- DEPARTMENT OF JUSTICE FEDERAL BUREAU OF INVESTIGATION THIS IS NOT A REQUEST FOR QUOTATION OR PROPOSAL JUSTIFICATION AND APPROVAL FOR OTHER THAN FULL AND OPEN COMPETITION 1. Identification of the Agency and Contracting Activity. The U.S. Department of Justice, Federal Bureau of Investigation (FBI), Facilities Logistics and Services Division (FLSD) at the FBI Academy in Quantico, Virginia has prepared this justification for other than full and open completion. This document constitutes the justification and approval for other than full and open competition for the acquisition described herein, under the authority of FAR 6.302-1 - "Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements." Estimated value - between $100,000 and $150,000. 2. Nature and description of action being approved. This is a sole source award of a firm-fixed price to provide a contract with the original Architect and Engineering firm of Record, Page Southerland Page (herein after, PAGE) of Washington, DC to perform construction administration (CA) services for the full construction project duration ( est. 370 days) of this exterior renovation project. 3. Description of supplies or services required to meet the Agency's needs. The FBI Academy is currently planning for the exterior renovation for the Jefferson Building at the FBI Quantico Complex. This exterior renovation project was awarded by the FBI Facilities Contracts Unit (FCU) and commencement is imminent. The initial design phase of this exterior renovation work was completed by the Architectural and Engineering Firm of Page Southerland Page several years ago. As a result, the FBI Planning and Design Unit (PDU) requires technical Construction Administration services in order to respond to technical submittals, RFIs and other project related technical inspection requirements (to include field site visits) from the A-E firm of record regarding the renovation and improvements of the work at this building. 4. Identification of statutory authority permitting other than full and open competition. a. 6.302-1 -- Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements. b. Citations: 10 U.S.C. 2304(c)(1) or 41 U.S.C. 3304(a)(1). 5. Demonstrate that the nature of the acquisition requires use of the authority cited. As the A-E/Designer of Record, PAGE is intimately familiar with their design which includes different aspects of the work including technical drawing details and specifications, nuances of the FBI requirements, site conditions and a history of the property. If the FBI were required to go to a different A-E firm for CA Services support, the Bureau would incur significant additional costs in order to bring the new A-E "up to speed" on the design aspects of the work. There would also be a potentially dangerous condition created if a new firm overlooked certain details of the project that PAGE would have been aware of through its historical knowledge. Since different designers may have different ways to solve technical problems, it is also possible that there could be conflicts between the technical solutions provided by PAGE in their design and the viewpoint of a new A-E and their masonry consultant. 6. Description of efforts made to ensure that offers are solicited from as many potential sources as is practicable, including whether a Federal Business Opportunities notice was or will be publicized as required by Subpart 5.2, and if not which exception under 5.202 applies. In accordance with FAR 5.202 (a)(12) a synopsis was not required. 7. Determination by the contracting officer that the anticipated cost to the government for the proposed acquisitions will be fair and reasonable. An independent government estimate has been prepared and will be compared to the contractor's proposal. The FBI will negotiate with PAGE to establish Fair and Reasonable rates for this project. 8. Description of market survey conducted and the results or a statement of the reasons that a market survey was not conducted. No market research was done specifically for these A-E services due to the specifics of this requirement and subsequent time constraints to secure this procurement. 9. Any other facts supporting the use of other than full and open competition. Construction on this project is imminent. This request is an urgent need. 10. A listing of the sources, if any, that expressed, in writing, an interest in the procurement. None. 11. A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisition for the supplies or services required. The FBI will remain vigilant to this matter and this type of requirement and work to establish processes that will help us avoid the need for J&A's of this nature in the future. 12. Statement of delivery requirements. Sole Source award of a firm fixed price contract.
