- The Pension Benefit Guaranty Corporation (PBGC) intends to award Mr. John Foster for professional services, non-personal, for the technical expertise and support for PBGC's Office of the Chief Counsel (OCC) regarding multi-employer pension plans. The Contractor shall provide technical expertise and support, based on extensive experience with multiemployer plans and his institutional knowledge, for OCC's Multiemployer Law and Policy Section in the application of the laws and the administration of the multiemployer insurance program under Title IV of ERISA. The Contractor shall provide the following services: • Technical expertise and support, based on extensive experience with multiemployer plans, multiemployer law, and institutional knowledge. • Assist the OCC's Multiemployer Law and Policy Section to assimilate knowledge on the application of the laws and the administration of the multiemployer insurance program under Title IV of ERISA. This will be done efficiently with the focused aim of transferring knowledge and information to attorneys in the section over a one-year period. PBGC does not intend to extend the contract. • Provide specialized advice and support on formal applications and other submissions by plans for PBGC review or approval, helping to evaluate complex actuarial, legal, and financial issues or matters, including transfers of assets and liabilities, and alternative methods for determining the allocation of unfunded vested benefits and alternative terms for the settlement of withdrawal liability. • Provide advice and support on first-time applications for partition and facilitated merger submitted by plans under the new Multiemployer Pension Reform Act of 2014. • Assist with the preparation of the PBGC contingency list that categorizes certain plans for possible future financial assistance for PBGC's annual financial statements. • Provide advice and support on technical issues relating to the administration of the multiemployer insurance program, including multiemployer mass withdrawal terminations, plan insolvencies, and the provision of PBGC financial assistance. • Assist in answering informal inquiries from practitioners and plans of a complex factual and legal nature. The period of performance is expected to be May 17, 2016 thru May 16, 2017. Interested parties may e-mail a written capability statement with sufficient experience for these required services, which shall not exceed 3 pages in length. Interested parties may submit their capability statements, and qualifications for the provision of this service, which may or may not be considered by the agency via email to Miller.Mark@pbgc.gov no later than 11:00 AM EST on April 1, 2016. This is not a solicitation, but a Notice of Intent. No solicitation will be issued
