Training (ACLS, BLS, CPRS, and VA MANDATORY): Contract physician(s) shall meet all VA educational requirements and mandatory course requirements defined herein; all training must be completed by the contract physician(s) as required by the VA. This training is a web based course which may be accessed on the Talent Management System (TMS) https://www.tms.va.gov/plateau/user/login.jsp. A copy of the training certificate must be forwarded to the Surgical Service COR who will in turn forward to VA Information Security Officers and Privacy Officer. This is an annual mandatory requirement for all employees. Successfully complete any additional privacy training, as required for VA personnel with equivalent information system access [to be defined by the VA program official and provided to the contracting officer for inclusion in the solicitation document - e.g., any role-based information security training required in accordance with NIST Special Publication 800-16, Information Technology Security Training Requirements.] The contractor shall provide to the contracting officer a copy of the training certificates for each applicable employee within 1 week of the initiation of the contract and annually thereafter, as required. These online courses are located at the following web site: https://www.tms.va.gov/plateau/user/login.jsp Failure to complete this mandatory training within the timeframe required will be grounds for suspension or termination of all physical and/or electronic access privileges and removal from work on the contract until such time as the training is completed. The non-VA employee may self-register on this site to access these courses. You will need to register and create your own Username and Password to this site. When you have completed your course on this alternate site, you will need to print certificates of completion and provide a copy to your VA point of contact as proof of completion. 2.1.7.Standard Personnel Testing (PPD, etc.): Contractor shall provide proof of the following tests for contract physician(s) within five (5) calendar days after contract award and prior to the first duty shift to the COR and Contracting Officer. Tests shall be current within the past year. 2.1.7.1.TUBERCULOSIS TESTING: Contract physician(s) shall provide proof of a negative reaction to PPD testing for all contract physician(s). A negative chest radiographic report for active tuberculosis shall be provided in cases of positive PPD results. The PPD test shall be repeated annually. 2.1.7.2.RUBELLA TESTING: Contract physician(s) shall provide proof of immunization for all contract physician(s) for measles, mumps, rubella or a rubella titer of 1.8 or greater. If the titer is less than 1.8, a rubella immunization shall be administered with follow-up documentation to the COR. 2.1.7.3 OSHA REGULATION CONCERNING OCCUPATIONAL EXPOSURE TO BLOODBORNE PATHOGENS: Contractor shall provide generic self-study training for all contract physician(s); provide their own Hepatitis B vaccination series at no cost to the VA if they elect to receive it; maintain an exposure determination and control plan; maintain required records; and ensure that proper follow-up evaluation is provided following an exposure incident. The VAMC shall notify the contract physician(s) of any significant communicable disease exposures as appropriate. Contract physician(s) shall adhere to current CDC/HICPAC Guideline for Infection Control in health care personnel (as published in American Journal for Infection Control-AJIC 1998; 26:289-354 http://www.cdc.gov/hicpac/pdf/InfectControl98.pdf) for disease control. Contract physician(s) shall provide follow up documentation of clearance to return to the workplace prior to their return. 2.1.8. National Provider Identifier (NPI): NPI is a standard, unique 10-digit numeric identifier required by HIPAA. The Veterans Health Administration must use NPIs in all HIPAA-standard electronic transactions for individual (health care practitioners) and organizational entities (medical centers). The contract physician(s) shall have or obtain appropriate NPI and if pertinent the Taxonomy Code confirmation notice issued by the Centers for Medicare and Medicaid Services (CMS) National Plan and Provider Enumeration System (NPPES) be provided to the Contracting Officer with the proposal. 2.1.9.DEA (as required): Contract physician(s) shall provide copy of current DEA certificate in Tennessee where services will be provided under this contract. 2.1.10. Conflict of Interest: The contractor is responsible for identifying and communicating to the CO and COR conflicts of interest at the time of proposal and during the entirety of contract performance. At the time of proposal, the contract physician(s) shall provide a statement which describes, in a concise manner, all relevant facts concerning any past, present, or currently planned interest (financial, contractual, organizational, or otherwise) or actual or potential organizational conflicts of interest relating to the services to be provided. The contract physician(s) shall also provide statements containing the same information for any identified consultants or subcontractors who shall provide services. The contractor must also provide relevant facts that show how it's organizational and/or management system or other actions would avoid or mitigate any actual or potential organizational conflicts of interest. These statements shall be in response to the VAAR provision 852.209-70 Organizational Conflicts of Interest (Jan 2008) and fully outlined in response to the Attachment 4 in Section D of the solicitation document. Reference VA Handbook 1600.03 https://www1.va.gov/vhapublications/ViewPublication.asp?pub_ID=1770 2.1.11.Citizenship related Requirements: 2.1.11.1.The contractor certifies that they shall comply with any and all legal provisions contained in the Immigration and Nationality Act of 1952, As Amended; its related laws and regulations that are enforced by Homeland Security, Immigration and Customs Enforcement and the U.S Department of Labor as these may relate to non-immigrant foreign nationals working under contract while providing services to Department of Veterans Affairs patient referrals; such proof should be provided at time of proposal. 