Description

Actuate Sole Source Justification N66604-16-P-1265 Synopsis The Naval Undersea Warfare Center, Division Newport, RI (NUWCDIVNPT) has a requirement for software NUWCDIVNPT utilizes for its strategic management and performance measurement program, BIRT Scorecard (formerly named PBViews). NUWCDIVNPT intends to award a firm fixed price purchase order on a sole source basis to Actuate Corporation, CAGE Code 1JAX3, San Mateo, CA 94404, for one (1) year renewal and maintenance of Silver Maintenance for 15 users. The required item is as follows: CLIN 0001 Actuate Silver Maintenance Renewal 15 users for 12 months Incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2005-87. The provision at FAR 52.212-1, Instructions to Offerors - Commercial Items applies to this solicitation. The provision at FAR 52.212-3, Offeror Representations and Certifications - Commercial Items applies to this solicitation. Clauses 52.212-4, Contract Terms and Conditions - Commercial Items and 52.212-5, Contract Terms and Conditions Required to Implement Statutes or Executive Orders-Commercial Items, DFARS 252.204-7008, Compliance with Safeguarding Covered Defense Information Controls (Dec 2005), 252.204-7009, Limitations on the Use of Disclosure of Third-Party Contractor Reported Cyber Incident Information (Dec 2015), 252.204-7012, and Safeguarding Covered Defense Information and Cyber Incident Reporting (Dec 2015) apply to this solicitation. Electronic and information technology Section 508, contract requirements compliance applies to this requirement. Therefore, Clause 56C Accessibility of electronic and information technology applies, see clause attached. The following addenda or additional terms and conditions apply: Defense Priorities and Allocations System (DPAS) rating is DO-C9. This solicitation requires registration with the System for Award Management (SAM) prior to award, pursuant to applicable regulations and guidelines. Destination Newport, RI (02841) This requirement is an unrestricted, sole source procurement as concurred by the NUWCDIVNPT Office of Small Business Programs (OSBP). The NAICS Code is 511210 and the size standard is $38.5 million. This notice of intent is not a request for competitive proposals. All responsible sources may submit a capability statement which will be considered by the Government. A determination by the Government not to compete this acquisition based on responses to this notice is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement. Payment by Government Purchase Card is preferred, but Wide Area Work Flow (WAWF) is also acceptable. Quotes shall include price, delivery terms, and the following additional information with submissions: point of contact (including phone number and email address), contractor cage code, and contractor DUNs number. Quotes received after the closing date and time specified will be ineligible for award. Quotes must be submitted no later than 2:00 pm EDT on Wednesday, 30 March 2016, to Naval Undersea Warfare Center Division Newport, Contracts Department, Code 0221, via email to Maureen Fauske at Maureen.fuaske@navy.mil.
