- INTRODUCTION This is a pre-solicitation non-competitive (notice of intent) synopsis to award a contract without providing for full or open competition (including brand-name). THIS IS A NOTICE OF INTENT, NOT A REQUEST FOR PROPOSAL. A SOLICITATION WILL NOT BE ISSUED AND PROPOSALS WILL NOT BE REQUESTED. The National Institute on Drug Abuse (NIDA), Consolidated Station Support and Simplified Acquisitions (CSS/SA) Branch intends to negotiate and award a purchase order to, Cryo Associates for storage and preservation of transgenic animals for neuroscience research without providing for full and open competition (including brand-name). NORTH AMERICAN INDUSTRY CLASSIFICATION SYSTEM (NAICS) CODE The intended procurement is classified under NAICS code 332420 with a Size Standard of 50 Employees. REGULATORY AUTHORITY The resultant contract will include all applicable provisions and clauses in effect through the Federal Acquisition Circular (FAC) 2005-87 dated March 7, 2016. This acquisition is for a commercial item or service and is conducted under the procedures as prescribed in FAR subpart 13-Simplified Acquisition Procedures. This acquisition is NOT expected to exceed the simplified acquisition threshold STATUTORY AUTHORITY This acquisition is conducted under the authority of the authority of FAR Subpart 13.106.1.b-1 DESCRIPTION OF REQUIREMENT Purpose and Objectives The National Institute of Mental Health requires sotraage and preservation of transgenic animals for neuroscience research. Preserving valuable transgenic organisms by cryopreservation is a core mission of the NIMH Transgenic Facility. For the last five years commercial biorepositories have been used to provide off-campus storage for these resources. Samples will be stored at these sites as long as the mandate to preserve these lines continues. Project Requirements The contractor shall provide all resources necessary to accomplish the tasks and deliverables described below. The contractor shall provide a secure location with a continuous supply of liquid nitrogen and a efficient monitor system to prevent any interruption of supply or rise in temperature in the liquid nitrogen tanks containing transgenic embryos or germ cells. In general, the vendor will provide continuous supply of liquid nitrogen, continuous monitoring of temperature and level of liquid nitrogen in the supplied tank. Access to these tanks shall be granted after a reasonable advanced notice. Specifically, the vendor will: Accommodate three NIMH-owned MVE XLC 810 HE Tanks, with an option to increase the number of tanks to 5 by the life of the contract 24 hours Point-of-Contact for tank (sample) access Free access during normal business hours Supply about 122 Liters of LN2/week Automatic fill of LN2 Automatic measurement with alarm and notification on LN2 level and temperature Regular manual measurement of LN2 level and temperature Backup LN2 supply Backup power supply (e.g., generator) Delivery time One base year with three subsequent option year periods. CONTRACTING WITHOUT PROVIDING FOR FULL OR OPEN COMPETITION (INCLUDING BRAND-NAME) DETERMINATION The determination by the Government to award a contract without providing for full and open competition is based upon the market research conducted. Specifically, Cyro is the only contractor in the NIH main campus vicinity that may provide the requested. Additional transferring of the samples can pose risk to the intergiruty of the samples and ultimately the continuity of science. Maintaining transgenic animal strains is more and more expensive each year. The number of these strains is also increasing as more innovative mechanism for manipulating gene are developed. As a consequence many laboratories at NIH use transgenic animals in their research projects. The NIMH Transgenic core facility is tasked with cryopreserving these lines as a cheaper alternative to keeping them in animal holding facilities in numbers that will guarantee their survival. The intended source is: Cryo Associates 7905 Airpark Road Gaithersbur MD 20879 CLOSING STATEMENT THIS SYNOPSIS IS NOT A REQUEST FOR COMPETITIVE PROPOSALS. However, interested parties may identify their interest and capability to respond to this notice. Responses to this notice shall contain sufficient information to establish the interested parties’ bona-fide capabilities for fulfilling the requirement and include: unit price, list price, shipping and handling costs, the delivery period after contract award, the prompt payment discount terms, the F.O.B. Point (Destination or Origin), the Dun & Bradstreet Number (DUNS), the Taxpayer Identification Number (TIN), and the certification of business size. All offerors must have an active registration in the System for Award Management (SAM) www.sam.gov.” A determination by the Government not to compete this proposed contract based upon responses to this notice is solely within the discretion of the Government. The information received will normally be considered solely for the purposes of determining whether to proceed on a non-competitive basis or to conduct a competitive procurement. All responses must be received by the closing date and time of this announcement and must reference the solicitation number.
