Description

The Department of Veterans Affairs, Network Contracting Office 7, intends to negotiate a five (5) year sole-source contract with BD Biosciences, 2350 Qume Drive, San Jose, CA 95131 on or around March 15, 2016 to provide service and maintenance to the BD FacsCanto Flow Cytometer, serial #V07300331, the conjoining BD software, and associated computer all of which are needed to sustain research approved and funded under VA approved merit grants for clinical head and neck cancer research for direct processing of patient samples enrolled in clinical trials. The machine and its software are imperative to the research and practices of the lab. Research use of these BD components is used on a regular basis for patient sample analysis as an essential tool for such purposes. Continual service maintained within the terms and requirements of BD are needed for the quality and functionality of the equipment. The purpose of this service contract is to ensure proper care and maintenance of the Flow Cytometer used for VA approved clinical head and neck clinical research. The machine, its software and computer are imperative to the research and practices of the lab. Research use of these BD components is used on a regular basis as an essential tool for such purposes. The Contractor possesses unique qualifications that require the use of the authority below. Continual service maintained within the terms and requirements of BD are needed for the quality and functionality of the equipment. The components of the machine maintain copyrights under the BD brand and are warranted under service with BD. The FacsCanto works solely on BD software which can only be accessed through BD technicians. Without the use and access to the software, the machine does not function for research purposes for which it was purchased. BD's software is continually updated and the current copyrights require the BD technicians as sole support for all software components. Technical support performed on the FacsCanto may require software to be reinstalled by BD technicians for machine functionality. Through the use and terms of BD's software agreements, no equal competitor is available to perform the necessary software and Flow Cytometer maintenance. No other service provider can guarantee up to date instrument parts when needed. BD Biosciences is the only service provider that can ensure updating of replacement parts when needed and are the only ones whom have to ability to service the BD software that runs the machine. NAICS Code: NAICS 334516, Analytical Laboratory Instrument Manufacturing (size standard 500 employees). This proposed procurement is for services for which the government intends to solicit and negotiate with only one source in accordance with FAR 6.302-1(b)(1)(i), Only One Responsible Source and no Other Supplies or Services will Satisfy Agency Requirements. This notice of intent is not a request for competitive quotes. However, interested parties may identify their interest and capability to respond to this requirement no later than March 1, 2016 at 1 p.m. EDT. A determination by the Government not to compete this proposed contract based on responses to this notice is solely within the discretion of the Government.
