Description
THIS IS A NOTICE OF INTENT, NOT A REQUEST FOR PROPOSAL. A SOLICITATION DOCUMENT WILL NOT BE ISSUED AND PROPOSALS WILL NOT BE REQUESTED. This notice is being published by the National Institute of Environmental Health Sciences (NIEHS) in accordance with Federal Acquisition Regulation (FAR) Part 5.201 and 5.204 requiring notice of a proposed contract action. This is NOT a request for competitive proposals. The statutory authority for this sole source action is 41 U.S.C. 253(c)(1) as implemented by FAR 6.302-1. Only one responsible source and no other supplies or services will satisfy agency requirements. Inherent duplication of cost to the Government and delays in service make competition not feasible. Award is subject to Justification for Other Than Full and Open Competition (JOFOC) approval. The National Toxicology Program (NTP), within the Division of the National Toxicology Program (DNTP), uses the commercial proprietary Hosted Provantis® Toxicology Data Collection & Reporting System (hereafter termed Provantis). Access to the Provantis database is provided by Instem LLS, the sole owner and distributor of Provantis. In accordance with FAR 6.302-1 and HHSAR 306.302-1, the National Institute of Environmental Health Sciences (NIEHS) intends to issue a non-competative modification to expand the access and scope of services provided under the contract. Instem, LSS is the incumbent for the existing NIEHS Contract Number HHSN273201300004C which was competitively awarded on February 27, 2013 with a period of performance of March 1, 2013 through February 28, 2014, with additional annual option years through February 28, 2023. The current contract provides access to Provantis through a specified number of annually purchased facility and user licenses. The NTP now requires access to Provantis in a greater capacity than the current contract allows for. Therefore, the NIEHS intends to negotiate on a non-competitive basis to expand the scope of the current contract to acquire additional user and facility licenses, and acquire expanded software services that are needed to continue providing adequate access to Provantis for the NTP and NTP contract laboratories. A brief description of the expanded needs is as follows: 1) Base contract subscriptions - The government requires an expansion of the Provantis subscription. The current base provides for a subscription of 100 user licenses for NIEHS and 1 facility, paid for annually. The government would like to expand this to 200 perpetual user licenses and 3 perpetual facility licenses. 2) The current contract provides an option to add up to 10 additional facility licenses over the life of the contract. The government would like to expand this to a total of 13 over the life of the contract in order to ensure NTP needs can be met adequately over the remaining years of the contract. 3) The current contract provides an option to add up to 10 blocks of 25 user licenses (250 licenses total) over the life of the contract. At this time, a change in this option is not being sought, as the NTP feels its needs would be met via the increase in perpetual user licenses. 4) The current contract provides an option to add up to 20 additional training blocks, in 32 hour increments, up to 640 hours over the life of the contract. At this time, a change in this option is not being sought, as the NTP feels its needs are currently met. 5) The current contract includes five (5) optional features to support specifically detailed NTP functions within Provantis. At this time, a change in these options is not being sought, as the NTP feels its needs are currently met. 6) The current contract includes software support which was used to develop specific NTP functionality within Provantis. This support was included in the base subscription price during the first 3 years of the contract. Due to the expansion of the government's needs for Provantis, the NTP now requires additional software support throughout the remaining years of the contract. Therefore, the government requires the addition of an option to add up to 3,000 hours of labor for software support in order to meet the NTP's expanded need to develop specific functionality for NTP tests. Provantis is accessed via the Instem Citrix portal. The NTP requires a quarterly summary of users of Provantis under this requirement who hold a current Citrix account to use Provantis under this contract. The NTP requires the ability to reassign Provantis Citrix users/Provantis users quarterly, at the discretion of the NTP, from users who no longer require access to Provantis to new users who do without a net increase in utilized seats (users). Facility licenses will be reviewed annually and may be reassigned at the discretion of the government. It shall be possible to pro-rate annual licenses in order to align with contract option years. Justification: Instem is the sole owner and distributor of Provantis software and access to and the use of Provantis cannot be obtained from any other source. Additionally, as owner of the product, Instem is the only vendor capable of providing annual support services or making alterations to Provantis, as required by the NTP. No other vendor is capable of supplying the services required. This notice of intent is NOT a request for competitive proposals. However, the Government shall consider all responses received within fifteen (15) days of this posting. A determination not to compete this requirement, based upon responses to this notice, is solely within the discretion of the Government. Written responses to this synopsis shall contain sufficient documentation to establish a bona fide capability to fulfill this requirement. NIEHS will not be responsible for any costs incurred by interested parties in responding to this notice.