2.1.11.2.While performing services for the Department of Veterans Affairs, the contractor shall not knowingly employ, contract or subcontract with an illegal alien; foreign national non-immigrant who is in violation their status, as a result of their failure to maintain or comply with the terms and conditions of their admission into the United States. Additionally, the contract physician(s) is required to comply with all "E-Verify" requirements consistent with "Executive Order 12989" and any related pertinent Amendments, as well as applicable Federal Acquisition Regulations. 2.1.11.3.If the contractor fails to comply with any requirements outlined in the preceding paragraphs or its Agency regulations, the Department of Veterans Affairs may, at its discretion, require that the foreign national who failed to maintain their legal status in the United States or otherwise failed to comply with the requirements of the laws administered by Homeland Security, Immigration and Customs Enforcement and the U.S Department of Labor, shall be prohibited from working at the contract physician(s) place of business that services Department of Veterans Affairs patient referrals; or other place where the contractor provides services to veterans who have been referred by the Department of Veterans Affairs; and shall form the basis for termination of this contract for breach. 2.1.11.4.This certification concerns a matter within the jurisdiction of an agency of the United States and the making of a false, fictitious, or fraudulent certification may render the maker subject to prosecution under 18 U.S.C. 1001. 2.1.11.5.The contractor agrees to obtain a similar certification from its subcontractors. The certification shall be made as part of the offerors response to the RFP using Attachment 5 Contractor Certification Immigration and Nationality Act in Section D of the solicitation document. 2.1.12. Annual Office of Inspector General (OIG) Statement: In accordance with HIPAA and the Balanced Budget Act (BBA) of 1977, the Department of Health and Human Services (HHS) Office of Inspector General (OIG) has established a list of parties and entities excluded from Federal health care programs. Specifically, the listed parties and entities may not receive Federal Health Care program payments due to fraud and/or abuse of the Medicare and Medicaid programs. 2.1.12.1.Therefore, contractor shall review the HHS OIG List of Excluded Individuals/Entities on the HHS OIG web site at http://oig.hhs.gov/exclusions/index.asp to ensure that the proposed contract physician (s) are not listed, and are required to certify in its proposal that all persons listed in the contractor's proposal have been compared against the OIG list and are NOT listed. Contractor should note that any excluded individual or entity that submits a claim for reimbursement to a Federal health care program, or causes such a claim to be submitted, may be subject to a Civil Monetary Penalty (CMP) for each item or service furnished during a period that the person was excluded and may also be subject to treble damages for the amount claimed for each item or service. CMP's may also be imposed against the contractor that employs or enter into contracts with excluded individuals to provide items or services to Federal program beneficiaries. 2.1.12.2.By submitting their proposal, the contract physician(s) certifies that the HHS OIG List of Excluded Individuals/Entities has been reviewed and that the contract physician(s) are and/or firm is not listed as of the date the offer/bid was signed. 2.2. Clinical/Professional Direction: The qualifications of contract physician(s) are subject to review by VA Medical Center COS or his/her clinical designee and approval by the Medical Center Director as provided in VHA Handbook 1100.19. Clinical/Professional direction of all clinical personnel covered by this contract for quality purposes will be provided by the VAMC COS and/or the Chief of the Service or his designee. A clinical COR may be appointed, however, only the CO is authorized to consider any contract resultant contract. 2.3. Non Personal Healthcare Services: The parties agree that the contract physician(s) and all contract physician(s) shall not be considered VA employees for any purpose. 2.4. Inherent Government Functions: Contract physician(s) shall not perform inherently governmental functions. This includes, but is not limited to, determination of agency policy, determination of Federal program priorities for budget requests, direction and control of government employees (outside a clinical context), selection or non-selection of individuals for Federal Government employment including the interviewing of individuals for employment, approval of position descriptions and performance standards for Federal employees, approving any contractual documents, approval of Federal licensing actions and inspections, and/or determination of budget policy, guidance, and strategy. 