Description

This is a sole source justification describing the Government's intensions to negotiate solely with Meso Scale Diagnostics, LLC. for award of custom build biological agent detecting kits in support of ECBC's mission. This is a NOTICE OF INTENT TO AWARD A SOLE SOURCE CONTRACT using Federal Acquisition Regulation FAR Part 13.5 (open market under SAT). The Sole Source Authority is in reference to FAR 6.302-1(a)(2), "when the supplies or services required by the agency are available from only one responsible source, or, for DoD, NASA, and the Coast Guard, form only one or a limited number of responsible sources, and no other type of supplies or services will satisfy agency requirements, full and open competition need not be provided for." The Army Contracting Command - Aberdeen Proving Ground (ACC-APG), Tennant Division is located at 6001 Combat Drive, Aberdeen Proving Ground (APG), MD 21005-3013. In coordination with the Edgewood Chemical Biological Command (ECBC), the following items are required for procurement: CLIN 0001 Biological Agent Detecting Kits; Qty: Twelve (12); Custom made by Meso Scale Diagnostics, LLC. The Government intends to negotiate solely with Meso Scale Diagnostics (MSD) for this procurement. The award will be made as a Firm-Fixed Price (FFP), sole source contract to Meso Scale Diagnostics, LLC. Meso Scale is the sole manufacturer of producing these types of custom biological kits to detect biological warfare agents using electrochemiluminescent technology. These kits are custom built to be used in conjunction with the MSD PR21800 instruments which are currently owned and being utilized by ECBC's laboratories. MSD has no resellers or authorized distributors. This firm is the sole developer/manufacturer /distributor of the product. The associated North America Industry Classification System (NAICS) Code is 325413 and the Business Size Standard is 500. This is not a Request for Quote (RFQ). It is the intension of the Contracting Office of ACC-APG to notify the general public of their intensions to negotiate solely with MSD for this award. If this is not truly considered to be a sole source based on the information contained in this notification along with the attachment labeled, "Abbreviated Justification and Approval", then all responses received within ten (10) days after date of publication of this notice will be considered by the Government. A determination by the Government not to compete this proposed purchase order based upon responses to this notice is solely within the discretion of the Government. Interested persons may identify their interest and capability to respond to the requirement no later than 3:00 P.M. Eastern Standard Time (EST), Monday, 04 April, 2016. Any response to this notice must show clear and convincing evidence that competition would be advantageous to the Government in future procurements.
