- The National Institute of Standards and Technology (NIST) intends to negotiate on a sole source basis, under the authority of FAR 13.106-1(b) (1), with Wyatt Technology, located at 6300 Hollister Avenue, Santa Barbara, CA 93117 to provide one (1) ambient Dawn Heleos II detector (Part WH2) with integrated cell maintenance technology (COMET, Part WIC) and one (1) integrated fiber optic QELS device (Part WIQ) to replace the scattered light at multiple angles (MALS) detector [S/N 183-HHC] and the Quasi-elastic Light Scattering (QELS) device [DP TH01;S/N 160-DPTH]. The sole source justification is based on the following: The MALS detector is failing and unsupported by the manufacturer with no replacement available. The QELS device is no longer compatible with current operating system of the Wyatt Technology Corporation-built A4F system (Eclipse 3+) [S/N 3541-FAS]. NIST requires that the replacement components be compatible with NIST's current Wyatt Technologies A4F System. Market research has shown that Wyatt Technology is the sole provider of the required replacement systems compatible with the A4F system. Given these facts, the preferred vendor Wyatt Technology is the only source reasonably available to provide the required replacement components. The resulting purchase order will be a Firm Fixed Price purchase order. The NAICS Code is 334516 with a size standard of 1,000 Employees. No solicitation package will be issued. This notice of intent is not a request for competitive quotations; however, responses received by 11:00 am EST April 13th, 2016, will be considered by the Government. A determination by the Government not to compete the proposed acquisition based upon responses to this notice is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement.