2.5 No Employee status: Contract physician(s) shall be responsible for protecting Contract physician (s) furnishing services. To carry out this responsibility, the Contract physician(s) shall provide or certify that the following is provided for all their staff providing services under the resultant contract: 2.5.1. Workers' compensation 2.5.2. Professional liability insurance 2.5.3. Health examinations 2.5.4. Income tax withholding, and 2.5.5. Social security payments. 2.6.Tort Liability: The Federal Tort Claims Act does not cover the contract physician(s). When a contract physician(s) has been identified as a provider in a tort claim, the contract physician(s) shall be responsible for notifying contractor's legal counsel and/or insurance carrier. Any settlement or judgment arising from a contract physician(s) action or non-action shall be the responsibility of the contractor(s) and/or insurance carrier. 2.7.Key Personnel: 2.7.1. The VA Full Time Equivalency (FTE) for the services required is 1.3 FTE. FTE is defined by VA as a minimum of 80 hours every two weeks and does not include holidays. 2.7.2. The number of Board Eligible/ Board Certified Orthopedic physicians required to be on-site on a daily basis is 1.3 FTE as defined in paragraph Hours of Operation in this section. 2.7.3. The contractor shall assign to this contract the following key personnel: Orthopedic Surgeons The contractor shall provide a complete list of all contract physician(s) that will be assigned to this contract at the time of award. This shall include a sufficient number of contract physician(s), so that there is coverage at all times. Provide the name of each contract physician(s) and the number of hours worked weekly by each contract physician(s) identified to work under this contract. This information may be provided in a table format as shown below: Name____________________ Hours__________________ NPI#__________________ Name____________________Hours__________________ NPI#__________________ Name___________________Hours__________________ NPI#__________________ Name____________________Hours__________________ NPI#__________________ 2.7.4 The contractor shall be responsible for providing coverage to the VA during periods of vacancies of the contract physician(s) due to sick leave, personal leave, vacations and additional coverage as required. If the contractor is unable to schedule a contract physician(s) at any time, it must be brought to the attention of the COR immediately. The contractor is to have a provider at the VA on the designated days requested Monday through Friday. In the event a scheduled contract physician(s) is unable to complete an assigned shift, the contractor shall provide replacement contract physician coverage within 2 hours and notify the Contracting Office Representative (COR) at the Memphis VA Medical Center immediately of the schedule change. If no replacement contract physician coverage is provided, the contract price will be decreased accordingly during each billing cycle. 2.8 Emergency Substitutions: During the first ninety (90) days of performance, the contractor shall make NO substitutions of key personnel unless the substitution is necessitated by illness, death, or termination of employment. The contractor shall notify the Contracting Officer, in writing immediately after the occurrence of any of these events and provide the information required by paragraph (c) below. After the initial 90-day period of the contract, the contractor shall submit the information required by paragraph (c) to the Contracting Officer for approval by the VA at least 15 days prior to making any permanent substitutions. No substitutions will be made at any time without prior approval of the COR and/or Contracting Officer. All contractor personnel must have had the appropriate background investigation before access to patient information will be permitted. 2.8.1. The contractor shall provide a detailed explanation of the circumstancesnecessitating the proposed substitutions, complete resumes for the proposedsubstitutes, and any additional information requested by the Contracting Officer. Proposed substitutes shall have comparable qualifications to those of the persons being replaced. The Contracting Officer will notify the contractor within 15 calendar days after receipt of all required information of the decision on the proposed substitutes. The contract will be modified to reflect any approved changes of key personnel. 2.8.2. For temporary substitutions where the key person shall not be reporting to work for three (3) consecutive work days or more, the contractor shall provide a qualified replacement for the key person. The substitute shall have comparable qualifications to the key person. Any period exceeding two weeks will require the procedure as stated above 2.8.3. The Government reserves the right to refuse acceptance of any contract physician(s) at any time after performance begins, if personal or professional conduct jeopardizes patient care or interferes with the regular and ordinary operation of the facility. Breaches of conduct include intoxication or debilitation resulting from drug use, theft, patient abuse, dereliction or negligence in performing directed tasks, or other conduct resulting in formal complaints by patient or other staff members to designated Government representatives. Standards for conduct shall mirror those prescribed by current federal personnel regulations. Should the VA COS or designee show documented clinical problems or continual unprofessional behavior/actions with any contract physician (s), s/he may request, without cause, immediate replacement of said contract physician (s). 2.8.4. The Contracting Officer and COR shall deal with issues raised concerning contract physician (s) conduct. The final arbiter on questions of acceptability is the Contracting Officer. 2.8.5. Contractor shall assign the same orthopedic surgeon or alternate orthopedic surgeon from a select group that has the Contracting Officer's Technical Representative's official approval. 2.8.6At the time of contract award, the contractor shall provide a complete list of the National Provider ID (NPI) numbers for all physicians identified as Key Personnel and are to be assigned to this contract. This ten (10) digit number may be located at the following website: https://nppes.cms.hhs.gov/NPPES/NPIRegistryHome.do 2.9 Contingency Plan: Because continuity of care is an essential part of VAMC's medical services, the contractor shall have a contingency plan in place to be utilized if the contract physician (s) leaves contractor's employment or is unable to continue performance in accordance with the terms and conditions of the resulting contract. The contractor shall also have a written contingency plan for computer downtime that defines the processes in order to ensure continuity of patient care and maintenance of the integrity of the patient's medical record during periods of loss of computer functions. The contingency plan must be reviewed and approved by the parent VAMC Director, Information Management prior to award. 2.10 Prohibition Against Self-Referral: Contract physician(s) are prohibited from referring VA patients to their own practice(s). 3. VA HOURS OF OPERATION/SCHEDULING: 3.1 VA Business Hours: Contract physician(s) must be present at the VA facility and must be actually performing the required services for the period specified within the contract or the contract cost will be decreased accordingly, during each billing cycle. Need to meet timelines standards for the clinic appointments, e.g. if they are on holiday, need to have "make up clinics." The contractor is responsible for planning and coverage during period of leave. This payment for any leave, to include sick leave, annual leave, administrative leave, and holidays are to be the responsibility of the contract physician(s) and must be brought to the attention of the COR immediately. (1) Regular Hours: Scheduled Office Hours are Monday through Friday, between 7:30 a.m. to 4:00 p.m. central time. (a) Operating Room: Monday through Friday, between 7:30 a.m. to 4:00 p.m. central time (b) Attending Duties: Hours are flexible depending on the needs of the patients (2) After hours are 4:00 p.m. through 7:30 a.m., Monday through Friday central time. (a) Weeknights Monday through Friday 4:00 p.m through 7:30 a.m. central time. (b) Weekends Friday 4:00 p.m. through 7:30 a.m. Monday central time. (3) Weekend hours are 4:00 p.m. Friday though 7:30 a.m. Monday central time. Patients must be seen by a contract physician(s) on-site at Memphis VA Medical Center in a timely manner in accordance with VA Rules and Regulations on clinic wait times and consult completion. Outpatient clinic appointments must be scheduled for patients to be seen by provider within 30 days. The VA will schedule patients as services are provided at the VA. Contractor shall notify the COR at least monthly about any obstacles to meeting this performance measure. 3.1.2. Contract physician(s) shall be available and present in clinic during regularMemphis VA Medical Center clinic hours, which may be revised, as deemed appropriate for patient care by the Chief of Staff. Currently, regular clinic hours are Monday through Friday, between 7:30 a.m. to 4:00 p.m. central time. On-call hours will have physicians responding outside of "Regular work hours" to evaluate and treat patients. Weeknight on-call hours are Monday through Friday 4:00 p.m. through 7:30 a.m. central time. Weekend on-call hours are Friday 4:00 p.m. through 7:30 a.m. Monday central time. 3.1.3 Off-hours Coverage: Contractor must make the contract physician(s) available on-call during all hours when the Memphis VA Medical Center clinic is closed, including evenings, weekends and holidays. 3.1.3.1.On-call contract physician(s) must be available at all times for phone consultations with VA residents and physicians. 3.1.2.2.Patients must be contacted within 15 mins by phone and seen within 1 hour if medically necessary. 3.2 Federal Holidays: The following holidays are observed by the Department of Veteran Affairs: "New Year's Day "President's Day "Martin Luther King's Birthday "Memorial Day "Independence Day "Labor Day "Columbus Day "Veterans Day "Thanksgiving "Christmas "Any day specifically declared by the President of the United States to be a national holiday. It should be noted that if a holiday falls on Saturday, it is observed on Friday. If a holiday falls on Sunday, it is observed on Monday. 3.3. Cancellations: Unless a state of emergency has been declared, the contract physician(s) shall be responsible for providing services. 3.4. Timeliness: Timeliness is an essential component of this contract and the Contractor must adhere to established timeframes for the provision of service for work completed in the Operating Room Suite, wards and/or units and/or Emergency Department. Contractor shall be available 24/7 via telephone for consultation services when requested 100% of the time. Response is required within 15 minutes of a call for services. The on-call Contract physician is not required to remain at place of residence while on-call, but must be available by pager/cell phone during this time. He/she is required to respond telephonically within 15 minutes of receiving the call and must be in-house within 30 minutes of the original page or telephone call to provide orthopedic services and/or assistance at the VAMC, whether in the OR Suite, on the floor/unit or Emergency Department. As required, the Contract Attending(s) will present to care for the Veteran patient.
